RESOLUTION NO. 34-81
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
PLANNING COMMISSION ACTION REGARDING PLANNING CASE 92-81,
A CODE APPEAL
WHEREAS, the applicant, Gerald H. Fields, has applied for a
building permit which includes the extension of a four foot deck on
the front of his home at 2255 Lambert Avenue; and
WHEREAS, the Mounds View Zoning Code, Section 40.05, Subdi-
vision D, lists structures that shall not be considered encroachments
on yard setback requirements; and
WHEREAS, the proposed four foot deck is not listed in Section
40.05, Subdivision D as an exception to setback requirements; and
WHEREAS, the Mounds View Planning Commission has reviewed the
request and considers the four foot deck an architectural feature
that is in conformance with other exceptions listed in Section 40.05,
Subdivision D;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission approves the code appeal of Gerald H. Fields at 2255
Lambert Avenue as requested in Planning Case 92-81;
BE IT FURTHER RESOLVED that the Mounds View Planning Commis-
sion will, in the future, recommend to the City Council that they
amend Section 40.05, Subdivision D, to include such architectual
features.
