CALL TO ORDER Chair Gary Meehlhause called the meeting to order at 7:30am. 2. APPROVAL OF SEPTEMBER 18, 2009 AGENDA Motion/Second: Commissioner Johnson mowed and Commissioner Entsminger seconded the approval of the September 18, 2009 EDC agenda. APPROVAL OF AUGUST 21, 2009 EDC MINUTES Motion/Second: Commissioner Larson moved and Commissioner Entsminger seconded the approval:ofthe August 21, 2009 EDC minutes. Motion Carried: 6 Ayes 0 Nays 5. SPECIAL BUSINESS There was no special business. 6. EDC BUSINESS Economic Development Specialist Heidi Steinmetz summarized her staff report about the • Burger Time concept for the former Premium Stop site located at 2390 County Road 10, which the Mounds View EDA owns. She asked the EDC for input on the concept and if the Draft EDC Minutes September 18,2009 Page 2 of 5 • EDC had a recommendation for the EDA on setting an asking price for the property. She said staffs recommendation would be for the EDA to set an asking price. Commissioner Johnson said that the Burger Time concept for the former Premium Stop site would"wreck"the City's goals to redevelop the area into a multi-use project. Ms. Steinmetz responded that the highest and best use of the area would be to combine at least two of the area's parcels and preferably more. Chair Meehlhause noted that there are no property taxes currently being generated from this parcel since the EDA owns it. He asked what a potential Burger Time building would generate in taxes if it were to locate on the site. His said that the EDA is not going to be able to sell the property for the amount they invested in it because the EDA's investment included the land price, the appraisal, the building demolition and the site cleanup. Chair Meehlhause is wondering how long it would take for the new taxes that would be generated from a Burger Time building to break even with what the EDA might receive as a realistic purchase price. Ms. Steinmetz said she has not run the numbers on that scenariou but will do so before the EDA/City Council's discussion on the topic. She added that if the parcel is ever developed as a single-use parcel (no matter what the use)that the building is going to be a small building since the parcel is only 1.28 acres. Commissioner Larson said that Burger Time is a good concept for that area because it will spruce up that corner and bring more traffic into that area. Community Development Director Ken Roberts said that the EDC should discuss whether it is worth waiting several years for the area to attract a more comprehensive redevelopment • project. Vice-Chair Wagner-Harkonen said if Burger Time is hoping to open forty stores in the next four years that it would be good for Mounds View to be on the cutting edge by offering a site to Burger Time. ,;She also said that community members should be educated on the extraordinary costs`of redevelopment Commissioner:.Helgemoe said that if Burger Time is willing to purchase the property at a reasonable price,then it would clean up the corner and spur more redevelopment. He went on to say that community members would rather have sit-down restaurants and a larger redevelopment project for the area and that Burger Time does not fit that model. He concluded by saying that it could take years for a larger redevelopment project to occur in that area. Chair Meehlhause mentioned that the property located at the corner of County Road 10 and Woodale Drive has been for sale for years. Commissioner Entsminger said that it would be good to get the earth moving on the former Premium Stop site. Commissioner Johnson said that she would prefer to wait for a larger redevelopment project because it would be better for the City in the long-term; however, a larger project is not realistic right now. She said that the City should at least talk with Burger Time because it would at least spur the discussion of an asking price for the property. She suggested that • we pull the file on Snyders to compare what Synders paid for their property on County Road 10 versus what someone might pay for the former Premium Stop site. Draft EDC Minutes September 18,2009 Page 3 of 5 Commissioner Helgemoe did some quick math and said that if it's true that Burger Time typically pays $250,000 for land, that equates to $4.00 per square foot for the former Premium Stop property. Ms. Steinmetz said that $4.00 per square foot is low for outstate Minnesota, let alone the Metro area. Motion/Second: Commissioner Johnson moved and Commissioner Larson seconded a recommendation to the EDA that they proceed in discussions with Burger Time or others interested in purchasing the former Premium Stop parcel located at 2390 County Road 10. Motion Carried: 6 Ayes 0 Nays Motion/Second: Commissioner Helgemoe moved and Commissioner Johnson seconded a recommendation to the EDA that the EDA set an asking price for the former Premium Stop parcel located at 2390 County Road 10 based on the mid-point of value ranges that at least three appraisers provide to City staff at no charge. Motion Carried: 6 Ayes 0 Nays 7. REPORTS OF COMMISSIONERS Commissioner Helgemoe reminded the Commission there was still time to participate in the Twin Cities North Chamber's"Nine is Fine"golf tournament tomorrow,Saturday,September 19, 2009. Chair Meehlhause asked Community Development Director Ken Roberts to provide an • update on Robert's Sports Bars farmer's/flea market. Mr. Roberts told the Commission that Robert's Sports Bar is no longer holding`flea markets this year but they plan on starting again in the Spring. ChairMeehlhause,also asked how business is going at Roberts because he noticed a lack of cars in the parking lot at 9pm on