RESOLUTION APPROVING A REAR YARD SETBACK VARIANCE FOR
THE PROPERTY LOCATED AT 2581/2583 COUNTY ROAD I
WHEREAS, Mr. Roger Koopmeiners, owner of property located at
2581/2583 County Road I, proposes to construct a duplex upon this
lot; and
WHEREAS, Section 40.02, Subdivision B(62) defines the front
lot line for corner properties as being the shortest lot distance; and
WHEREAS, for the property under construction, a corner lot,
the front year line, by definition, is located on the Greenwood Drive
side; and
WHEREAS, per Section 40.05, Subdivision C, and as a result of
setback distances for adjacent structures, the front yard setback on
the Greenwood Drive side must be 44 feet; and
WHEREAS, the 44 foot front yard setback combined with the

size of the proposed building to be located on the property would
result in a rear yard (east side) setback of 23.5 feet; and
WHEREAS, a 30 foot rear yard setback is required by Code; and
WHEREAS, per the original plat of Bayport Acres, the intent
of the two R-2 lots which front County Road I is to provide a buffer
to the R-1, Single Family lots immediately north; and
WHEREAS, the Planning Commission is requesting that the build-
ing fronts County Road I to minimize impact on Greenwood Drive and
the applicant concurs with this request; and
WHEREAS, the request that the proposed building fronts County
Road I will necessitate a rear yard setback variance of 6.5 feet; and
WHEREAS, the side yard setback on the north side of the building
will be 33 feet; and
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission approves a 6.5 foot rear yard setback variance. The rear
yard is defined as the yard on the east side of the proposed building.
A hardship is demonstrated as a result of the requirement to front
the building on County Road I in addition to the required setback of
44 feet on the Greenwood Drive side, which is much in excess of the
• 30 feet normally required for corner lots;
BE IT FURTHER RESOLVED, based upon proposed zero lot line
standards, that the granting of this 6.5 rear yard setback variance

will preclude this property from dividing using the zero lot line
concept as proposed for Chapter 40 of the Zoning Code.
