Authorize Supplemental Field Review and Analysis to Assess Environmental 39 Conditions at 2696 County Road 10 Preparatory to Acceptance of Land 40 Donation 41 42 Community Development Director Ericson explained that this is a request for authorization for 43 environmental analysis at 2696 County Road 10 because the property owners have expressed an 44 interest in donating this property to the City after becoming aware of a trailway proposed. 45 Mounds View EDA November 13, 2006 Regular Meeting Page 2 46 Director Ericson indicated that an appraisal was requested by the owners for IRS purposes, the 47 City had one done, and the EDA authorized preliminary environmental analysis, as there were 48 other uses in this area prior to it being vacant. He then said that an auto repair shop on Silver 49 Lake Road, a home, and a couple of dump sites were identified and the findings indicated that 50 because of some hazardous contamination a further recommended analysis should be done to 51 include soil borings and water analysis on the site. 52 53 Director Ericson indicated that Staff does not think that there is any contamination on this parcel 54 but prior to accepting it the City should take a look at this and rule out that possibility listed in 55 the study done in the 1990s. 56 57 Director Ericson indicated that Bonestroo has submitted a proposal for handling the further 58 environmental analysis and Staff recommends approval of Resolution 06-EDA-225 Authorizing 59 the Additional Environmental Review not to exceed $3,700. 60 61 Commissioner Flaherty indicated that the Phase I and Phase II reports done in 1997 and in 2001 62 came back virtually negative on the site and he is wondering what has been on the site that would 63 change the report. 64 65 Director Ericson indicated that there is nothing that he is aware of. 66 67 Commissioner Flaherty said he does not feel that another assessment is necessary if the intention 68 is to keep this green space for the future. 69 70 Commissioner Flaherty asked what are the taxes received from this parcel right now. 71 72 Director Ericson indicated that this is a marginal property that may not be buildable as viewed by 73 the County so what is generated in taxes is minimal. He then said that the analysis did identify 74 some trace chemicals but where the contamination was found was not on this site. He further 75 indicated that, because it was found there, the rationale for moving forward with additional work 76 is to rule out that it has not migrated to this site since there was a dump site on this property. 77 78 Director Ericson indicated that to the untrained eye of Staff there is nothing that seems to be an 79 issue but Staff feels this would be an “insurance policy” for the City. 80 81 Commissioner Flaherty indicated that he would like to save the City $3,700 and, if there is 82 nothing substantial coming in from this parcel in taxes, he would like to designate it as open 83 space. 84 85 Commissioner Thomas said that she is not willing to take over any property that the City does 86 not have a known clean documentation for liability purposes for the future. She then said that 87 Mounds View EDA November 13, 2006 Regular Meeting Page 3 since there was a dump site close by she would not be willing to take ownership without the 88 environmental review. 89 90 Commissioner Flaherty indicated that the previous report shows that this was basically a clean 91 site and nothing has happened there since that would cause contamination. 92 93 Commissioner Thomas said that the previous review was preliminary and she feels that the City 94 would not be doing its due diligence if the review is not done prior to the City accepting the 95 property. 96 97 President Marty said that he is concerned because a citizen raised the concern to him about the 98 property being a dump site. He further said that he thinks the environmental assessment is 99 necessary to ensure that the City receives a clean site and does not incur the liability for a 100 contaminated site. 101 102 President Marty indicated he thinks that $3,700 is a small amount to pay to ensure that the 103 property is a clean site. He then said that the EDA talked about this property and he wonders 104 why copies were sent to Bonestroo when the City knew this was a possible problem area because 105 the City can order this done without paying Bonestroo to review it and order it done. He further 106 asked why it is necessary to have this engineering firm look at the documentation. 107 108 Director Ericson indicated that the City Staff does not have the training or experience to analyze 109 and determine what contamination may or may not be on the property in order to make a 110 recommendation to the Council. He then said that the review was a minimal cost to pay for the 111 expertise that they provided for the City. 112 113 City Administrator Ulrich indicated that he feels that it is important to enter the chain of title of 114 the property with a guarantee that there is no contamination on the site. 115 116 MOTION/SECOND: Gunn/Thomas. To Waive the Reading and Approve Resolution 06-EDA-117 225, Authorizing Supplemental Field Review and Analysis to Assess Environmental Conditions 118 at 2696 County Road 10 Preparatory to Acceptance of Land Donation. 119 120 Vice President Stigney said that his issue is that this property should not be accepted at all 121 because it costs money to determine if there is contamination and he does not think that the City 122 should take the property off the tax roles and the City does not need this property for the trail to 123 go through. He further said that he thinks this is a waste of taxpayer dollars. 124 125 Commissioner Flaherty said that the recommendation is that there is a low risk of contamination 126 at the property but he thinks that the City will end up doing this again in the future if the City 127 takes the property. 128 129 Mounds View EDA November 13, 2006 Regular Meeting Page 4 Commissioner Gunn asked how developable the property is. She then said she does not think 130 that it is, as most of it is wetland. 131 132 Director Ericson indicated that there are significant development impediments due to the 133 wetlands on the site and the soils may not be suitable in the upland portion of the property. He 134 then said that it is his belief that the property owners may let this revert back to the State for 135 unpaid taxes but this way they get a benefit by giving it to the City. 136 137 President Marty indicated that Council has decided that they would not be going ahead with 138 developing an overlook until the trailways on both sides of Highway 10 are done so it may never 139 be done. But, to ensure that the City is not accepting a liability on a property that may cost the 140 City money in cleanup later, he feels it would be prudent to spend the $3,700 to make the 141 determination beforehand. 142 143 Ayes – 3 Nays – 2(Stigney/Flaherty) Motion carried. 144 145 8.
