At the Planning Com�ussion's last mee�ing on February 19, 1997, the relationship beiween the
house and the proposed garage was discussed. Specifically, it was discussed that the proposed
garage may be ioo large for ihe site and the kome. To baiance this concern, the Planning
Commissian looked at the advantag�s of such a garage, such as creaiing adequate storage space
for the resident's vehicies and yard appliances. It was nofied thai zfi is desirable from a cornmunity
perspective �0 4�ave property owners improve fheir properties wifh garages since the proper�ies
are tkzen usually kept in better order. The full effect of the garage would be shielded from ei#her
street view. In this instance, �he benefits of such a garage outweigh any disadvantages.
The applicant is noi intending to alter the driveway's configuration in conjunction with the garage
constructian, but ,plans io do so in the near future. As presented, th� proposai meets all of the
criteria imposed by ihe Code, as addressed in the dimension�t requirements above.

1. Relationsl�ip ivith the Comprehensive P(an. f�y'`'�-`-�

The Comprehensive Plan encourages fihe development and maintenance of r�s,�.dential areas
sa as to unprove the quality, appearance and attractiveness oihousing unit�ar� resicfential
property in general. The Comprehensive Plan designates this property, 21���'Pinewood
Drive, low-density residentiai. This propasat does noi conflict with th� Comprehensive
Plan.
2. The Geographical Area Involved.
4. The Character af the Surrounding Area
The Iots u� this area are either the same size as the subjeci lot or are smaller. The homes in
this area are ot' a similar styie and consiruction, wiih detached or a�tached garages. Since
2185 Pinewood is a corner lot and also fronts County Road I, iti has more visibility than tke
ather homes zn this area. Although the proposed garage is larger than is iypical for the
area, the placement o#'the garage hides the bulk of it from view from adjacent streets.
3. Whether such use will tend io or actually depreciafie the area in which it is proposed.

Removing the existing, one car garage and replacing it with a new, targer garage would be �
a benefit to the area in the sense that it is an upgrade to an existing buiiding, and an
improvement ta the property.
The Demonstrated Need for Sucb a Use.
The applicant has stated that this garage is needed to store vehicles used fbr racing, a hobby
the residents partake in. Previously, the applicani was asked 6y the City to remove a large
car carrier from their rear yard. Currently, the car carrier is in the front driveway because
the existing garage is too small. A new, larger garage would enable the applicant to keep
ihe car cazrier and race cars inside, as well as other yard appliances. Keeping these items
within the garage as opposed fio outside will reduce the appearance of ciut#er on the
property.
WHEREAS, the Pianning Commission makes the fotIowing findings regarding the criteria
�or approval of a conditional use permit, as required by Section 1 I25.01 Subd. 3.b.:
(1) The use will not create a� excessive burden on e�sting parks, schools, streets and other public
facilities and utilities w3aich serve or are proposed to serve the area.
{7) The use will not cause tzaffic hazards or congestion.
(8) Adequate utilities, access roads, drainage and necessary faciii�ies have beetx or will be
provided.
The construction of an oversized garage to replace an existing garag� will not create a

greaier irr�pact on existing public facilities or services, on utilities or access roads, nor will it
create an appreciable increase in traffic on adjacent streets.. The increase in runo�'�rom the
Iarger structure is not signif can� and will noi a$`ect the drainage system.

(2) The use will be sufficiently co�patible or separated by dzstance or screening from adjacent
residentiaily zoned or used land so that exisiing homes will not be depreciated in value and
there will be no detexrence to develop�eni of vacant land.
(3} The struct�.u°e and site shall have an appearance ti�at will not laave an �dverse �ffect upon
adjacent residen�ial properties.
The placement of the garage so that the buik of the struciure is hiddea from street view wiU
provide adequate screening, and will preserve the residential character of the neighborhood.
The adjacent neighbors have no objeciion to the proposal.
{4) The use, in the opinio�x of the City Council, is reasonably related to the overall needs of the
City aa�d to the e�sting land use.
{5) The use is cousistent with the purposes of the Zoniug Cade and the purposes of the zoning
district irx which the applicant intends to locate the proposed use.
(6) The use is not in conflict with the Comprehensive Plan. of the City.
Garages are typical uses in residential areas, and allow for storage of v�hicles and ather
equipmeni. Having this garage will allow for the properiy to be kept izx better order and for
storage of larger-than-typical equipment. Improving neighborhoods by enclosing stored
items is beneficial to the community and consistenfi with commuzu�y goals. �
NOW, THEREFORE, BE IT RESOLVED that the Mounds V'iew Planning Commissian
recommends approval of the conditional use pern�it with the following stipulaiions:
The conditiona.i use pemut be recorded with Ramsey County witivn 64 days of City
Council approval, and a receipt of such recording shall be provided to the City of
Mounds View.
2. The garage shall be desi�ned arad maintained to provide a uniform building
appearance with the dwelling unit.
The garage shali not be used far living space or other, uses noi allowed by the
district in which it is located or by the Zoning Cod� �Should the
use c�ange for which the permit was granted, th� canditzomal i�se permit shall
become null and vaid.
4. Th� garage shall be situated parallei to the home such ihat it mainiain� a consisteni
distance from the sid� of the home closest to �he garage and not be set at an angle.

