BACKGROUND On October 22, 1997 TOLD Development held a neighborhood meeting to discuss their proposal to construct a Walgreens store at the corner of Highway 10 and County Road I. The neighbors who attended expressed a number of concerns about the project. Because of those concerns it was determined that a joint meeting between the Planning Commission and the City Council should be held to discuss the project further to provide input to the Developer so that the the Developer can decide on whether to apply for City approval. Staff will provide a brief overview of the status of thero ect the City j a pprovals which will be required, and a summary of the issues raised at the neighborhood meeting. Bob Cunningham from TOLD Development will be present to describe the proposed project. STAFF RECOMMENDATION Staff recommends that the Planning Commission discuss the proposal with the City Council and provide input to the Developer about the issues which will need to be addressed so that a decision can be made on whether to proceed with the development and the City approval process. Bill Morrish from the University of Minnesota Design Center for American Urban Landscape presented the findings concerning the developoment of the Heart of Mounds View and the concept of a ring road. Following Mr. Morrish's presentation the floor was opened up to comments and questions from the approximately 55 citizens in attendance at the meeting. The following is a summary of the comments that were received: 1. Highway 10 right-of-way width is too wide. • 2. If the City is considering relocating or reorganizing the city hall/community center site, it should relocate the theatre site to the city hall site to preserve trees and wetlands. This could also minimize potential flooding in the adjacent neighborhood. 3. Wetlands need to be preserved and protected within the ring road study area. 4. There was a question about what the service nodes were which were identified on the plan, where they were located, and the impact they would have on adjacent residences. 5. The proposed plan for the city hall site would require relocation of a pumping station. 6. The plan would result in the loss of or further reduction of the softball and soccer fields on the city hall site. There is already a shortage of soccer fields in the city. 7. The proposed theatre and ring road proposals would isolate and adversely impact the Donatelles restaurant. 8. The ring road would be not benefit properties on the south side of Highway 10. The area is already developed. 9. The ring road would add to existing traffic problems south of Highwayl0. The amount, speed, and time of traffic on Mounds View Drive are problems which would get worse. The amount of traffic is a problem adjacent existing residential uses (Silver Lake Woods project). 10. The theatre project would add addtional late night traffic on Mounds View • Drive. Ingress and egress of the theatre must be addressed. Mounds View Drive should not be extended to the theatre project. City of Mounds View Staff Report October 31, 1997 Page 2 • 11. The east/west orientation of the ring road is bad because cars will be driving into the sun in the morning and evening. 12. Lake Court Drive traffic levels increase when Mounds View Drive backs up. 13. Concern was expressed that this was TMa done deal". 14. The proposed Walgreens development at Highway 10 and County Road I removes 4 homes and does not protect the homes remaining. The ring road would result in additional commercial development which further adversely impact residential in the area. 15. There needs to be an overall traffic study done to determine the impact of the ring road on adjacent residential areas. 16. The theatre project layout may lead to parking and crime problems. 17. There may be more intense commercial development in the future. The theatre may not be a long term use. 18. Speed of cars on Long Lake Road is a problem. Better enforcement is needed. 19. Redevelopment of the second tier of homes off of Highway 10 is being proposed. Change of residential to commercial is a problem. 20. All activity being proposed focuses on cars. There is a need for more emphasis on pedestrian trail systems which connect to the community center area. 21. It is good to talk about these issues. Overall benefits of the ring road concept need to be discussed also. 22. Will pedestrian bridges be considered? 23. Signal timing should be studied. 24. A good compromise was reached to reduce the impact of the theatre project on the County Road H-2 residential area. 25. The existing soccer field in Silver View Park is not widely used. 26. The service road would end up too close to the light which would lead to congestion which would be a problem because of the number of senior citizens in the area and the library. The city needs to provide protection to residential properties beyond what is provided by the city code. 29. Public agencies must get together to solve problems. 