RESOLUTION NO. 11-81
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL FOR MR. DONUT FOR A
CONDITIONAL USE PERMIT, MINOR SUBDIVISION AND DEVELOPMENT
AGREEMENT EXECUTION
WHEREAS, Scott Builders, Inc. has requested approval to construct
a convenience food establishment, Mr. Donut; and
WHEREAS, approval to construct the convenience food establishment,
Mr. Donut, requires the City to approve a conditional use permit, a
minor subdivision and a development agreement; and
WHEREAS, the Planning Commission of Mounds View has reviewed the
request by Scott Builders, Inc. and provisions of the Mounds View Muni-
cipal Code pertaining to conditional use permits, minor subdivisions and
development agreements; and
WHEREAS, the Planning Commission has received and reviewed reports
from the City staff and consultants regarding the request and its appli-
cation to Mounds View Municipal Code;
�. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends approval of Scott Builders, Inc. request to the
Mounds View City Council with the following considerations:
1. A conditional use permit be granted to include the following
provisions:
a) Joint parking covenants be required between Brooks
Superette and Mr. Donut to be filed and be of record
at Ramsey County Court House.
b) All conditions pertaining to the specific site are
subject to review and change when the City, upon
investigation in relation to a formal request, finds
1) general welfare and public betterment can be
served as well or better by modifying the conditions;
and 2) upon a change in ownership.
2. Minor subdivision be granted to include the following provisions:
a) Drainage easements be recorded for the ponding require-
ments of Resolution No. 983.
b) Utility easement for Brooks Superette be granted at
the time they are located or relocated.

3. Development agreement be granted to include the following
provisions:
a) Exhibits:
1) Site Plat
2) Surveyors Certificate
3) Legal Description
4) Resolution No. 983, Security Requirements ($1,000)
5) Building Plans and Specs
6) Joint Parking Covenants
b) Park Fund Dedication
C) Security for development in the amount of $23,750.00
d) Exhibit 2A to require the following:
1) Payment of City expenses as they may occur.
2) Utility services for Brooks Superet.te shall be
relocated if they fall within 5' of the foundation
of the Mr. Donut structure. After relocation proper
easements shall be filed.