The applicant, Caral Hoopingarner, is requesting approval of a minor subdivision to create two
tots from her property locai�d at 8344 Groveiand Road. The Ciiy's subdivision regulations a11ow
for approval of a surveyor's ceriificate in these situations. A copy of the surveyor's certificate
showing the proposed lot split is attached. This property is a through Iot that fronts both
I�nollwood I�rive and Groveland Road. The applicant's home sits an the porCion of the lat
froniing Groveland. The lot is irregularly shaped, in that fihere is an additional3Q feet of larid

aitached to the southeast 211 feet of the lot. The applicant proposes to split the lot at a point
approximately 3 0 feet o�F center to the east.
I�sues:
At the last Planning Commission meeting on February 19, 1997, the issue was raised as Yo
whether or not the requested easements were excessive. The area in question is the land lying
between the existing N�P easement and the proposed rear property line of the lot fronting
Crroveland Road (PaYCei A}. A thirty-foot �vide drainage easement is present just south of th�
property, but does not e�tend through. Sta�requested the Ia,rid between the NSP easement and
the proposed rear property line be set aside for a drainage easement. The �esult is a wider than
normal easernent area of approximaiely 35 feei along the rear properiy Iine for Parcel A.
PIanning Comrzussion requested staffto meet with the appiicant to detemvne the best course of
action from �tlze applicant's perspective. They pcefer having the easement as propased. Staffatso
feels t�at it will cause Iess confusion in the field to have the entire area beiween the NSP easement
and the rear properiy line ir� easement. The easement doct�ments being prepared by the applicant
would create the 35-f00% v✓ide easement area.

square-foot foundation for ZEP Manufacha�ing, a national company specializing in the rrianufactur�
and sale of specialty janitorial, sanitation and maintenance chemicals. This facility would serve as a
sales support and disiribution warehouse. No manufaciuring or packaging would be done here.
The building would consist of 5,950 square feet of offtce space (which includes 2,500 square feet of

This project will require approval af a wetland alteration pemut because grading is being don� in
the buffer area for the detention pond and a portion of the parking lot is in the �uffer area �s well.
The �irst �tem can be handled as an admix�istrative approval by staff; tlne second requires City
Councii approvai. These requiretnents are reflected in the conditions of approval recommended by
Resolution No. 496-97
Parking: The last issue of significance with Yt�is project is the parking situation, which was
discussed at your last meeting. The parking ratios in the Zoning Code would require 87 spaces far
this faciliiy.
VVarehouse: 19,325 sq.ft. divided by 500 + 8 spaces = 38.65 + 8= 47 spaces*
Qffice: 5,954 sq.it. divided by 175 + 3 spaces = 37 spaces
� Total: 84 spaces
� Each fraction of 1/2 or more shall coastitute another space (Section 1121.08. Subd. 1)
�taff has prepared a resolution approving a variance request in the pazking ratios which will apply
fio ttus property. Tkte revised ratios would result in a requiremeni for 43 spaces (19 spaces for
warehouse; 24 spaces for office). The site pian shows 42 spaces. Staff is suggesting tha� �.vo more
spaces be shown at the end of the parking bay across the front of the properiy, so the total
provided is 44 spaces. The resolution includes a condition to ti�is effeci, and a requirement thaic ttte
applicant is obligated to build up to 40 additional parking spaces if it is deemed necessary by the
City. The site plan shows sufficient area is available to build an additiona143 parking spaces.

