G. Engen is requesting a variance to allow for a permanent driveway surface within the five- .. - :. - - - - . .� .... •r. _en s exis ing asphalt driveway needs to be replaced and it is his desire to replace the asphalt drive with a cement driveway surface. The existing driveway is within a foot of the side yard property line. In his letter requesting the variance, Mr. Engen desires to retain the driveway at its current width to allow him access into the garage while parking vehicles on the side of the drive. If the new driveway were to be located so that it would not encroach into the five-foot side yard setback, a fence and 40 year old trees would need to be removed. The next-door neighbor impacted by this request has submitted a letter indicating their approval of a cement driveway closer than 5 feet to their property line. • Analysis: Section 1104.01, Subd. 4 of the Mounds View Municipal Code requires that driveways be set back five feet from side yard property lines. This dimension may be reduced to'one foot for temporary surfaces with permission from the abutting property owner. Temporary surfaces, according to the Engen Variance Request Planning Case No. 496-97 August 20, 1997 • Page 2 Code, are gravel, brick, or asphalt. The neighbors affected by this proposal, Frank and Judy Silvis of 2237 Oakwood Drive, have submitted a letter indicating their approval of a cement drive next to their property line. It is stars opinion that, for all intents and purposes, cement driveways are just as"temporary" as asphalt driveways. Were it not for the reference in the Code that disallows cement drives within the five foot side yard setback, staff would be supportive of this request. The Codes of this City have been put into place to ensure the orderly growth and development of the community while simultaneously protecting the health, safety, general welfare, comfort and repose of the residents. To deviate from these Codes, there must be a compelling reason to do so. There are seven standards which need to be met in order to justify the Board of Adjustments and Appeal's granting of a variance. These criteria are stated in Section 1125.02, Subd. 2 of the City Code. All seven of the criteria have been met. Recommendation: Staff recommends approval of Planning Commission Resolution 525-97, a resolution approving the variance request of A. G. G. ENGEN TO ALLOW FOR A PERMANENT DRIVEWAY SURFACE WITHIN THE FIVE-FOOT SIDE YARD SETBACK AT 2229 OAKWOOD DRIVE; PLANNING CASE NO. 496-97 WHEREAS, the Mounds View Planning Commission has reviewed the request of A. G. ENGEN, residing at 2229 Oakwood Drive; and, WHEREAS, this property is zoned R-1, Single Family Residential District and is legally described as: Lot 26, Block 6, Pinewood Terrace No. 3, Ramsey County, State of Minnesota WHEREAS, the Planning Commission has reviewed the following documents associated with this request: • 1. Planning Application 2. Zoning Map 3. Site Plan 4. Photographic Documentation 5. Letter from Applicant 6. Letter from Neighbor 7. Planning Commission Resolution No. 525-97 WHEREAS, the applicant requests a variance to allow for a permanent driveway surface to be located within the five-foot side yard setback at 2229 Oakwood Drive; and, WHEREAS, exceptional or extraordinary circumstances apply to this property over which the applicant have had no control, in that the existing driveway currently encroaches into the five- foot setback and installing a new driveway of the same width not in the setback would necessitate the removal of a fence and significant trees; and, WHEREAS, the literal interpretation of this Code would deprive the applicant of rights commonly enjoyed by other property owners in the same district, in that other property owners are allowed driveways as wide as 35 feet and that because of the mature trees, the applicant would be unable to retain the driveway at its current width or location if replaced WHEREAS, granting the variance requested will not confer on the applicants any special • privilege that is denied by this Title to owners of other lands, structures or buildings in the same district in that driveways in single family residential districts may be as wide as 35 feet; and, Planning Commission Resolution 525-97 Engen Variance August 20, 1997 Page 2 WHEREAS, the variance requested is the minimum variance which would alleviate the hardship in that a driveway at this width allows for just enough room to park two vehicles side by side; and, WHEREAS, the variance would not be materially detrimental to the purpose of this Title or to other properties in the same zone in that permanent surfaces such as cement poses less of an environmental impact and is aesthetically more pleasing than gravel, a common temporary parking surface; and, WHEREAS, the proposed variance will not impair an adequate supply of light and air to adjacent property or substantially increase the congestion of the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood in that the variance requested would allow for the replacement of an old, disintegrating asphalt drive with a