a Saturday. Mr. Roberts answered that he has noticed the same*thing during the week after evening Council meetings but he is unaware of the status of the business. Commissioner Johnson promoted the Irondale Youth Hockey Associations 5K and Kids Fun Run for Saturday,September 26, 2009. The run begins at The Mermaid and travels around Silver Lake. A pancake breakfast also begins at 8am that morning and the public is welcomed to attend.'Commissioner Johnson added compliments to Irondale football, boys and girls soccer and the marching band. Commissioner Helgemoe complemented the Mounds View Police Department for their help responding to a police call yesterday at Western Bank in Mounds View (Commissioner Helgemoe's place of employment). He explained that Western Bank's staff and the police officers were able to detain a person who was trying to cash false checks. He continued by saying that Western Bank has had nothing but positive experiences with the Mounds View Police Department. He added that the Mounds View Police are good at patrolling the area and that they have quick response times. Commissioner Entsminger said that the Festival in the Park was very successful this year. Commissioner Johnson added that she thought the fireworks were the best she had seen all summer. S Draft EDC Minutes September 18,2009 Page 4 of 5 8. REPORTS OF STAFF A. Former Let's Get Graphic Building (2442 County Road 10) Available Ms. Steinmetz said that the owner of Let's Get Graphic tried to purchase the building but the negotiations with the building owner fell through. Now that Let's Get Graphic has moved to Coon Rapids,there is about 14,000 square feet available at their former location of 2442 County Road 10. Ms. Steinmetz said that more information about the building is on the City's Website in addition to all of the available business sites in Mounds View. B. Recap of City Council Mini-Retreat on August 31, 2009 .--- Mr. Roberts stated that the City Council and Staff Department Heads met on Monday, August 31, 2009 for their semi-annual retreat. He highlighted the discussion topics that were most relevant to the EDC, which were"Review"and reaffirm the 2009 City goals and priorities" and "County Road 10 redevelopment and revitalization - aggressively pursue redevelopment opportunities." He said that the Council provided direction to City staff at the retreat that they (the Council) are not interested in offering any new TIF for redevelopment projects but that the Council is still interested in renaming County Road 10. Mr. Robert's mentioned a few other topics discussed by the Council at the retreat including foreclosure response efforts, code enforcement,the 2010 City budget and the new location for the City's annual Town Hall Meeting. He expanded on the City's code enforcement efforts, stating that the amount of code enforcement cases that the City's Code Enforcement officer has opened this yearis'three times more than last year at this time and the compliance rate is 80%. He credited the increase in cases to the new Code • Enforcement software that the City purchased. He added that City staff could not monitor as many cases without the new software, not to mention that the City's Code Enforcement officer has other duties besides Code Enforcement. Commissioner',Larson asked if renaming County Road 10 would be a financial burden on the City. Mr. Roberts said that it could be but that City staff has not delved into the process yet. He added that Mounds View would also need the participation from adjacent cities. Commissioner Larson stated that it is important for the City to move forward now with renaming County Road 10 and that the City has been talking about doing so for years and years. Chair Meehlhause asked if the Council's opposition towards the redevelopment of County Road 10 is unanimous. Mr. Roberts and Ms. Steinmetz agreed that the consensus of the Council is not to assist financially towards the redevelopment of County Road 10. Commissioners Johnson and Entsminger said that they do not understand this reasoning. Commissioner Entsminger added that County Road 10 is the first thing that people see when driving through Mounds View and that potential businesses do not see the internal improvements of the City, such as trails and new residential roads. Commissioner Helgemoe said that Western Bank's clients have difficulty locating the bank because of the confusion between State Highway 10 and County Road 10. He added that he can't imagine other Mounds View businesses don't have the same problem. Ms. Steinmetz stated that she doesn't believe County Road 10 in Mounds View will be • redeveloped unless the Council is willing to use the financial tools that the State legislature has afforded to cities in order to conduct redevelopment. She told the EDC that she hopes Draft EDC Minutes September 18,2009 Page 5 of 5 • the City Council will strongly consider developing Citywide goals in the Spring of 2010 that can truly be achieved. Commissioner Entsminger left the meeting at this time (8:45am). C. City Council Denied Business Registration Program Ordinance on Sept. 14, 2009 Ms. Steinmetz said that twelve Mounds View businesses provided input to City staff about their opposition towards this program,which is the main reason why the City Council denied the program. She added that there was an editorial in the Star Tribune today in favor of such a program. D. New Businesses: Mounds View Family Dental, Consulting Firm, Right Fit Running Ms. Steinmetz alerted the EDC about new businesses coming to Mounds View. Commissioner Johnson noted that all three businesses are planning to locate in either a new building or a newly renovated building in,M©unds View. E. EDA to Review City Tagline Ideas on October 12, 2009 Ms. Steinmetz reported that City staff had received suety tagline ideas from the public as of today, which brings the total of possible tagline ideas to around 100. 