Item Title/Subject: Charitable Gambling Ordinance
Staff was directed by Council to research each permanent Charitable Gambling Permit to ensure that each
licensee is contributing the Mounds View Trade Area. According to the City Code Section 502.13. subd. 2 (c):
c. By December 31st of each calendar year, a licensed organization conducting lawful
gambling within the City shall expend seventy five percent (75%) of its expenditures for
lawful purposes conducted or located within the City’s trade area. The City’s trade area”
is defined as, and limited to, Mounds View, Spring Lake Park, Blaine, Shoreview, Arden
Hills, New Brighton and Fridley.
According to Section 502.13, subd. 2 (d), of the City Code, each organization licensed to conduct charitable
gambling in the City shall report monthly to the City its gross receipts, expenses, and profits from those
activities in and the distribution of those profits, itemized as to payee, purpose, amount and date of payment.
Organizations licensed to conduct charitable gambling at more than one (1) site must provide the above-
mentioned information for each site within the City. These requirements may be satisfied by submission of
copies of the monthly reports required by the Gambling Control Board.
On February 14, 2005, the Twin Cities Chamber, the Lion’s Club and Merrick, Inc., made presentations to the
Mounds View City Council to discuss their contributions to the Trade Area. Attached is the February 14, 2005
Minutes for your reference. Also, below is a breakdown of what each permit holder’s contributed to the City’s
trade area in 2005 for your reference.
Merrick, Inc.
Merrick, Inc., is a nonprofit organization 501(c)(3) charitable corporation, licensed by DHS as a Day Training &
Habilitation (DT&H) and Supported Employment Services (SES) provider. The focus of their program is to
provide employment services to adults with a developmental disability. Merrick’ Inc.’s charitable gambling
license was approved on January 26, 2004, and they did not start their Charitable Gambling activities until May
of 2004. They currently hold a permit with Robert’s Sports Bar and Entertainment. Below is a breakdown of
their contributions for 2005:

Staff understands that the City Council has been concerned with Merrick’s Charitable Gambling activities in
regards to their contributions to the trade area. It seems that Merrick, Inc., only states on their tax returns the
“Mounds View Trade Area” and other permit holders state the trade area organization/business they
contributed to. This was further explained in a presentation presented by Merrick to the City Council on
February 14, 2005 (Minutes Attached).
Twin Cities North Chamber of Commerce
The Twin Cities North Chamber of Commerce, is a non-profit organization, which holds charitable gambling at
Jake’s Sport Café in Mounds View. Their mission is to improve the northern Twin Cities metropolitan area.
According to their website, they accomplish this by:
• Being a bold voice for business.
• Increasing the “value” of chamber membership.
• Expanding leadership capacities.
• Engaging and supporting tomorrow’s workforce.
The Twin Cities North Chamber of Commerce has operated a charitable gambling permit since February of
2002, when they were known as the New Brighton/Mounds View Chamber of Commerce. On February 23,
2004, the City Council approved a charitable gambling permit under its new name, Twin Cities North Chamber
of Commerce. Below is a breakdown of their contributions for 2005:

The Mounds View Lions is a non-profit organization that currently holds a charitable gambling permit at the
Mermaid. The Mounds View Lions does many things for the Mounds View Community to include Foodshelfs,

November reports on all permit holders should arrive by next week and the December reports should arrive in
January. Attached are the most recent tax reports from all permit holders for your reference. All monthly
reports are available up on request.
There was some discussion at the February 14, 2005 City Council Meeting in having a City Fund in which
Charitable Gambling organizations contribute 10% of their earning into a City Fund. This was discussed at the
February 14, 2005 meeting with opposition. The City Council may want to address this issue again if it feels
that the City’s Charitable Gambling Ordinance is too vague.

Item Title/Subject: Discuss Revising Section 502.08 of the Mounds View
City Code in regard to Public Hearing of Liquor
License Renewals
Section 502.08 of the City Code requires that a public hearing be held prior to the
renewal of any intoxicating liquor license. Section 502.08 states:
502.08: LICENSE HEARING: No issuance of a new license or
transfer of an existing license for the sale of intoxicating liquor
on-sale, off-sale, club, Sunday sales or on-sale wine shall be
hereafter granted by the Council until a public hearing has
been conducted by the Council after published notice in the
official newspaper at least ten (10) days in advance of the
hearing. Renewals of existing licenses issued under this
Chapter and the issuance of temporary intoxicating
special event and banquet licenses as defined in Section
502.03, subdivisions 6 and 7 of this Chapter may be
granted by the Council after a public hearing without the
requirement of a prior published notice.
Staff feels that this section of the Code needs to be revised. The concern is the
requirements of all intoxicating liquor license renewals go before a public hearing
without the requirement of published notice. A public hearing is used to encourage
input from residents. By not publishing the notice, residents would not be aware of a
liquor license renewal, and therefore, the City may not be aware of problems other
than what is offered by police reports.
Staff recommends amending Section 502.08 to read that public notice is required on
all renewal liquor licenses. If the City Council is in approval, then Staff will start the
process of revising the code by the Ordinance process.