new aesthetically pleasing cement drive in the same location. NOW, THEREFORE, BE IT RESOLVED, that the Mounds View Planning Commission acting as the Board of Adjustment and Appeals approves the variance request of A. G. Engen, residing at 2229 Oakwood Drive, with the following conditions: 1. A notation shall be added to the building permit application for the driveway that • indicates a variance was granted on August 20, 1997, allowing a permanent driveway surface to be located not closer than one foot to the side yard property line. 2. The applicant shall have the side yard lot line located and identified by a trained specialist prior to obtaining any permits for the requested work. 3. The driveway to be constructed shall maintain at least a one-foot setback from the marked side yard property line. Attachments: Planning Application lication Zoning Map Site Plan Photographic Documentation Letter from the Applicant Letter from Neighbor Planning Commission Resolution No. 524-97 Background: Paul Jacobs is requesting a variance to allow a driveway curb cut opening of 25 feet, three feet more than what is allowed by the Code. The driveway has already been constructed, a photo of which has been attached. Mr. Jacobs, who did the work himself, was not aware of the width requirements for driveway curb cuts when his was installed. The extra width is required for the many vehicles owned by the family and to compensate for the length of the driveway, which is only 33 feet long. Mr. Jacobs' letter supporting his request is attached, as is a letter of support from a neighbor. Analysis: • According to Section 1121.09, Subd. 5, driveway curb cuts in single family residential districts are limited to a 22-foot width. The applicant is requesting an additional three feet. The property is located on the southwest corner of Ridge and Brighton Lanes. The amount'of street frontage facing Ridge Lane, the street from which the driveway access is gained, is 135 feet. While the Code is clear about the maximum width allowed, it does allow for a driveway width of 35 feet. The design and appearance of the proposed building will not differ significantly from the existing building. The design to be used is the standard design theme used for all newer McDonalds. Access and Drive Aisles: Access to the building will be from Program Avenue via two curb cuts spaced 40 feet apart as required by City Code. The positioning of the curb cuts will change only slightly from their existing configuration. Curb cuts in a B-3 zoning district are allowed to be 30 feet in width. The horizontal widths of the curb cuts are 25 feet and 24 feet, yet measured along the property line, the widths increase to 43 feet and 32 feet, respectively. It is staffs opinion that the appropriate measurement should be taken horizontally, and in doing so, the widths comply with the Code. The drive aisles are proposed to be 24 feet wide. These are adequate on the east side of the building. On the west side, the drive-through lane takes up 10 feet of the 24-foot drive aisle. The bank of diagonal parking spots on this side of the site could make vehicle passage through this area unsafe. It might be beneficial to move the diagonal parking stalls two feet closer to the property line to allow for a wider drive aisle. Drainage: The site, which covers 50,001 square feet, is located near Rice Creek. Sites located closer than 300 feet to Rice Creek or those in excess of 2.5 acres require review By Rice Creek Watershed District. The applicant has provided a letter for the City's review from Sunde Land Surveying, Inc., stating McDonalds Development Review Planning Case No. 500-97 August 20, 1997 Page 3 that the McDonalds parcel is 487 feet from the closest edge of Rice Creek. This letter, dated July 12, 1997, has been attached. The grading and drainage plans have been submitted to Rocky Keehn, the City's Engineer, for review. In a memo dated August 7, 1997, Mr. Keehn responded that the overall impervious surface on the site will not increase with this development. However, because of the relocation of the building, the drainage patterns may shift, causing additional runoff in a particular area. The applicant has submitted revised drainage plans showing existing and proposed drainage flows, which have not yet been reviewed by Mr. Keehn. Staff will have a response regarding the drainage prior to your meeting on August 20, 1997. Mr. Keehn recommends that no water quality treatment methods be required for this development proposal due to site constraints. Landscaping: Much of the existing landscaping present around the perimeter of the lot will be retained. The landscape plan includes a planting schedule for the trees and shrubs to be added around the building and in the island separating the two curb cuts. Two larger evergreens existing near the front of the lot are proposed to be transplanted to the rear of the lot because of the shifted curb cuts. Rick Wriskey, the City Forester, has not yet reviewed the planting schedule, but will do so before your meeting on August 20, 1997 at which time I will verbally