30. At the November 5, 1997 meeting I would like to begin discussing the process of updating Mounds View's comprehensive plan. Specifically, I would like to review what a comprehensive plan is, the role of the planning commission in the development and maintenance of the plan, the required elements of the plan, and the status of the process to update Mounds View's Comprehensive Plan. I have attached copies of sections of the Metropolitan Council's Local Planning Handbook ,; which outline the required and optional elements which need to be included in the Comprehensive Plan. I have also attached copies of documents which were originally prepared by Pam Sheldon. These documents outline a process to complete the update of the plan by the end of 1998. While some of the items are in process, we are about 2 months behind at this point. I would anticipate that there will be items related to the comprehensive plan update on most of the Planning Commission agendas from now until December of 1998. I think this will be an exciting and informative process. The City of Mounds View is located 10 miles north ofMmneapolis and St. Paul directly west of Interstate 35W on Highway 10. Mounds View is in the northwest corner of Ramsey County is bordered by the communities ofNew Brighton, Arden Ants,Fridley, Blaine, Shoreview anand Spring Lake Park It is considered to be in the first ring of suburbs developed around the Twin Cities following World War II, with 47% of the City's single family houses stock being built prior to 1960 and 32% of the single family houses being built between 1950 and 1959. Mounds View • also has three manufactured housing parks,with a total of 585 housing units. The multiple 28% spaces, and 1,370 multiple family P fly units represent of its housing stock It is bisected by Highway 10 which provides a direct connection to 1-35W and Hwy 694. Highway 10 carries approximately 40,000 trips per day. Mounds View has a population of 12,800 people and has grown from a bedroom community to a bustling suburb with diverse residential neighborhoods and three quality business parks. Much of the City is in large, tree covered single family lots served by quiet, country-style streets. There is also a significant concentration of larger-sized rental apartment developments in the central section of Mounds View on either side ofEghway 10. There has been considerable interest during 1996-1997 in development and redevelopment opportunities along Highway 10, with three major projects underway. In 1996, the City purchased an existing building which is being renovated into a community center, and along with City Hall, they form the nucleus of what is hoped will become the Mounds View City Center, an activity area with entertainment, offices, retail shopping, multiple family housing, and civic and recreational uses. restaurants, Status of Comprehensive Plan and Other Planning Activities The most recent Mounds View Comprehensive Plan was completed in 1979 and adopted by City Council on July 26, 1982. Several efforts have been undertaken in the interveningthis years update plan, but have not been concluded. The plan is in major need of revision and updating to •better address current community issues, a changing development climate, and regional planning activities. Ordinance No. 599 approving the PUD rezoning passed on May 27, 1997, along with Resolution No. 5127 approving the general concept plan for the PUD. An application for development plan approval was submitted on July 11, 1997, and the original date for Planning Commission action was scheduled for August 20. However, in light of the identification of a number of issues that had to be resolved prior to Commission action, this item was scheduled for discussion only at the August 20 Commission meeting. Subsequent to that meeting, comments received by the Planning Commission were considered and incorporated into the current submittals. Additionally, the development team had been awaiting preliminary approval from Mn/DOT for the proposed curb cuts along TH 10 as identified on the plat. On October 9, 1997, Mn/DOT granted preliminary approval for the requested curb cuts, and as a result of that approval the applicant has proceeded • toward completion of the submittal package for consideration by the Planning Commission at its meeting of November 19, 1997. The preliminary plat for Silverview Estates has been reviewed by the City's Planning Staff, and a memorandum to the applicant was prepared identifying the balance of the outstanding issues. Subsequently, a meeting was held with the development team on November 13 to discuss the issues related to the proposed site development plan and preliminary plat. The development team is requesting that the Planning Commission review the development plan and preliminary plat applications at the November 19 meeting and formulate recommendations on each item to the City Council for consideration in December. Discussion: The following discussion identifies issues raised by Planning Commission at the August 20 meeting and by Planning Staff either as a result of the initial submittal in August or as a result of staff's review of the most recent submittal. City Staff members have met with the applicants, and the discussion below incorporates the most current responses to the issues raised. Some items identified below will be resolved either with submissions to City Staff prior to November 19 or submissions to the Planning Commission on the 19th. It is anticipated, however, that each and every issue raised here will be addressed in a manner sufficient to allow Commission action on • November 19th. Planning Commission Report Silverview Estates PUD Development Review and Preliminary Plat • November 19, 1997 Page 3 Development Review: • The