STATE OF MINNESOTA
RESOLUTION DENYING A VARIANCE REQUEST FOR
7090 SILVER LAKE ROAD FOR OVERSIZED CURB CUT
WHEREAS, Mr. Don Gaetke, Owner of the property located at
7090 Silver Lake Road, has requested a variance for an oversized
curb cut; and
WHEREAS, the Owner has submitted a sketch which shows the
proposed curb cut as being Fifty (50) feet in width; and
WHEREAS, the Planning Commission has reviewed this sub-
mission as well as staff reports; and
WHEREAS, Mounds View Municipal Code, Chapter 40.07, Subd. D
(8) (g) states:
No curb cut access shall exceed twenty-two(22)
feet in width for R-1 residential areas

and;
WHEREAS, the Planning Commission finds no unique hardship
regarding the variance request;
NOW, THEREFORE, BE IT RESOLVED that the.Mounds View Planning
Commission denies the variance request of Don Gaetke, 7090 Silver
Lake Road, for an oversized curb cut due to lack of hardship meeting
the requirements of the Mounds View Zoning Code;
BE IT FURTHER RESOLVED that although the Planning Commission
has offered Mr. Gaetke the option to withdraw his application and
receive a refund, he has refused this offer.