present his approval or any recommendations that he has made. • Lighting Parking lot lighting will be accomplished by four 24-foot tall standards, each with two 1000 watt metal halide lamps. The photometric analysis provided by the applicant indicates that the lighting meets the requirement as set forth in Section 1103.09 of the Zoning Code, whereby light from the property shall not exceed one foot-candle as measured from the centerline of adjacent streets. The Code also states that no bulbs may be visible from adjoining properties and that they be hooded or shielded to prevent glare. There was no indication on the photometric analysis of any wall-mounted lighting for the building. This will need to be clarified by the applicant. Signage: The existing pylon sign on the property will be retained in its present position. No other ground- mounted signage is proposed other than four small directional signs at the entries to the site. On the building front, there will be approximately 40 square feet of signage which will display the name of the restaurant. On either building side, the company logo will be attached to the wall. Both signs are approximately 20 square feet in area. Parking: Given estimated square-footages for the kitchen and dining areas of the proposed building at 1,000 square feet and 1,600 square feet respectively, the applicant would need to provide a minimum of 53 parking spaces. This total is based on the following ratios: 1111 Kitchen area (1 space per 80 square feet): 1,000 divided by 80 = 13 spaces Dining Area(1 space per 40 square feet): 1,600 divided by 40 =40 spaces Total spaces required: 53 spaces McDonalds Development Review Planning Case No. 500-97 August 20, 1997 Page 4 The applicant is proposing 75 spaces, four of which would be handicapped-accessible, 7 of which would be designated as"compact cars only." The grading and drainage plan reviewed was printed on July 23, 1997. Based on this set of plans,the proposed building relocation will not alter the current impervious and pervious surface area amounts that currently exist on the site. Therefore, the total runoff from the site should not change with the reconstruction. Our concern is not the amount of runoff, but how the drainage patterns for the proposed runoff may be altered since there are three discharge locations of runoff from the site. The three discharge locations are to a curb-cut on the east side of the parking lot,the south entrances to the parking lot and a catch basin at the end of the drive thru. Based on the information provided for our review,it cannot be determined exactly where the existing and proposed 110 runoff drains from the site. Also,flow from the catch basin at the current drive thru is not shown on the plans. To document the drainage patterns, the developer needs to submit a drainage map which shows where all the runoff from the site will go for both the existing conditions and for the proposed. If the drainage patterns differ from those that currently exist, the developer's engineer will need to calculate the expected changes in flow rates to the downstream drainage systems and determine if these changes will cause any adverse impacts. All maps and calculations will need to be submitted for our review. The applicant will also need a Rice Creek Watershed District(RCWD) permit if the area is more than 2.5 acres or within 1000 feet of a DNR protected wetland. Due to its location near Rice Creek, the applicant should check to see if a RCWD permit is required. If a permit is required,RCWD will likely encourage the developer to construct measures to improve the water quality of runoff from the site. Based oiour review,it appears dne to site cnnstraints that an above ground water quality system is unfeasible. An underground system could be built, but since it would be a private system,maintenance would be a problem. Therefore, we would recommend that for this site no water quality treatment methods be required as part of the reconstruction. Planning Commission Resolution 526-97 Background: This plan review is for the development of a convenience market/gas station/car wash on the corner of Highway 10 and Silver Lake Road; 25,000 square feet of office space on the parcel north of the former TJB Homes office building; 5,000 square feet of office on the parcel south of the former TJB Homes building; and an 82-unit senior housing building. Silverview Estates Dev. Co. Preliminary Plat&Development Review Planning Cases 501-97 and 502-97 • August 20, 1997 Page 2 Ordinance No. 599 approving the PUD rezoning passed on May 27, 1997, along with Resolution No. 5127 approving the general concept plan for the PUD. An application for development plan approval was submitted on July 11, 1997, and the original target date for Planning Commission discussion on this item was August 6 with Commission action scheduled for August 20. However, in light of the identification of a number of issues that must be resolved prior to Commission action, this item has been scheduled for discussion only at the August 20 Planning Commission meeting. It is