This site is heavily wooded, a portion of which lies in wetland. While #here is ample room

has shown that the Mounds View paricing requirements are muc� higher in comparison to
neighboring communities and communities across the counfiry. The applicani is not
respor�sible for the City'"s parking requirements. It is advantageous io retain natural areas as
opposed to paving them for parking lots, if the parking provided will be adequate for the
use proposed.
b. The literal intezpretation of the provisions of tIus Title would deprive the applicant
of righis comm,only enjoyed by other properties in the same district under the texms of t�is titte.
d. Th�at granting the varianee requested will not confer on the applieant any speciai
privilege that is denied by this title to owners of other lands, slrucEures or

The higher-than-norrnal parking requirements for offce and warehouse square footage
creates an undue burd�n on the applicant, and similar considerafi�on would be given to
other requests from developers who are proposing to build similar facilities. The
developnnent to ihe south, the Bridges Technotogy Center, was granted a similar parking

In July of 1994, VVilliam Liggett, representing Colonia� Village Park, made application to amend the
Zoning Code reiating to the R-5 (Mobile Home District) to allow the display and sales of model
mobile homes. The Planning Com�nission approved the Code amendment on November 2, �994,
sendir�g the amendment on the City Council. Befare reaching the Council, however, Paul
Harrington and Jim Thompson (the City's respective community development coordinator and
attorney at that time) �ogether reinie�preted the Code and decided that the use was a permitted
condi�ional use. On January 4, 1995, the Planning Commissian approved the CUP applicatian,
sending iti on the City Council. Th� Council approved the CUP on February 27, 1995.

was sta.�s understanding ihat th� oniy Code violation on the rnodei homes was that they were
missin� the s�condary sta.ircases. This has since been resolved. We ar� now aware, however, ihai
the staircases and entrance platforms at the primary enirance are no� in compleie compliance with
the Code in terins of the handrails and ihe height and width of the steps. This has been an ongoing
problem with no� only the model homes but other homes in the park, In the past, there has been
somewhat sporadic enforcement on this item due to workload. We have started enforcing ihis
provision, but consider ii to be larg�r issue than just the model homes. It is staff's pre%rence to
address the existing staircases through an overall approach to enforc�ment in Colonial �Iillage, or
to provide a iune frame for the model homes to be broughi i�to compiiance.
The con�ingencies on the orig�nal CUP have been meti as %llows; Th� f rst required that ih� CUI'
be recorded with Ramsey Couniry, �which has been verified. �'he second contingency required that
the number of units available nat exceed six percent of licensed lots. There are currently 194 lots
within Colonial �Iillage, of which only three are model homes (refer to the site plan.) Tlus
represents a percen�age of less than two perceni. The third eontingency required that the mod�I
homes be insta.11ed in complianc� with all City and State regulations. An inspection by �iick Jarson
on Febnaary 28, 1997 verified that ihe secondary sta.ircases have been added as reques�ed. (Another
code compliarice issue is noted earlier in this report.) The fourth requirement states that the Ciiy be
seni a list of homes offered for sa1e, updated every month. 'The City has these notices on file,
indicating that this requirement has been met. The fifth requirement puts limits on the hours of
walk�throughs. Carol Mueller, ihe pa.ric manager, responds ihat they adhere to tkese hours. Staff
has not received any complaints stating o#herwise. The last requirement specifies that the CUP be
reviewed after one year.
Stiaff' is unaware of any problems associated with the CUP and does not have any documented
complaints regarding Coionial V'illage or its display and saies of znodel homes on file. Staffhas
notified the park residents as well as tihe residents within 350 feet of Colonial Villa�e regarding the
review of tlus CUP in order to solicii any commenis or concerns they may have.

The CUP does not conflict wi#h the Compreh�nsive Plan.

