RESOLUTION NO. 69-83
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING THE VARIANCE REQUEST FOR
RICHARD EMERSON AT 2070 OAKWOOD DRIVE
WHEREAS, the owner of 2070 Oakwood Drive, Richard Emerson,
proposes to construct a second story only addition to his house;
and
WHEREAS, this addition is proposed to come within a distance
of 5 feet 4 inches from the east property line; and
WHEREAS, since this property is located on a corner, minimum.
setback is 30 feet; and
WHEREAS, from the original lot width of 105 feet, 45 feet
was taken for frontage road right-of-way, leaving a 60 foot frontage;
and
WHEREAS, the Mounds View Planning Commission finds this 45
foot frontage right-of-way taking as a hardship by which a variance
is justified; and
WHEREAS, the property presently has two unimproved driveways
which have been grandfathered in;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission approved the request for a 24 foot 8 inch variance for
required side yard setback for 2070 Oakwood Drive;
BE IT FURTHER RESOLVED that the existing non -conforming
unimproved driveways be allowed to remain.