anticipated that the development stage plan will be ready for Commission action on September 3, with Council action to follow on September 8. The preliminary plat for Silverview Estates has been submitted for staff review and comment and has been placed on the Planning Commission agenda for action at the August 20 meeting. The required hearing notice has been published allowing the City Council to hold a public hearing on the plat at its August 25 meeting. Discussion: Development Review: Staff is anticipating that the time spent on this item before the Planning Commission on August 20 will be to update the Commissioners both on the items that have been • resolved and those items that are still outstanding on this project. The following discussion identifies issues raised by and/or deficiencies in the development plans that were submitted for consideration. City staff members have met with the applicants, and the discussion below incorporates the most current responses to the issues raised. In addition, there remain some items that have yet to be resolved. It is anticipated, however, that each and every one of the issues will be addressed in a manner sufficient to allow Commission and Council action in early September. • The building area allowed in the PUD for the senior housing component is 84,000 square feet maximum. The architectural site sheet 1 of 1 indicates that the building area for the senior housing is to be 115,800. This modification will require an amendment to the PUD concept plan that was approved on May 27 and which governs the development of the development stage plans. Applicant's Response: The senior housing complex was proposed at 83 units. The building size and configuration was conceptual and estimated at 84,000 square feet. As now planned, the building has 82 units. Our architect has designed the building to include, in addition to the 82 units, lobby and lounge areas, offices, game room, library area, music, arts and craft areas, a chapel, storage and trash areas. The building square footage is now approximately 115,800. In retrospect, it may have been better to set general parameters on the building size in the PUD for a building of this type. It is our intent to abide by the setback standards and parking requirements set in the PUD. • Staff Comment: Theoriginal building footprint of 84,000 was the result of the scaling of the building on the concept plan drawing. Therefore,regardless of the number of square feet, the building mass and general design have not changed. Additionally, the senior housing structure reflected in both the concept plan and the development stage plan are respective of the established setbacks. As such,the necessary amendment to the PUD reflects a modification to the square footage number to reflect the building footprint. • Information needs to be submitted to assist in the determination of pervious versus impervious surfaces for each of the sites within the PUD. Applicant's Response:I may have those exact figures by the August 20th meeting. The data will be on the revised site plan for September 3'd Again, it is our intent to abide by the conditions of the PUD document. • All plan sheets that depict building elevations need to be modified to include finished building height. • Color and materials boards and architectural renderings are required as part of the development stage plan submittal. • Applicant's Response: Colored elevations of all buildings will be presented at the Planning Commission meeting. The data will be on the revised site plan for September 3'd Again, it is our intent to abide by the conditions of the PUD document. Building materials will be presented to the Planning Commission on August 20th as well as architectural renderings of each building. It is our intent to coordinate building materials and color throughout the PUD. • The site plans for the two-story office building, the one-story office building and the senior housing structure do not indicate a location or construction type for trash and recycling enclosures. Applicant's Response: The site plan shows a trash enclosure adjacent to the C-store. All other buildings have been designed to handle trash inside. • The site plan sheet 1 of 1 indicates a 10-foot setback for the parking area along Silver Lake Road in front of the senior housing building. The minimum setback required in the PUD is 30 feet. Applicant's Response: This was an oversight. We have ample parking to make the appropriate adjustment to provide a 30 foot setback along Silver Lake Road • The detailed landscaping plan that is required for submittal at this stage requires that the plan • show species, numbers and sizes of all plant material. The"preliminary planting plan" that has been submitted does not indicate sizes, does not recognizeincorporation of existing trees that will be preserved on site, and does not specify location for plant species. August 20, 1997 Page 4 Applicant's Response: Our consultant selected a landscaping plan format designed to provide some flexibility to the type of plantings but not the sizes. A more detailed