EDC BUSINESS A. Discuss 2009 Economic Development Priorities Community Development Director Ken Roberts referenced Ms. Steinmetz's staff report that included the EDC's 2008 priorities. Acting Chair Helgemoe stated that redevelopment along the County Road 10 corridor should remain the EDC's#1 priority. Commissioner Larson added that Risdall's Residents Survey Report suggested that a high number of residents feel that the corridor should be kept neat and tidy and that the City should do something about the blighted buildings. Mr. Roberts suggested that the EDC add Commissioner Larson's suggestion as item H under Priority 1. 411 The EDC agreed upon the„following • language for this item: "Improve the aesthetics of properties in the County Road 10 corridor” Commissioner Belting asked to incorporate the Mounds View Branding Project into the EDC's list of priorities. Mr.Roberts suggested that it become EDC Priority 2. Mr. Roberts stated that it is important for the City to useand implement the information from the study. The EDC agreed upon the following language for their new Priority 2: "Incorporate the Risdall Branding Study, including marketing and communications plans, to help guide the EDC's priorities and recommendations". The EDC reordered the rest of their priorities and added a new one for 2009 (as follows): • Priority 3 became "Monitor and assist with Citywide housing issues and projects". • Priority 4 became "Support the implementation of the Citywide Street & Utility Improvement Program". • Priority 5 became "Skyline Motel Redevelopment'. The EDC also clarified Priority 1 under item A to read "Premium Stop Redevelopment Area (south to County Road H)". Motion/Second: Commissioner Johnson moved and Commissioner Entsminger seconded the approval of the 2009 Economic Development Priorities. Potential Mounds View Farmer's Market - Commissioner Wagner The EDC discussed collaborating with an existing farmer's market or starting a satellite one in Mounds View. Vice Chair Wagner will bring additional information to a future EDC meeting. 8. REPORTS OF STAFF A. Mounds View Branding Project Update Mr. Roberts recapped Risdall Marketing Group's presentation of the Residents Image Survey results at January 5, 2009 City Council Work Session, which was a joint meeting between the EDC and City Council. B. Former Silver View Plaza Tenant - Jian Kang Massaqe Mr. Roberts explained the circumstances of Jian Kang Massage's departure. C. New Silver View Plaza Tenant ''Fantastic Sams Now Open Commissioner Entsminger left the meeting at this time. D. County Road 10 Redevelopment Update Mr. Roberts recapped the developer's presentation at the January 5,2009 City Council Work Session. 9. The report includes the purpose of the program, the City's current Certificate of Occupancy application form and examples of business registration • programs from New Hope, New Brighton, Maplewood and Ramsey. The City Council provided Ms. Osmonson with positive feedback about such a program on January 5th and directed her to draft a new ordinance to implement the program. The Council may review the draft ordinance in March. Economic development staff discussed this potential program with the Twin Cities North Chamber of Commerce's Economic Advancement Committee on January 28, 2009. The Committee suggested that the Council consider imposing a fee to businesses only if they do not provide the City with the requested information and to model the City's program after the Minnesota Secretary of State's "Annual Business Renewal" requirements. The Secretary of State's office has different forms depending on business type (i.e. Sole Proprietorships, Nonprofits, LLPs, etc.), so staff attached one 2- page form as an example (the "Minnesota Business Corporation" form). Discussion Since the EDC acts as an advisory body to the EDA/Council on matters relating to ways that the City can expand existing businesses and attract desirable new businesses, staff thought the EDC should provide input to the EDA/Council about this potential program. • Item 6A-Discuss Potential Business Registration Program February 20,2009 EDC Meeting Page 2 of 2 Economic Development staff agrees with the Chamber Committee's suggestion to impose a fee only as a penalty but staff is not familiar enough with the Secretary of State's Annual Business Renewal process to suggest it or not. Staff also agrees that one comprehensive business database is more effective than several databases. This potential program could also be a way to promote the business programs offered by the Spring Lake Park-Blaine-Mounds View Fire Department. A list of the Fire Department's business programs are attached (more details on each program are available at www.sbmfire.com). Recommendation Staff recommends that the EDC provide input about the potential business registration program to the City Council. Staff will forward the input to the City Council when they consider the draft ordinance. The purpose of this memo is to explain the pros and cons of a • business registration program and to request direction from the City Council about possibly starting such a program. Discussion: The purpose of a business registration program would primarily be for the City to obtain and maintain information about all businesses in Mounds View. The City would use this information to inform appropriate City Departments of the current occupancy and of occupancy changes within buildings. This would allow the police and fire departments to maintain updated information for pre-incident planning including hazardous materials locations, operations