RESOLUTION NO. 08-81
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RECOMMENDATION TO CITY COUNCIL REGARDING PLANNING CASE 71-80
WHEREAS, the Mounds View Planning Commission has reviewed the
application of James A. Trapp regarding accessory building at 8018
Sunnyside Road; and
WHEREAS, this piece of property is similar to other properties
in the immediate neighborhood and in the City as a whole; i.e., not
unique in character; and
WHEREAS, the Mounds View Code Section 40.04 Subd. D(4) limiting
the size of an accessory building to two hundred sixteen (216) square
feet and no more than twenty five (25) percent of the rear yard is not
restrictive, when applied to the property at 8018 Sunnyside Road, but
rather maintains a uniformity which enhances the properties in this
community; and
WHEREAS, the applicant has not demonstrated the existence of
unnecessary hardship unique to the property;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends to the City Council that the request for condi-
tional use, to construct an accessory building which would be in
excess of the City Code allowance of two hundred sixteen (216) square
feet, be denied.
