7. CONSENT AGENDA
A. Set a Public Hearing for Monday, September 24, 2001, at 7:05 p.m. to
Consider the Sale of 2625 County Highway 10 to the Mounds View Animal
Hospital.
City Attorney Riggs indicated that Minnesota Statutes Section 469.105 requires that the EDA
hold a public hearing before selling the property.
MOTION/SECOND: Marty/Stigney. To Approve the Consent Agenda as Presented.
Ayes – 4 Nays – 0 Motion carried.

Item Title/Subject: Public Hearing and Discussion Regarding Proposed
Sale of 2625 County Highway 10 to the Mounds View
Animal Hospital
Date of Report: September 20, 2001
Background:
On May 7, 2001, the City Council provided staff with direction to accept a purchase offer
for the property located at 2625 County Highway 10. The offer was submitted by the
Mounds View Animal Hospital, who intends to construct a new freestanding facility on the
site. They have received City approvals for the development; the last step is the public
hearing for the sale of land which is required by Minnesota Statutes. The accepted offer
for the property was $50,000.
Discussion:
On September 10, 2001, the Economic Development Authority (EDA) set a public
hearing for the proposed sale on September 24, 2001. A public hearing notice was then
sent to the Focus News to be published in their Sept. 13th edition. On Friday, September
14th, I received an apologetic voice-mail message from the Focus staff indicating that the
page with the legal notices was for whatever reason omitted from the printing. Thus, we
are not able to hold a public hearing on September 24 due to an insufficient notice.
The Focus has republished the notice originally intended for the Sept. 13th edition in its
September 20th edition. (Staff verified its inclusion.) To satisfy the public hearing
notification requirements in Minnesota Statutes, the public hearing will need to be
continued to October 1, 2001, at which time the EDA will call to order for a special
meeting. The applicants are aware of this change in schedule.
Recommendation:
Open the public hearing originally set for 7:05, Monday, September 24, 2001, and
immediately continue the hearing to 6:00 pm, Monday, October 1, 2001.