Item Title/Subject: Review Request to Amend City Code to Allow
Outdoor Restaurant Seating and Consumption of
Alcohol
Introduction:
Jake’s Sports Café of Mounds View, which had recently considered a sale of the facility, has
requested the ability to open an outdoor patio seating area attached to their existing
business at 2400 County Road 10. The City however does not expressly allow consumption
of alcohol outside of the licensed premises. The state does not regulate such activity,
leaving the issue up to individual cities to determine.
Discussion:
Many cities allow exterior patio seating associated with a restaurant, many of which holders
of liquor licenses. Local examples of restaurants serving alcohol with exterior seating can be
found in New Brighton (Jake’s, John Barleycorn Brew Pub), Roseville (Old Chicago, Joe
Sensors) as well as numerous downtown locations in St. Paul and Minneapolis. To stay
competitive and to offer its clients a refreshing seating alternative on warm days, Jake’s is
planning to expand the business to add such a seating area and have requested that the
Mounds View liquor licensing regulations found in Chapter 502 be amended to permit such
activity with appropriate restrictions and controls. If the council is not opposed to the idea in
principle, staff will draft such an amendment, working with the City Attorney, and present the
changes at a future worksession.
Recommendation:
Discuss the request and provide direction to staff as to the potential amendment.

Item Title/Subject: Setting the 2006 Meeting Dates for City Council Meetings
DISCUSSION:
Based on the Council’s schedule of conducting meetings, Work Sessions are normally
scheduled for the first Monday of each month and Council meetings on the second and
fourth Mondays of each month. Attached is a proposed list of Work Session and City
Council Meeting dates for 2006. These dates will be finalized at the December 12, 2005,
City Council Meeting by resolution.
Three legal holidays fall on dates that would otherwise be considered Council meetings—
New Years Day (in accordance with Section 3.10 of the Personnel Manual New Years Day
is observed on Monday, January 2, 2006), Labor Day (September 4, 2006), and Christmas
(December 25, 2006). For these dates, the schedule reflects a Tuesday meeting date.
Staff has also scheduled one Special City Council Meeting for 2006 on Thursday,
November 9, 2006, to canvass the 2006 Election Results.
Staff would also like to discuss with the City Council about Council availability for the 2006
City Council Staff Retreat. Normally, the City has conducted this retreat at a Work Session.
Please review the Work Session calendar (attached), and direct staff on what dates would
work for the City Council.
In addition to a City Council Staff Retreat, Staff recommends scheduling a discussion on
Meeting Administration and Protocol. This can be scheduled at any Work Session. Staff
recommends this discussion either on the January or February Work Session.

D. OTHER INSPECTIONS / PLANNING FEES
Applicants are responsible for all costs incurred associated with the filing, review and
processing of development applications. Such fees are to be paid in escrow up front or upon
receipt of statement from the City of Mounds View. Fees may include but are not limited to
costs for consultants retained by the City, consultant planning services, attorney, and
engineer fees. A deposit may also be required to cover costs of public notices, materials
and staff time spent in the review, research or preparation of materials associated with this
application. The applicant shall be responsible for all reasonable incurred costs in excess of
the initial deposit amount. Any portion of the deposit not spent or encumbered shall be
refunded to the applicant within 30 days after consideration of the application is completed.
Payment of park dedication fees is required with subdivision applications. Application fees
are not refundable.

City Council Meeting in December due to the holidays. Currently, the last City
Council Meeting in December is on December 27, 2005. Staff feels that this City
Council Meeting is not necessary and recommends that the meeting be cancelled.
If the City Council agrees, then the cancellation of the December 27th City Council
Meeting will be announced at the December 12, 2005 City Council Meeting.

Item Title/Subject: Board and Commission Member Reappointments
Each member of a board or commission (except the Charter Commission), will need
to be appointed by the City Council from Applications submitted. Several members
of different boards and commissions have terms expiring on December 31, 2005.

Staff would like permission from the City Council to call each individual whose term
expires on December 31, 2005, to see if they wish to be reappointment for another
term. By contacting them verbally, it will speed up the process in having them fill out
another application. The City will then draft a resolution for the City Council’s
consideration approving these re-appointments. If any member wishes not to renew
their term, then Staff will start the process of advertising.