This area is trailer park tocated in the narth-easterr�osi section of the City, surrounded by
four-plexes and dupiexes on th� south and west sides ana Interstate 35W and I�ighway
118 to the east and north. Given thai the trailer park is existing, there are no adverse
e�ects to th� area expected from continued sale of model hom�s. ihe sut°rounding area is
5hOW1IIg SOYT16 Si�i15 Of ��1$Il�; some of �he four9plexes in the area are in a state of
disrepair. Improving the quality of hausing in fihis area� is a benefit io everyone, and may
serve to motivate neighboring property owners to iake better care of'their homes,
buildings and properties.
Wbefrher such use will tend to or actuaiiy depreciate the area in whicix it is proposeci.
The CUP allows for the display a.nd sales of model homes. The intent is to improve the
level of housing quality gresent in the park. The area should not depreciate as � r�sult of
bringing in nev�ver, higher quaiity homes.
The demonstrated need for such use.
Having the CUP to display and sell model homes has allowed Colonial Vill�ge to improve
the overall condition of ihe park.
WF�EREl�S, the Pianning Commission makes the following fndings regardin� the criteria
for approva� of a conditional use permit, as required by Section 1125.01 Subd. 3.b. af the
Municipal Code:
(1) 'l�e use will not create an excessive burden on e�cisti�g parks, schools, streeis and other
pubiic facilities and utilities which serve or are proposed to serve the area.
{7) Tlie use will not cause traffic hazards or congestio�.
{8) Adeqnate utilities, access roads, drainage and necessary facilities have been oc will he
provided.
The model homes will be located on existing lots whicix are served by existin� parks,
schools, streets and other public facilities. No additional demands on serv�ces, utiliYies,
access roads and drainage are aniicipated. The level of tra�f°ic to the model hom�s has n.ot
caused tra.ff°ic hazaxds or con�estion.

(2} The use wiII be sufficiently compatihle or separated by distance or screening from adjac,�nt
residentiatly zoned or used la�d so that e�sti.ng �iomes will not be depreciated in value and
ti�eze will be no deten-ence to development of vacant land.
(3) The structure and site sha31 have an appearance that will not have an adverse effect upon
adjacent reszdential properties.
The use involves the placement of higher-qua.lity models of mobile homes onto existing
lots, wh�ch will remain in place when sold. This use is expected ta have a pasitive eff°eci
on the quality of housing in fihe park, and wiii cause possible appreciation rather than
deprecia�ion of adjacent propert�es.
(4) The use, in th� opinion of the City Council, is reasonably related to the overail needs of irhe
CiCy and to the existing land use.
(S} Tb.e use is consistez�t with the purposes of the Zoning Code azzd the purposes of the zonin�
district in which the applicani intends to locate the proposed use.
{6) The use is not iu coe�flict with th� Comprehensive Plan of the City.
The C�ty has identified the need for upgrading the qua.lity ef� housing in M[aunds �1iew.
both in the Comprehensive Plan and in the Mounds View Focus 2000 projeci. The Focus
''; 2004 report stated as an actzon step: "increase support to owners ofmanufactured horrze
parks to encoucage upgrades and improvements." The sale of higher-quality mobile
homes in Colanial Village, wk�ich will remain in pl�ce when sold, is consistent �,vith this
direction. Both the Comprehensive Plan and the Zoning Code identify ihis area for
development and operation of a mobile home park. Dispiaying models of mobile homes
for sale in Coloniai Village is very s�zitable, and will heip iti achieving the overall need to
� improving this mobile home park.
IV�W, THEREFQRE, BE IT RESOLVED that the Mounds View Flanning Comm�ssion
recommends approval of the conditional use permit with the following stipulations:
The number of units availabie for saie at any one time shall not exceed six percenfi
of the licensed lots.
2. The modeis offered for sale sha11 be instailed in compliance with all applicable City
and Stat� regulations goveming manufa�red homes. The stairways and entrance
platfarms for the primary entrances sha(1 be broughi into cornpliance wiih the
Buildin� Code by June l, i997.
3. A current Iist of properties, updated monthly, upvn which model homes are
offered for sa1e, shall b� provided by the applicant and kept on fiIe at City Hall.

has been vacant since 1995. The site is currently owned by Norvaest Baeilcs. In Tan�aary of 1996,
the �ity Council approved Ordinance No. 580, which amon� other things, established a rtiinimum

In �eptefnber of 1996, I�on Ostrander and Bruce MacDonald applied for a condiiional use permifi
to allow for an auto repair business at this site {Planning Case No. 460-96). Th� Planning
Commission heard this appiication on October 9, i 996 after which the applicanis withdrew th�ir
request. The Pianning Commission's comments as �vell as the staffreport on this earIier case were
given to the present applicants to guide them in the development of their plan.
On January 9, 1997, I�en C1ark, represeniing $pots Quick Lube, Inc., submi�ted an application far a
conditional use permit to allow for minor auto repair at the Auto Central site. There are no plans
to structurally aiter the present building.