and emergency contact lists. Inspections and code enforcement personnel would have information about the parties who would be responsible for abating any code violations or life safety conditions that may exist from time to time. These departments also would have date of birth for the party responsible for the business. Having this information would allow the City to issue orders and citations when necessary with fewer staff hours involved. Upon receipt of the Business Registration application, the City would verify that the business meets the City Code and State Building and Fire Codes before the business may be registered within the City of Mounds View. The planning department also would have an opportunity to review the proposed use to ensure that the proposed business would conform to the zoning for the property and building in which the business intends to operate. Mounds View Staff Report January 5, 2009 . Page 2 Businesses posing a higher fire hazard (such as those with combustible metals and businesses with high pile storage) and licensed facilities shall submit information about their operation (such as operations that would require a fire permit or change of ownership, see the attached Occupancy Certificate form).to the City every year, while ordinary occupancies (such as retail sales) shall update their business and contact information every three years. This timeline coincides with annual fire inspections for high hazard and licensed businesses and the other businesses on a three year rotation. New businesses in the City would need to apply for the registration before operating the business at which time their plan would be reviewed. The inspections would take place when they are operational, similar to a final building inspection that takes place after the building is being built, if the plan is approved, and ultimately approve the business registration upon compliance with the applicable codes. Business owners and operators would be responsible for keeping their contact information current with the City rather than having each department independently collect this as now happens. The registration program will not only consume fewer staff hours, the businesses will only have to be bothered to supply this information once a term, rather than two or more times annually. The City will require the following information (in addition to the information collected in the Occupancy Certificate application) (attached): • • Verify the proposed business fits the zoning of the site and would meet the zoning district standards. • Business owner's date of birth. • Building owner's contact information and date of birth if it is a rental building. • Hours of operation. • Business and building insurance information including the amount of insurance carried and insurance carrier information. The business license/ registration program would be more complete and mandated than the existing occupancy certificate program. As envisioned by staff, the new registration program could merge with the existing City occupancy certificate program. For more information, please refer to the attached documentation from nearby cities that currently have business licensing / registration programs. While these programs vary significantly, every one has a fee involved. This fee would help to sustain the program. It will take some administrative staff hours to set up and maintain the database, but in the end it will save inspectors' staff hours in researching business and building owner information. To help the City Council understand some of what occurs with businesses, various contacts and City staff, I have prepared the following examples: 111 Mounds View Staff Report January 5, 2009 • Page 3 Silver View Plaza After the initial fire inspection of the Laundry King (in which they failed their inspection), staff sent correction orders to Kraus Anderson (the property owner), as we had no contact information on the tenant. Before staff was able to locate the tenant, we received a complaint about this business. As staff has done in the past, we asked the water department to let us know who pays the water bill for the business. In this case, staff found they have another company doing their bill paying. Kraus Anderson had to research the owner information and assist City staff in locating the manager to open the venting areas so City staff could complete the fire inspection and follow up on the complaint. When City staff completed the re-inspection of the mall, staff noted that a new furniture store had moved in to Silver View Plaza and was in operation. This business may be considered a change of use, as they are now storing and selling furniture where previously there was a "B" occupancy. This new use may require a sprinkler system upgrade and an update of the emergency services pre-incident planning. As such, City staff continues to work with landlords and business owners to resolve these matters. If the City had a business license/ registration program, the new business would have been required to register with the City before operating. Based on such a registration request, City staff would have inspected their facility, identified the hazards and would • have required the owner or operator to correct problems before they moved into their space. Wvnsong Theater Staff has been working with this business since February 2008 on a non-heated closet enclosing a sprinkler valve assembly. This code violation came to our attention after a fire call to the building for a water-flow situation. Theater management indicated that they would