building area allowed in the PUD General Concept Plan for the senior housing component is 84,000 square feet maximum. The architectural site sheet 1 of 1 indicates that the building area for the senior housing is to be 115,800. The original building footprint of 84,000 was the result of the scaling of the building on the concept plan drawing. However, the building footprint has not changed since concept plan stage. Therefore, regardless of the number of square feet, the building mass and general design have not changed. This modification will require an amendment to the PUD resolution that was approved on May 27. This will be done prior to City Council action. • The amounts and percentages of pervious and impervious surfaces shown on the site plans for each of the lots within the PUD are inaccurate. The applicant has submitted corrected data as follows and will revise the site plans prior to City Council action. The applicant will correct these drawings to reflect accurate heights prior to City Council action. • In the most recent submittal there was no detail provided on the proposed canopy over the pump islands at the Holiday Stationstore. The applicant has submitted relevant detail for the canopy that shows height, materials and proposed signing. This information will be available to the Commission on the 19th. • The site plan sheet reflects a parking lot setback of 30 feet as required, but the label indicating 10' setback has not been removed. The applicant has been advised and will make the necessary change to the site plan. • The landscaping plan did not originally identify plant material by size and type and did not • indicate the extent of existing trees on site to be preserved. The revised submittal includes the required plant material information, and the applicant will provide a label for the areas shown as existing vegetation that will read "plant material to be maintained." Planning Commission Report Silverview Estates PUD Development Review and Preliminary Plat November 19, 1997 Page 4 • The development stage plan had not received approval from the Rice Creek Watershed District prior to the Planning Commission discussion on August 20. The Watershed District approved the required permit on October 22, 1997, as reflected in the attachment to this report. • The City's Engineer(Rocky Keehn, SEH)has reviewed the submitted plans for drainage design. His comments to the City on the drainage design are contained in a memorandum dated November 11, 1997. Three issues were identified that will need to be addressed: lack of distance between in the inlet and outlet for the NURP pond on Lot 3, ensure that the culverts under the St. Paul Waterworks right of way function properly, and ensure that emergency overflow from the NURP pond on Lot 4 is directed away from the underground garages and toward the street. These issues are addressed as conditions of approval to Planning Commission Resolution No. 515-97. • While the latest submittal included a proposed lighting plan for Lots 2 through 4, the plan did not give a clear indication of fixture types and their location and information on building-mounted lighting. The applicant has been advised and will make the necessary adjustments prior to November 19. Ali • Lighting information, including site photometrics, was submitted for Lot 1 at the Planning Commission meeting on August 20. The applicant has been made aware, however, that on-site lighting is an area of concern, particularly as to how the lighting under the canopy will be shielded downward. In an attempt to address this issue, the applicant has provided staff with revised photometrics for site lighting that incorporates the use of a light baffle within the canopy fixtures. It is staff's position that the light-enhancing capabilities of the prism-type lenses on the canopy fixtures is not desirable, and efforts should be made to determine whether such fixtures can be recessed into the canopy or whether a shoe-box type fixture should be employed. The applicant will be prepared to address this issue at the November 19 Commission meeting. • Snow storage areas were not identified on the original plan, but the latest submission does identify locations for snow storage. However, the snow storage area to the south of Lot 4 is shown within the wetland. The applicant will modify the location of this snow storage area so that it is not in the wetland. • The most recent submittal identifies sign type for Lots 2 through 4. However, no sign detail was submitted for Lot 1. The Planning Commission requested at its August 20 meeting that the free-standing sign for the Holiday Stationstore include brick columns that flank the text area of the sign, similar to the brick columns used for signing on Lots 2, 3 and 4. The applicant has provided this information which is attached to this report. In addition, the applicant will affix 10' sign setbacks on the site plan. • Planning Commission Report Silverview Estates PUD Development Review and Preliminary Plat • November 19, 1997 Page 5 • The recreational vehicle service facility has been relocated to the rear of the Holiday Station. Detail on how the waste will be contained and/or disposed of was not included in the submittal package. The applicant will have information for the Commission on the 19th that indicates disposal of waste via sanitary sewer system. In addition, the