Access:
'The site plan ind�cates iwo 16-foot wide access points onto Spring I.ake Itoad and none onto
Highway 10. The two existing entry points from Highway 10 are proposed to be �losed offwith
the driveways and culverts removed. Staff believes that the two access onto �pring Lake Road
pose nuyneraus problems and requires that ihe site pIan be revised to irzdicate one 309foot wide
aceess point onto Spring I.ake Road in the general iocation of the northernmost access point.
Draina�e;
The applicani will be installing three catch basins on the site to help route water to the Higl�way
10 drainage ditch as it will no longer be able to flow freely to the ditch with the addition of
curbing. The amount of drainage runoff will decrease since, under the applicant's plan,

"I°he drainage w�ll flow to MnDOT right-af-way so the applicant will need a Mn]70T pernut to work in their
right-of-way. Rice Creek Watershed DistricC shoiald alsa be no�fied to verify that they do not have any
concems on this project. The Maunds View Hfydrologic Review data sheet is attached for your records.
Runoff calculations were not ir�cluded as part of the submittal. Since the Iand use is not changing a. >''
irnpervious surfaces are not being increased, deCailed calcttlations are rcot required. However, a�ading plan
that shows the existing drainage and one with the proposed draiztage plans should be provided for reference.
Since the storm sewer system will rep�ace the existing dra�inage system which currently flows directly tio the
MnDOT di.tch, there are small drainage changes which should be noted by the applicant.
The proposed entrance wiU need a more detailed review in regards to traffic. I showed the site plan to our
trafftc engineer and he indicated a concem an the tocation of the entrance to the site. If cars are stacked to
get into the site, it could cause a problezn to vehicles tucning anto Spring Lake Road from Highway IQ. A
better atternative �ay be to make the north entrance a one-way in and the south entrance a�one-way out.
Before the site is presented to Council, the applicane should lzave a traffic e�gi�eer provide input an the
location of the drives. If the city desires, we are availahle to do a rnore detailed review of the site to
deterriune actual site distances and entrance Ia�caiions. Fees for a more complete review af the site will need
reimbursad.
- The last consideration is the actual connection of the drives io �pring Lak� Raad. Sprin� Lake Road is
scheduled to be reconstructed in I998. If the drives are incorrectiy insCalled, they would need to be
reconstructed as part of the roadway improvement project. A 1zt�file foresight shovid prevent this. Also, the
road will be reconstruc�ed ta State Aid standards which may put a restricrion on the iocation of their
driveways. Prior to approval, the applicant should check with State Aid standards to verify that the locatian
of the drives will not i�e in violation of future requirements.

Permit to operate an automobile lubrication �°e�ail facility at the above-referenced

The name of the business a� this location will be Spot's Quzck Lube, Inc., ����� 1� �
sister company of BiII Clark Oil. BiII Clark Oii has been involved in the wholesale of
lubricants for 34 years and is a substantial corporate citizen in Eden Praarie.
I anticipate that this business will employ 5 full-tizne and several part_tirr�e �rri�l�y��s.
In addition, I anticipafe �hat while the success of the business will be enharzced t�y #he
weII-traff cked Highway 10, we wiil alsa attract business to the streei that will b�n��g

will ensure the addition of an atlractive business on the street and maximize on curb cuts

requested fiarther revisions. This ord°uzance would provide five exempf�ons #o the usuaI
requirement to mow "tall grasses" in excess of eight inches. The ex�mptions would include fihe
following situations:
i. Native wetland vegetation fouzrd ir� floodpla.�ns, drainage ponds or ditches which s�ore
and convey stormwater
2. Aiative vegetation found an naiurai areas wiuch are part of public open space, parks and
nature centers.
Natural plantings, weiland and meadow vegetation indigenous to 1Viuuiesota, grown on
any occupied Iot or parcel of land and maintained as part of a la.ridscape treaiment or
garden area approved by the Direcior of Communi�y Deveiopment.
4. An ar�a where the land and vegetation appear not to have been �raded, landscaped,