install an anti-freeze system no later than May 2008. When City staff followed up with the manager in May, they promised that the room would be heated by September 2008. A follow up by City staff in September to the district manager said the issue is being held up at the corporate level. Having this information available to staff early on (through a licensing or registration process) would make complete communications with all levels of their management cleaner, and would define a responsible party for correcting violations, rather than working with middle and lower management. Again, if the City had had the contact information from the beginning, we would have saved many hours of City staff time in trying to resolve the matter. Recommendation: Provide City Staff with direction about the City Council's interest in starting a business registration or licensing program in Mounds View. If the City Council has interest in such a program, then City staff would continue to work on the matter and would bring back more details for Council consideration. The program requires every new business in New Hope to register with the city and arrange for an inspection of their facility before it opens for business. This inspection will ensure that the new business'building is safe, appropriately equipped, and meets building and fire code requirements for the type of operation planned. In the past,many new businesses moved into New Hope without the knowledge of city staff. New business owners sometimes did not have a complete understanding of all of the fire safety and building code requirements that applied to their type of business in New Hope and,consequently,failed to comply with some of those requirements. Now,new businesses will be able to avoid potential fire safety and building code problems by registering with the city through the BUCO program and working with New Hope building inspectors and West Metro Fire-Rescue District fire inspectors to • resolve any code issues before opening for business. By proactively addressing building code and fire hazards, the BUCO program will help to ensure the safety of employees of local businesses and the surrounding community and protect the investment of commercial and industrial property owners. The process begins when a new business completes an application(enclosed)that provides the city with basic information about its proposed operation. The$25 fee,which accompanies the application,helps to pay for the program.After reviewing the application,city inspectors advise the new business owner of building code and safety requirements they must comply with. Once a new business owner believes they are in compliance with all code requirements,he or she schedules an appointment with city and West Metro Fire inspectors. At the same time, the Police and Fire Departments inspect or respond as needed or necessary to all businesses regardless of their license status. Amendment The following text is hereby incorporated into Chapter 7, Licensing and Permits, of the City Code. Section 7.20 Business Registration Certificate Section 7.20.01 General Provisions Subdivision 1: Purpose The purpose of this Section is for the City to obtain and maintain current information on all businesses 411111 as defined herein located in the City in order to inform appropriate City departments of the current occupancy and occupancy changes within buildings, permit the City to update and review records regarding emergency contact lists, fire preplan, inspection, and hazardous materials, permit the City to ensure that any business intending to operate within the City shall comply with the State Building Code, the State Fire Code, the City Code, and insure that the business uses conform to the building in which the business intends to operate. The information obtained will also allow the City Police Department to be notified of any hazards or security issues that may affect the community's health, safety and welfare. Subdivision 2. Definitions The following words and phrases,when used in this section, shall have the meanings set forth: Person - Includes an individual, partnership, corporation, or any body of persons, whether incorporated or formed as an association or not. Business — Any establishment, occupation, employment, or enterprise where merchandise is manufactured, exhibited or sold, or where services are offered for compensation. Zoning Administrator—The City's Community Development Department shall be deemed the Zoning Administrator. Subdivision 3. Application and Required Information Application for a Business Registration Certificate ("BRC") shall be made with the Zoning Administrator on a form furnished by the City. The application shall be filed with the Zoning Administrator 30 days prior to any Business's intended occupancy, or 30 days prior to the existing • BRC's expiration date. The expiration date for all BRCs is December 31st. The Mermaid Subdivision Charlie and Dan Hall, owners and representatives of The Mermaid, have applied to the City for a major subdivision. This latest proposal shows the property divided into two lots — including creating a new 3.0-acre parcel (for the existing hotel and 273 parking spaces) from their existing 8.9-acre site. The owners of the Mermaid wish to divide their • property to create separate lots for the Mermaid Entertainment Center and the Americlnn Hotel. This new plat is a substantial change from the previous plat approved by the Planning Commission and City Council this past Fall. B. New Convention &Visitors Bureau (CVB) Mounds View's Economic Development staff sits