PUD will need to be amended to recognize the establishment of this use on the Holiday site. • Stormwater ponds have been identified on some of the plan sheets as "NERP" ponds. The applicant will modify the plans prior to City Council action to reflectthe correct"NURP" designation. • Three additional handicap parking stalls are required to be shown on Lot 2 adjacent the building's main entrance. Additionally, in accordance with ADA requirements, additional handicap stalls should be shown in the underground parking facility in order to satisfy the ADA requirements of one handicap space per 25 spaces. The applicant will modify the site plans to reflect these requirements. • Parking stalls on Lots 2-4, while consisting of a minimum of 180 square feet, are of a 10' x 18' configuration instead of the City's standard 9' x 20' configuration. It is staffs position that the extra width is desirable and that the 2' lost in stall length is not • detrimental to on-site parking or circulation. The PUD agreement will be amended to reflect this modification. • The latest submittal includes some conflicts with details of the planting plan. The applicant will amend the plans so that planting details will appear only on sheet 1 of the Landscape Plan and on sheet LI for the Holiday Staionstore. • The Mounds View City Forester has reviewed the landscape plans and planting schedule and finds them acceptable overall but has made some suggestions that the developers may want to incorporate prior to City Council action. First, the Niobe Weeping Willow are • . ..-'. - - - . - i crowd out other vegetation and then begin to die off prompting their removal. It was suggested that more River Birch be planted in their place. Second, the Chuckles shrub rose--while a nice plant--typically have not performed well in Mounds View soils. Nearly Wild shrub rose should be planted in their place. Last, the Forester questioned whether or not the Red Barron crab trees are disease resistant and commented that nurseries often do not carry this tree. If a substitution becomes necessary, either of the following flowering crabs would be acceptable: Red Splendor, Snowdrift, Spring snow or Pink Spires. • The owner of the future Holiday Stationstore has indicated throughout the process that the car wash facility will minimize the use of water and thereby reduce the amount of waste water generated on site by recycling at least 60% of the water used in that facility. As such, the applicant has agreed that the PUD agreement be amended to include language to the effect. Planning Commission Report Silverview Estates PUD Development Review and Preliminary Plat November 19, 19971110 Page 6 • The Mounds View Fire Marshal has reviewed the plans and requires that the fire department connection to the senior housing building and the two-story office building be accessible year round and at all times. In addition, if the floors of the senior housing building are on wood trusses, the concealed combustible space will need to be subdivided or sprinklered, as will the attic. Also, an additional fire hydrant is required on the east side of Silver Lake Road toward the south end of the senior building. Last, the Hydrant to be relocated in front of Lot 4 on the Highway 10 shall be kept free and clear of any winter snow storage. • At previous Planning Commission meetings on this subject, the extent of development and impervious surfacing within the 100-foot wetland buffer has been a concern. While the site plans do not indicate this, the total square footage of land within the buffer equals 83,234, of which 41 percent(34,054 square feet) is impervious surface. These figures do not take into account the St. Paul Waterworks right of way of approximately 79,000 square feet. Preliminary Plat for Silverview Estates: The Preliminary Plat for Silverview Estates has been reviewed in light of the provisions contained in Title 1200, Land Subdivisions, of the City of Mounds View Municipal Code. The plat was provided for the purpose of review and comment to the relevant City departments, and no adverse comments were forthcoming. The plat was submitted, as well, to the Rice Creek Watershed District, Ramsey County and Mn/DOT for review and comment. The proposed plat has received the necessary approvals from the Rice Creek Watershed District, Ramsey County and Mn/DOT. • The Preliminary Plat identifies the location for the 30' x 30' easement for a future gateway element but does not indicate the dimensions. The applicant will label the easement dimensions on the preliminary plat. • In a memo dated 8/11/97, Ramsey County has required that an additional three feet of right-of-way for that part of Silver Lake Road adjacent to proposed Lot 4 would be dedicated and an additional ten feet of right-of-way dedicated adjacent to Lot 1. While the additional right-of-way would not impact the placement of structures on Lot 1, this additional right-of-way dedication would reduce the setback for the senior apartment building and associated parking lot to 27 feet. The applicant has indicated that Ramsey County would accept the existing 40 feet of right of way along Lot 4 if the additional ten feet is dedicated along Lot 1, although staff has not yet been able to verify this agreement with Dan Soler, the Ramsey County trffic Engineer. It is the recommendation of staff that, without receipt of a letter