9. UPCOMING EDC MEETING The next regular EDC meeting is scheduled for Friday, October 16, 2009 at 7:30am. • 10. Chapter 408 of the Mounds View City Code states "The Commission shall be composed of seven equal voting members, including three business representatives and four residents". The City Code also states that the EDC must recommend whom the EDA/Council should appoint to the EDC. Attached is Chapter 408 for the EDC's reference. Discussion The five people listed below(in alphabetical order) submitted EDC applications to City staff by the October 30, 2009 application deadline. Recommendation Staff recommends that the EDC provide a recommendation to the EDA/Council with a listing of the applicants the EDC believes would best fill the three vacant EDC seats. Business representatives must fill two of the open EDC seats and a resident must fill the remaining seat. Each person appointed by the City Council will serve a three-year term (from 2010-2012). The Economic Development Commission is referred to herein as the "Commission". (Ord. 542,6-27-94) 408.02: PURPOSE: The Commission shall serve as an advisory commission to the Economic Development Authority, hereinafter the "Authority", on matters relating to fostering a positive economic climate, encouraging economic development and enhancing the tax base of the City. The Commission shall also make recommendations to the Authority regarding retention and expansion of existing businesses, attraction of desirable new businesses, redevelopment and rehabilitation opportunities, and other appropriate economic development strategies. (Ord. 542, 6-27-94) • City of Mounds View 408.03 408.06(Rev. 2/01) 408.03: COMPOSITION, MEMBERS, QUALIFICATION OF MEMBERS, TERMS OF OFFICE: (Ord. 677,2-12-01) The Commission shall be composed of seven (7) equal voting members, including three (3) business representatives and four (4) residents, appointed by the Authority Board of Commissioners based on the recommendation of the Economic Development Commission, from the applications submitted. Members shall have diverse qualifications with practical experience consisting of, not limited to, but including one (1) of the following areas: economics, finance, accounting, real estate, social services and marketing. For the purpose of initiating the Commission, the terms of all members shall expire December 31, 1994. (Amended,Ord. 741, 6- 28-04) Beginning January 1995, three (3)members shall serve a one (1) year term, two (2) members shall serve two (2) year terms and (2) members shall serve three (3) year terms. Thereafter, members shall serve three (3)year staggered terms, with terms expiring December 31 of each year. At least two (2) of these terms, but not more than three (3) terms shall expire each year. The appointees shall be duly sworn and take office at the first regular meeting of the Commission in the month of January each year. Both original and successive appointees shall hold their offices until their • successors are appointed and qualified. (Ord. 546,7-25-94; Ord. 677,2-12-01) 408.04: CONFLICT OF INTEREST: No person shall be appointed with private or personal interest likely to conflict with the general public interest. If any person appointed shall find that their private or personal interests are involved in any matter coming before the Commission, they shall disqualify themselves from taking part in action on the matter; alternatively,they may be disqualified by a two-thirds (2/3) majority vote of the Commissioners in attendance. (Ord. 542, 6-27-94) 408.05: COMPENSATION: Members of the Commission shall serve without compensation. (Ord. 542, 6-27-94) 408.06: VACANCIES: Subd. 1. Termination of Appointment: Any Commission member designing to terminate their appointment to the Commissioner before the expiration of their term shall give written notification to the Commission chairperson of their intentions. It should be the duty of the chairperson of the Commission to notify the Authority promptly of any vacancies. The Authority president, with approval of a majority of the Authority Board of Commissioners, • shall appoint a new member from applications received for the unfulfilled portion of the term. City of Mounds View • 408.06 408.07 Subd. 2. Removal from Office: Any member of the Commission may be removed from office for just cause and on written charges by at least four-fifths (4/5) of the entire Authority. Such member may be entitled to a public hearing before such a vote is taken. An appointed member may also be removed by the Authority for nonattendance at Commission meetings if a Commissioner is absent from five (5) regularly scheduled meetings per year or from three(3)consecutive meetings,without the consent of the Commission. (Ord. 542,6-27-94) 408.07: ORGANIZATION,MEETINGS: Subd. 1. Organization: At the first regular meeting of the year, the Commission shall appoint a chairperson from among its voting members. This appointment shall be subject to Authority approval and shall consist of a one (1) year term. The position of chair shall rotate among members,with no Commissioner serving in that capacity for more than two (2) consecutive terms. The Commission shall also elect a vice-chair from among its appointed members for a term of one (1) year. The Commission may create and fill such other offices from its • members as it may determine to transact Commission business. Subd. 