planting schedule will be provided We will also use our tree inventory data to show what size and type of trees will be saved around the existing wetland • The development stage plan must receive approval for delineation of the wetland from the Rice Creek Watershed District prior to consideration by the Planning Commission. Applicant's Response: This development will be reviewed by Rice Creek Watershed at their August 27`h meeting Staff review and comments to date have been favorable. • The City's Engineer (Rocky Keehn, SEH) has reviewed the submitted drawings for drainage design. His comments to the City on the drainage design are contained in a memorandum dated August 8, 1997, which is enclosed with this letter. Mr. Keen has identified additional information that must be submitted in order for him to complete his review. Submittal of this information and City Engineer approval of the preliminary grading plan, erosion control plan and drainage plan is necessary prior to Planning Commission action on the development stage plan. • Applicant's Response: Our engineer, Chuck Plowe, will continue to work with Rocky Keehn. • The submission does not include the required lighting plan that is to indicate lighting location and type as well as site photometrics. Applicant's Response: Lighting plans showing fixture type and locations and the foot candle meter readings are being prepared for each site. • Snow storage areas have not been identified on the plan as required. Applicant's Response: Snow storage areas will be shown on the site plan. We believe we have ample space on site to store a "typical" snow fall event. However, in the event of severe snow fall conditions, it would be necessary to truck snow off site. • A coordinated sign program will need to be submitted prior to Planning Commission consideration of the development stage plan. The sign program must show sign type, location (with appropriate setbacks), materials and text. Applicant's Response: The convenience store sign plans are near completion. Plans for • signs at the other buildings are under consideration. It is our intent to again coordinate the materials used for sign support. Silverview Estates Dev. Co. Preliminary Plat&Development Review • Planning Cases 501-97 and 502-97 August 20, 1997 Page 5 • The development stage plan was to include specific design elements at the corner of TH 10 and Silver Lake Road in order to create a gateway to the Mounds View Village Center. In lieu of identifying a particular design at this time, however, the development stage plan should reflect that space will be reserved at the corner for subsequent planting and gateway monumentation. The City anticipates that the results of its current effort to identify a TH 10 design theme will drive the specific design and landscaping layout for this corner. Applicant's Response: A 30 x 30 foot triangular easement will be provided at the corner. • An engineering report regarding construction of underground parking for the senior housing component has not been submitted as part of the development stage plan as required by the PUD. Applicant's Response: Soil investigation and soil bores on the site have been completed All information will be given to the City Engineer. No problems with underground parking are anticipated • The owner/developer still needs to provide permission from Mn/DOT for the TH 10 access points • and from Ramsey County for the Silver Lake Road access points prior to approval of the development stage plan. Applicant's Response: Ramsey County has given verbal approval"to driveway access to Silver Lake Road Permit applications will be submitted Discussions with Mn/DOT continue. Staff Comment: The August 12 letter from Scott Peters of Mn/DOT that is attached to this report indicates that the PUD site will be allowed no more than two access points along TH 10. The driveway to the former TJB Homes building would constitute a third access point along this segment of TH 10. As indicatecLby the site plT an_the a___a p licants_are-contemplating development of three access points within the PUD site. As a result, discussions with involved property owners as well as with Mn/DOT representatives will continue in an effort to resolve this question. • Access points should indicate driveway radii in order to assist the Fire Department in its review of the site plan. Additionally, fire hydrant locations should be indicated on the plan as required by the Fire Department. Applicant's Response: We absolutely agree that driveway radius must conform to fire truck maneuverability. Fire hydrant locations are shown on the utility plan. • Staff Comment: Planning Staff has been informed that the Fire Marshal has reviewed the site plans and finds that the radii at the site access points provides for adequate turning movements. Fire hydrant locations also have been reviewed and found to be acceptable. Silverview Estates Dev. Co. Preliminary Plat&Development Review Planning Cases 501-97 and 502-97 • August 20, 1997 Page 6 • Prior to action on the development stage plan, the developer must provide an