confirming this agreement, the PUD resolution be modified , to allow for a reduced setback of 27 feet for the senior housing structure and site. We find the plat alacceptable for further development with consideration of the following comments. • • As stated in our letters of April 23, 1997 and August 12, 1997, we constructed arterial highways such as TH 10 to serve regional mobility needs rather than to accommodate direct property access. Proliferation of accesses is inconsistent with the highway's purpose and reduces the highway's capacity and safety. Control and reduction of access is critical in reducing highway congestion, and are important factors in reducing accidents on highways. As previously stated in our past reviews of this site, we strongly recommend that these parcels have consolidated access. Regional policy developed by the Metropolitan Council discourages direct access to the highway from an individual property. As previously stated, the emphasis of a minor arterial, such as TH 10, is on mobility as opposed to direct land access. Regional policy advocates land access management and control as tools in ensuring that minor arterials continue to operate efficiently and effectively. In addition, we conducted our previous reviews of this proposal with the understanding that the site is to be developed as a Planned Unit Development (PUD). Resubmittal of this proposal as a preliminary plat disregards the intent and integrity of the PUD process if resubmitted merely for trunk highway access purposes. Three of the four lots in the preliminary plat have direct access to Silver Lake Road. The city should act accordingly to limit access to this site to the local roadway network. Direct property access is most efficiently and safely provided by internal circulation and streets that provide access to TH 10. Mn/DOT Metro Division's long range investment plan identifies TH 10 as a preservation corridor. The plan places the highest priority on the use of resources to preserve the existing transportation system. Preservation strategies maintain the facility or roadway in its current condition to serve its current purpose. If future TH 10 improvements are required because of this development proposal's trunk highway access, the improvements will be the responsibility of the project proposer, the city or both. We prefer to work in partnership with landowners and the city to prevent problems before they occur. Our ability to preserve safe and efficient traffic flow on the highway is compromised when we lack city and landowner cooperation. It is our desire to work with you to manage the highway system effectively. 11111 • We will allow the requested accesses. However, we strongly recommend consolidation of access and local roadway use to best serve the operation of TH 10 and safety of the proposed project's users. We require access permits for all three accesses to TH 10. We require construction of a continuous right turn Iane on eastbound TH 10 for permit approval. This development proposal necessitates the continuous right turn lane and is the responsibility of the project proposer, the city, or both. All accesses that require installation of culverts must use 6:1 slopes. Placement of culverts must occur beyond the clear zone. The permit applicant must submit plan and cross-sectional drawings of the proposed access, showing the required turn lane. The developers meet with me about two weeks before the project was submitted to the City. It appears that the project is consistent with the previously submitted site plans. They have moved the outlet from the pond in front of the Senior Housing as recommended in earlier site plans to provide more distance between the inlet and outlet. I also indicated to them that I would like to have the outlet from the small pond moved southwest to provide a longer distance from the inlet to the outlet. We discussed the outflow from the site. To make sure the site drains,the culverts under the St.Paul Utility should be operationaL There was some question to whether or not the developer could improve these culverts since it may or may not be on their property. This issue may need further investigation. The final item hydraulic item discussed was the overflow from the pond in front the Senior Center. I indicated to them they should make sure the emergency overflow is away from the garage and towards the street. They will investigate this. We also discussed the buffer area. I indicated to them that I would like to see natural vegetation between the ponds and buildings. This area should be obtained as an easement by the City to assure it is not mowed. My main concern is encroachment in the buffer. The developer will need to address this issue to make sure the intent of the buffer is meet. If you have any other questions please call be at 490-2026. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the Development Review request by Silverview Estates Development Company contingent upon the following: 1. Before the City Council takes action on this Development Review request, the applicant shall amend the plans as follows: a. The table showing pervious and impervious area by lot shall be amended to be consistent with other tables and to reflect accurate data and to include a column for percentages pervious and impervious. b. Building heights, canopy detail and signage for the Holiday store shall be added to the plans. • c. The 30-foot parking lot setback along Silver Lake Road for the senior housing building is labeled as 10 feet. This will need to be changes to reflect the correct setback. d. Where existing vegetation/plant materials are to be preserved, the landscape plan shall be updated with a notation to reflect this. e. An updated light plan is required which clearly shows the fixtures to be used and their placement about the site. In addition, the lighting used under the gas station's canopy shall be shielded or hooded to comply with City Code regarding glare. f. An area south of Lot 3 has been designated as snow storage. No storage of any kind will be permitted within the wetlands area or NURP ponds. As such, the plan shall be changed to show the snow storage between the parking lot and the wetland boundary on Lot 3. g. Sign setbacks shall be shown on the plans. h. Detailed plans are required which show the RV service center and the containment measures used to prevent spillage. • I. "NERP" shall be changed to "NURP." Three additional handicap accessible stalls are required on Lot 2 located on either side of the building's main entrance and additional stalls shall be added to the underground parking to satisfy ADA requirements of one handicap space per every 25 spaces or fraction thereof. k. The landscaping detail on the individual site plans shall be removed so as to eliminate any inconsistencies with the master landscape plan. 2. Per the City Engineer's memo dated 11/14/97, the following items will need to be corrected prior to City Council action on this request: a. The outlet from the NURP pond located on Lot 3 shall be moved more to the southwest to provide and longer distance from the inlet to the outlet and prevent a short-circuiting of the water. b. The overflow from the NURP pond located on Lot 4 shall be positioned so as to ensure emergency overflows drain away from the garage and toward the street. c. The applicant shall ensure that the culverts under the St. Paul Water Utility are 4111 operational. 3. Per the Fire Marshal's memo dated 11/12/97, the following items will need to be corrected prior to City Council action on this request: a. The fire department connections for the senior residential building and the two-story office building shall be shown on the plans to be readily accessible year round and at all times. b. An additional fire hydrant shall be added to the utility plan on the east side of Silver Lake Road near the south end of the senior building. 4. Before any permits are issued for this subdivision(building, grading or otherwise), the applicant shall accomplish the following: a. The park dedication fee in an amount specified by the City Council shall be paid as required in Section 1204.02 of the Municipal Code according to the appraisal report dated October 31, 1997. • b. A separate easement document shall be executed which dedicates to the Citythe 30' P by 30' area labeled "Signage Easement"shown on the site plan at the corner of Highway 10 and Silver Lake Road. A development contract which sets forth all of the terms, conditions, requirements, agreements, guarantees and plans for the orderly development of the land shall be executed as required by Section 1006.06, Subd. 4 of the City Code. d. Obtain a permit from MnDOT for accesses onto Highway 10, drainage into the Highway 10 right of way and any grading within the right of way. e. Obtain approvals from Ramsey County for the final grading and drainage plans, access and construction on County right of way, and a utility permit for construction within the County right of way. f. Obtain a general stormwater permit from the Minnesota Pollution Control Agency. As you may recall, this signal is an important part of the theatre project on the O'Neil property as well as the Ring Road concept. It is anticipated that the theatre project will be proceeding through the development review and major subdivision approval process in December and January. Also attached is a copy of the response to MnDOT from SEH ( the City's consultant ) concerning this matter. • City staff has contacted MnDOT staff to see how they will be considering the petition and if further input from the City is required or desired. Mn Dot staff stated that they will work with the City to resolve any issues. City staff will be meeting with the Association to try to address their concerns. STAFF RECOMMENDATION It is recommended that the Planning Commission discuss this matter and if appropriate pass a resloution in support of the signal. The relocated intersection would be approximately half way between County Road H2 andd Long Lake Road. The existing Edgewood Drive intersection at Highway 10 is at a very skewed angle. The Commission indicated that in general the process included in the planning grant application should be followed and that the Commission preferred working as a whole versus in subcommittees. The Commission also indicated that public forums by planning districts should be held to gain citizen input. It was also suggested that the staff should work with the local newspapers to do articles on the Comprehensive Plan and the update process. Staff was also directed to prepare an updated schedule. At the November 19, 1997 meeting staff will present the revised schedule and talk about the format for the public forums.