2. Regular Meetings: The Commission shall hold at least one (1) regular meeting each month at a time which the Commission shall fix by resolution. Subd. 3. Special Meetings: Special meetings may be called by the chairperson or by any two (2) members of the Commission by a written notice filed with the Clerk-Administrator who then shall notify all members of the Commission of the time and date of the special meeting, at least three(3)days before the meeting date. Subd. 4. Quorum: A majority of the appointed voting Commission members shall constitute a quorum. Subd. 5. Voting Privileges: Each of the appointed members shall have equal voting privileges. Subd. 6. Bylaws: The Commission shall adopt bylaws for its governance and for the transaction of its business. The bylaws will be reviewed on an annual basis at the first regular meeting in February. Subd. 7. Records: A recording secretary shall keep a record of attendance at Commission meetings, a record of resolutions and votes and abstentions on each question requiring a vote. Report: The Authority may request an annual report from the Commission without having received consent of its content by a majority of the Commission members at a regular or special meeting of the Commission. (Ord. 542,6-27-94) 408.08: EXPENDITURES: The Commission may request from the Authority such funds as may be necessary and proper for the conduct of its duties. (Ord. 542, 6-27-94) 408.09: DUTIES OF THE COMMISSION: In order to carry on its purpose, the Commission shall: Subd. 1. Confer with and advise the Authority on all matters concerning the industrial and commercial development and redevelopment of the City. Subd. 2. Publicize, with the consent of the Authority, the industrial and commercial advantages and opportunities of the City. Subd. 3. Collect data and information as to the type of industries and commerce best suited to the • City. Subd. 4. Survey the overall condition of the City from the standpoint of determining whether the City has a community climate for industry and to determine the general receptiveness of the City of particular types of industry. Subd. 5. Publicize information as to the general advantages of industrial and commercial development and redevelopment in a community. Subd. 6. Cooperate with all industries and businesses in the City and in the solution of any community problems which they may have, and to encourage the expansion, development and management of such industries and business so as to promote the general welfare of the City. Subd. 7. Coordinate the Economic Development activities of the various groups active in the City. Subd. 8. Recommend zoning changes and development of areas suitable for industrial and commercial development and redevelopment to the Planning Commission. Subd. 9. Develop, compile, coordinate and publicize information such as, but not limited to the following: a. Existing industrial and commercial concerns within the City, their addresses, types of business,number of employees and whether each serves local,regional or national markets. • City of Mounds View S 408.09 408.09 b. Available industrial and commercial sites including number of acres and square footage, approximate price,existing zoning and proximity to highways. c. Available buildings for industrial and commercial operations,including type of buildings, number of square feet,existing zoning and proximity to highways. d. Transportation facilities, including railroads, motor carriers, water transportation, air transportation and highway facilities that serve the area. e. Electric power available. f. Fuels available for industrial and commercial use. g. Sewage disposal facilities. h. Water supply facilities. i. Community facilities such as fire,police and educational. • j. Recreational facilities. k. Going wage rate in the City for the trades, skilled and semi-skilled and white collar workers. 1. Availability of labor. m. General community attitude toward industrial and commercial expansion, development, redevelopment and attraction. n. Experience and programs of surrounding communities in regards to industrial and commercial expansion,development,redevelopment and attraction. o. Financial and technical resources available to new and existing businesses at the local, County, State and national levels for economic expansion and vitality. Subd. 10. Recommend Authority and Planning Commission policies and particular actions in regards to industrial and commercial expansion development,redevelopment and attraction. Subd. 11. Cooperate with and use the services of the Minnesota Department of Trade and Economic Development,Minnesota Housing Finance Authority and any other organizations at the national, State, County and local levels that are deemed conducive to the overall vitality of the City. • City of Mounds View • 408.09 408.09 Subd. 12. The Commission shall have the power to appoint task forces of a size and nature it may deem necessary and may enlist the aid of persons and/or organizations who are not members of the Commission. Subd. 13. The Commission shall have no power to make contracts, levy taxes, borrow money or condemn property, but shall have the full power and responsibility to investigate the necessity and recommend the taking of these and any other actions related to the industrial and commercial development and redevelopment by the Authority and all other officers of the City responsible to formulate the terms of and the procedure for taking such action. Subd. 14. Review the City's existing housing stock analysis and make recommendations to the Authority regarding mechanisms for the rehabilitation of said housing stock.