requested further revisions. This ordinanc� would allow day care centers and group nurseries as a
conciitional use in fihe B- I, �-2, B-3, �-4 and I-1 districts. The criteria for review of ihe
cQnditional use perrnit were proposed to nnirror the criteria wiuch are now applied in the
residential districts. These cri�eria are:
a. No overni�ht faciliiies are provided for the children served. Children are delivered
and removed daily.
b. The front yard depth shall be a minimum af t%irty five feet (35'}.
c. Not less than forty (40) squa.re feet o� outside play space per child be provided and
�hat such space be suitably fences ancUor screened in accordance with conditions as
specified by the City Council.
d. Adequatie off-street parking and access is provided, in compliance with Chapier
1121 af tlus Titie.
e. Adequate off-sireet Ioadin� and service entranees are provided in compliance with

Two issues were of concem to Ciiy Council:
If day care ceniers are placed in business and industrial disiricts, it is possible that they wili

subjecied to higiier levels of exhaust fumes. The question was asked whether a crit�r�a
should be added which would address this possibility.

way to address this issue is to direct attention to Highway 10, �vhich carries a very hi�h volur�a� c��
traffic and is uruque in ihe community, and decide whether or not a distance requirement from
Highw�y 10 is needed. If arterial and callector streets are included in general, e�sting etement�
schools and day aare centers will become non-conforniing {examples: Pix�ewood Elementary,
Sunnyside Christian I]ay Care). Even if our atiention is confineci to Highway 10, any distance
requirement wiih make Kinder Care a non-cor�forming use.
As a starting point for discussion, staffwouId suggest a distance requiremeni of 250 feet.
Sta� has called the Minnesota Department of Human Services to learn whether air pollution teveis
are considered in issuing licenses for day care centers, and they responded that this item is not
regulated. We are checking with thE Minnesota Pollution Control Agency.
Dis#ance Requirement from Certain Businesses:
The City Code requires that premises holding a intoxicating liquor license be 500 feet from any
schaol or church except th�t the 500 foot requiremeni shati not apply to �ny premise that receiv�s
afi least sixty perceni of its annual gross sales revenue form the sale of food (Section 502.05,
Subd. 2}. Day care centers are noi mentioned as one of the uses triggering the 500 %ot distance
requirement. Iiit is the City's desire to have new day care centers located at Ieast 500 fee� from
liquor establishments, then a cri#erion to this e�ect needs to be added to the conditional use
pe�nit requirements for d�y care ceniers. Adding tfus criterion will not prevent new liquor
establishmer�ts fro� locatin� within 500 f�et of an existirag day care center. The liquor cod�
would need to be amended to a,ddress this issue.

The City Code requires a ticense for adult establishments w�iich i�clude: adult body painting
studios, aduli bookstores, adult cabareis, companionstup esiablishments, conversation/rap parlo�s,
aduit health/sport club, adult hoteVmotel, adult massag� parlor, adult mini-motion picture th�ater,
adult modeling siudio, adultmotion pict�are arcade, adult mation picture theafer, aduli novelty
business, adult sauna, adult steam room/bathhouse facility. �uch establishments shall not be
Iocated within S00 feei of a residential zorung district, public facilities zoning district, school,
church, library or commercial day care center.
These regulations wili prevent new adult establishments from locating withiri 500 feet of existin�
day care centers, but will not prevent a�etiv day care eenter from locating withirf 500 feet o� a.n
existing adult business. To address t4us situation, a distance requirement needs to be added to the
criteria appticable to day care cenYers.
Options:
1. Recommend ti�at the following distance requirements be added io the criteria for app�o��d
of conditional use permits for day care centers and group nurseries in busaness and
in�aCStyz°a�l districts:
a. 250 feet from Highway 10 right-of-way Iine
b. 500 feet fram any establishment holding either a.n on-sal� or off-sale intoxicatin�
liquor license, except that the 500 foot requirernent shall not apply to any
establishment receiving at least si�cty percent of its annual gross saies revenue fr��
the sate of food
c. 500 feet from any adult establishment
2. Recommend Option 1 plus adding the distance requirements to #he r�si�erat�al districts
(recognizing that Option #2 �vvill make Kind�r Care a non-con�forming use but will treat a�ll
day care uses the same relative to Highway 10)
3, Recommend that Ordinance No. 595 be adopted as ari�inally praposed.