assessment as to the composition of the fill on the office site to the east of the existing TJB Homes office building. Applicant's Response: Soil tests and bores have been taken. Written results are expected soon. Various construction debris will have to be removed from the site. • The RV dump site that is shown on the convenience store site is not listed as a permitted use in the PUD. This use needs to be removed from the plans unless approval of an amendment to the concept plan is obtained from the City Council. Staff would note that it is our feeling that the location of such a facility on that site is in opposition to the City's desire to create a gateway element in this quadrant of the TH 10/Silver Lake Road intersection. Applicant's Response: The owners of the convenience store wish to further discuss the service area with the Planning Commission on August 20. • Additional detail is needed on the proposed entry treatment on the angle wall elevation of the two-story office building. While this may serve as the rear entry to the building, this elevation receives significant exposure; hence, architectural enhancement of this entry is warranted. The • present design resembles a service door. Staff will be recommending that this entrance be opened up to the plaza in a manner similar to the front entrance. Applicant's Response: We have asked our architect to take your comments into consideration. This building entrance was not initially intended to be a "main"building entrance. Preliminary Plat: The Silverview Estates Preliminary Plat has been reviewed in light of the provisions contained in Title 1200, Land Subdivisions, Municipal Code of the City of Mounds View. The plat was provided for the4urposes_of_review an -the-relevant departments and referral agencies. • Gateway Easement: The 30-foot by 30-foot triangular easement at the southeast corner of Silver Lake Road and Highway 10 shall be indicated on the preliminary plat to allow for the future establishment of landscaping and design elements along the south side of Highway 10 as required by the PUD document approved by the City Council 5/27/97. • Drainage and Utility Easements: The applicant has added delineated easement boundaries around the wetland and two of the three NURP ponds. The small pond located behind the 5,000 square-foot office building does not show an easement over it. In addition, the plat will need to show dedicated five-foot easements on either side of all • proposed interior lot lines. These easements will need to be shown on the plat prior to approval of the preliminary plat by.the City Council. The applicant shall be responsible for drafting legal descriptions of all easement areas. A document granting the easements to Silverview Estates Dev. Co. Preliminary Plat&Development Review Planning Cases 501-97 and 502-97 • August 20, 1997 Page 7 the City will need to be executed by the applicant prior to City Council approval of the final plat and recorded with Ramsey County not more than 60 days after the date of final plat approval. • Right of way: The Preliminary Plat shows a roadway width of 40 feet from the property line to the center line of Silver Lake Road where it intersects with Highway 10. On the Ramsey County plat maps, however, the right of way on Silver Lake Road at this point is only 33 feet to the center line. The applicant shall be responsible for drafting the legal description for the additional seven feet of right of way and shall permanently dedicate this right of way to the City by means of an executed document prior to the approval of the final plat. • Park Dedication Fees: According to Section 1204.02 of the Municipal Code relating to dedication of lands, every subdivision to be developed for residential, commercial, industrial uses or any combination thereof, shall necessitate a dedication of lands, or, at the sole discretion of the City, a cash dedication equivalent to ten percent of the fair market value of the lands bveing subdivided. The applicant shall contribute a park dedication fee as established by the City Council before the final plat is approved by the Council. • Recommendation: Staff recommends that the August 20, 1997 meeting of the Planning Commission be used to review and discuss the issues identified above concerning the development review and to provide comments and feedback to the applicants in order to facilitate the orderly preparation of a development plan for consideration by the Planning Commission at its September 3 meeting. The preliminary grading and erosion control plan was dated 7/11/97. One item not submitted was a drainage map showing the subwatersheds to each pond. The map should include roof drainage and show those areas that will flow to the garage and thus need to be drained using pumps (show where the pump runoff will discharge). Based on this set of plans,the major pond in the center of the site appears to be adequate. The other two ponds need further refinement. The minimum depth of a NURP ponds is four feet. The proposed pond next to the 1 story office building does not meet this criteria. The