on the Visit Minneapolis North (VMN) board of directors. Mounds View is one of eleven cities represented by VMN. In general, CVBs promote their cities through marketing to visitors, especially by promoting hotels and meeting facilities. Mounds View's involvement with a CVB is crucial since the City itself has limited funds to spend on marketing. It appears as though VMN is going to split into two separate CVBs with the dividing line being the Mississippi River. City staff has been involved in the discussions on different levels: Clerk Administrator Jim Ericson, Community Development Director Ken Roberts and I met with representatives of the new CVB on January 5, 2009 and I've been involved with the board of directors and a special task force. Most recently, the Twin Cities North Chamber of Commerce passed the attached resolution dated February 3, 2009 supporting a new CVB. Jim Ericson then provided the City Council with the attached e-mail on February 11, 2009. Finally, Jim Ericson and I will be attending a meeting of cities on the east side of the Mississippi River on • February 18, 2009 to discuss further the new CVB. City Council Goal Setting Retreat: Saturday, February 28, 2009 The City Council and City Department Heads will participate in their annual goal setting retreat on Saturday, Feb. 28, 2009 at Random Park. Staff will provide the EDA/Council with the EDC's 2009 Priorities at the Feb. 23, 2009 EDA meeting. D. 5th Annual Town Hall Meeting: Saturday, April 25, 2009 All Mounds View residents are encouraged to attend the 5th Annual Town Hall Meeting on Saturday, April 25, 2009 from 9am to noon at the Mounds View Commuity Center. Mounds View Branding Proiect Update Below is a timeline of upcoming branding activities: • • February 23, 2009 EDA meeting - The staff from Risdall will present the EDA with their Discovery Findings Report (summary of all research) and Mounds View's Preliminary Brand Strategy. Although the surveys, interviews and research are the basis for developing the brand strategy, the EDA/Council needs to accept Risdall's Discovery Findings and provide input on the Preliminary Brand Strategy before the project moves forward. • February 28, 2009 City Council Goal Setting Retreat - The staff from Risdall hopes that the Council will further discuss the Preliminary Brand Strategy at the retreat. • March 9, 2009 EDA meeting - The staff from Risdall will present the EDC and EDA/Council with Mounds View's final Brand Strategy and new logo/tagline. • March/April 2009 - Risdall Marketing Group will develop a marketing/public communications plan for the City. Select Senior Housing Project Update (95 Units) By the end of this month, Joel Larson of Select Companies plans to finalize the purchase of three properties (former trailer hitch business and three single-family homes) located on the northwest corner of County Road 10 and Groveland Road. Select Companies will demolish the existing structures and will construct a 95-unit senior housing facility this Spring. They applied for a building permit from the City last week. I thought I would bring to your attention a matter which you will certainly be dealing with in the coming future relating to the Visit Minneapolis North (VMN) Convention and Visitors Bureau (CVB) . There has been some discord and discontent within the organization regarding the future of the organization and perceived inequities and disparity of dollars spent on certain efforts. There is a push to divide the CVB into two distinct CVBs based on geography with the Mississippi acting as the dividing line. Essentially, what is proposed is that a new CVB would be formed to represent the National Sports Center and surrounding communities (including Mounds View. ) The CVB derives most of its revenues from motel and hotel lodging tax which cities collect from the motel and hotel property owners which is then passed on to the CVB. The National Sports Center feels that not enough CVB resources are being used to market their programs, events and activities. Four communities have already Alhopted out of the VMN CVB (Arden Hills, Shoreview, Blaine and Coon Rapids) and a meeting is being held next week to discuss possible next steps (see attached notice. ) I will be 41"attending this meeting. The 11 member cities have adopted an ordinance allowing for the lodging tax and have signed agreements with VMN for them to provide marketing services for the cities. There has been a lot of discussion in the past year about the partnership between VMN and the National Sports Center(NSC), including the future direction of the NSC. While the VMN Board has fought to keep the organization together, four cities have opted out(Arden Hills,Blaine, Coon Rapids and Shoreview)and it may be inevitable that the organization change results in the incorporation of a new convention and visits bureau. VMN has had a task force meeting to address some of these issues. While the VMN Board of Directors voted in December to keep the 11-City organization together,the task force has come to the conclusion there may be too much dissention and it is time for cities to discuss some of these issues. It was recommended at the last VMN task force meeting that cities east of the Mississippi River meet to discuss what might be in the best interest of their city and lodging properties. As a result, a meeting has been put together for the cities on the East side of the River to review and discuss the issues and to come up with a plan of action. The meeting has been scheduled for Wednesday,February 18,2009 at 7:30 a.m. at Coon Rapids City Hall.
