STATE OF MINNESOTA
RESOLUTION RECOMMENDING THE AMENDING TO CHAPTER 40 OF THE
MOUNDS VIEW MUNICIPAL CODE REGARDING SENIOR CITIZEN HOUSING
WHEREAS, the City of Mounds View has received a request to
construct a 40 unit senior citizen housing project; and
WHEREAS, the Mounds View Municipal. Code does not address
design criteria for senior citizen housing in its zoning sections;
and
WHEREAS, the Planning Commission finds the need to regulate
these types of developments from a zoning perspective; and
WHEREAS, the Planning Commission has met, and is recommending,
that senior citizen housing be included as a conditional use in an
R-4 residential district; and
WHEREAS, following surveys conducted of other senior citizen
•projects in the metropolitan area, the Planning Commission has
established a definition for senior citizen housing and also specific
parking requirements;
NOW, THEREFORE, BE IT RESOLVED that the following code
clarifications are being recommended:
40.02, Subd. B (all definitions following senior citizen
housing would be renumbered)
Senior Citizen Housing. A residential housing development,
or that portion of a housing development, in which 60 percent
or more of the units are designed for occupancy by individu-
als over 60 years of age or by an elderly couple with one or
both members over 60 years of age (40.13, Subd. D).

(28) Senior Citizen Housing. At least a total of one Cl)
space per housing unit including not less than one (1)
designated handicapped space per handicapped housing unit
and at least 25% of the total spaces shall be no less than
11' by 20' or equivalent angle stall, including the designated
handicapped spaces.

a. Sixty percent or more of the units, exclusive of any
occupied by the caretaker, shall be designated for
occupancy by the elderly for a duration of at least ten
years. No amendment to the conditional use permit that
changes the designation of these units for occupancy by
the elderly shall be made within ten years. Any such
amendment after ten years must be adopted by a 4/5 vote
of the members of the City Council.
b. If required: by the City, the owner of the property shall
record a covenant on the property executed in a form
approved by the City which indicates the fact that the
property is designated for occupancy by the elderly.
d. The development provides for a lounge or other inside
common areas amounting to at least 15 square feet for
each unit.
e. The development is provided with other special features
which meet the needs of low and moderate income elderly
persons. '
f. The site shall be of adequate size to accommodate the
required number of parking spaces should the facility
convert to other R-4 permitted uses, and will meet the
requirements of Section 40.05, "Yard Requirements".

C. The development is assisted by the U.S. Department of
Housing and Urban Development under one of its programs
for housing low and moderate income elderly or such
housing is constructed and/or operated by a profit or a
non-profit organization which can demonstrate
experience and a commitment to housing for the elderly,
and provided such agency shall record at least a 20 -year
covenant and other land use controls on the property,
executed in a form approved by the City, which will limit
use of the property or a portion thereof to the occupancy

by the elderly under the terms of the provisions governing
senior citizen housing.
d. The development provides for a lounge or other inside
common areas amounting to at least 15 square feet for
each unit.
e. The development is provided with other special features
which meet the needs of low and moderate income elderly
persons. '
f. The site shall be of adequate size to accommodate the
required number of parking spaces should the facility
convert to other R-4 permitted uses, and will meet the
requirements of Section 40.05, "Yard Requirements".