pond located next to Silver Lake Road has no separation between the inlet and the outlet on the south side of the pond.. This will cause short circuiting and thus greatly reduce the efficiency ill of the pond. The site also greatly infringes on the 100-foot buffer around the wetland. Although some measure have been done to protect the wetland, there are several highly used impervious surface next to the wetland. To help this problem at the 1 story office building parking lot,we would like the developer to investigate if they can move the building 10 feet further northwest. This will create two additional parking stalls which allows them to eliminate the two parking areas closest to the wetland. The City should also consider obtaining a 20 foot easement around the delineated wetland.. By obtaining the easement, the City can control land use (mowing, etc) in the reduced buffer. We would also recommend that plantings be used in the easement which deter people from going into the area. We noticed that on one drawing the central pond has a walkway on the wetland side. The problem with this is that the grading plan shows a riprap overflow in the same location. The developer should correct this inconsistency in the plane. We also require construction of right turn lanes on eastbound TH 10 for the two accesses allowed for permit approval. This development proposal necessitates these turn lanes and are the responsibilities of the project proposer, the city, or both. Enclosed is a diagram showing design specification for right turn lanes. In addition, any proposed access requiring installation of culverts must use 6:1 slopes. Placement of culverts must occur beyond the clear zone. The permit applicant must submit plan and cross-sectional drawings of the proposed access, showing the required turn lanes. The DNR may submit comment for Silver Lake Estates in relation to these other programs. 2. It is good to note that most of the stormwater appears to be treated in stormwater ponds. However,it is unclear if the stormwater from the one-story office building will be treated. We strongly recommend the treatment of stormwater in sedimentation ponds. Untreated stormwater will cause pollution that will negatively impact the recreational, aesthetic,wildlife and property values downstream of Silver Lake Estate-s. 3. It is good to see the large number of trees that will be planted for Silver Lake Estates. The trees will appear to be out-of-place amidst the very large amount of pavement proposed for Silver Lake Estates. The site flows into Silver Lake. Studies indicate that the quality of lakes decline as the amount of impervious surface within their watershed increases. We recommend that the impervious surface of Silver Lake Estates be reduced as far as practical to protect Silver Lake. 4. There should be some type of dedicated easement, covenant or deed restriction that will preserve the wetlands on the property in their natural state. This would help to ensure that property owners are aware that the U.S.Army Corps of Engineers,the City of Mounds View,and the Rice Creek Watershed District have jurisdiction over the areas and that the wetlands cannot be altered without appropriate permits. 5. The Flood Insurance Rate Map for the City of Mounds View depicts a designated floodplain with a 100-, • year flood elevation of 905'on the site of Silver Lake Estates. The structures and roads must comply with the floodplain regulations of the City of Mounds View,and the Rice Creek Watershed District. The analysis was conducted to determine any differences that would occur in trip generation as a result of a change in the proposed land use. Trip generation for the site initially included the following uses: • • 8-pump gas station with a car wash and a 3,887 square foot convenience store • 1,654 square foot fast food with drive through window • 10,000 square foot sit-down restaurant • 5,000 square foot general office • • 83 dwelling units for senior citizens (assisted care and non-assisted care) Of concern in this memorandum is the impact of changing the 10,000 square foot (SF) sit-down restaurant to a 25,000 SF office. Findings . : 3: A comparison of adjusted trip generation for the 10,000 SF sit-down restaurant and the 25,000 . , SF office is shown in Table I on the following page. The 10,000 SF sit-down restaurant will generate more overall trips than will the 25,000 SF office. The overall decreased trip generation for the 25,000 SF office would be expected to occur over the course of the entire day and during the AM and PM peak hours. Analysis shows that during the AM peak hour, however, in-bound trips to the office would be higher than inbound trips to the restaurant, but _; , only 50 percent higher. Given results of this analysis, it is safe to assume that a 25,000 SF office use, instead of a '. 10,000 SF sit-down restaurant use, would not lead to any traffic impacts that have not already k '" been discussed. In fact. the office use, because it generates fewer overall trips, would result . in less severe traffic impacts than the restaurant use.
