ADJOURNMENT Item No: 8A Meeting Date: October 1, 2001 Type of Business: PH & EDAB WK: Work Session; PH: Public Hearing; CA: Consent Agenda; CB: Council Business City of Mounds View Staff Report To: Economic Development Authority From: James Ericson, Community Development Director Item Title/Subject: Discussion and Consideration of EDA Resolution 01- EDA-152, a Resolution Authorizing the Sale of EDA- Owned Land Located at 2625 County Highway 10 to the Mounds View Animal Hospital Date of Report: September 26, 2001 Background: On May 7, 2001, the City Council provided staff with direction to accept a purchase offer for the property located at 2625 County Highway 10. The offer was submitted by the Mounds View Animal Hospital, who intends to construct a new freestanding facility on the site. They have received City approvals for the development; the last step is the public hearing for the sale of land which is required by Minnesota Statutes. The accepted offer for the property was $50,000. Staff had originally set a public hearing date for September 24, 2001, but due to a publication problem, the notice was not published and as a result the public hearing was renoticed for October 1, 2001. Discussion: Chapter 469 of Minnesota Statutes requires that the EDA hold a public hearing prior to the sale of any land it owns. This public hearing satisfies the Minnesota statutory requirements. The purchase Agreement that the City entered with the Mounds View Animal Hospital was contingent upon obtaining City development approvals for the site. With the approval of the Rezoning, Code revision, Conditional Use Permit and the Development Review, this contingency has been satisfied. The last requirement is the public hearing to consider the sale to the proposed purchaser, Mounds View Animal Hospital. Consistency with Comprehensive Plan: City staff and the Mounds View Planning Commission feel that the proposed sale would be consistent with the City’s Comprehensive Plan and the proposed development would be consistent with and appropriate for the existing neighborhood. The property has a future land use designation of Community Commercial, and the proposed use is consistent with that designation. The definition of Community Commercial, as indicated in the Comprehensive Plan, is as follows: “Land use principally engaged in the provision of goods or services with a primary EDA Report Sale of 2625 County Highway 10 October 1, 2001 Page 2 service to the community. Community commercial uses would typically be located in a small commercial/retail center. Examples would include community shopping center, retail, service oriented businesses, funeral homes, banks, savings and loans, restaurants and/or bars, veterinary clinics, and day care centers.” Consistency with the Zoning Code: On July 9, 2001, the City Council approved Ordinance 684 which rezoned the property B-2, Limited Business, from the Medium Density R-3 designation. As the classification indicates, the B-2 designation is a more restrictive business district in which lower or less intensive commercial and retail uses are allowed. The less intensive business zoning was appropriate in this situation given the close proximity of the single family housing. The proposed use would serve the community and would not typically cater to the pass-through traffic present on County Highway 10. Consistency with Other Requirements: As indicated earlier in this report, the applicants have secured approval of a conditional use permit (Resolution 5599, adopted August 27, 2001) and a development review (Resolution 5604, also adopted on August 27.) Attached you will find a draft of the Purchase and Redevelopment Agreement. Staff is working with the City Attorney to finalize the details of the agreement. Recommendation: Approve Resolution 01-EDA-152, a Resolution Authorizing the Sale of EDA-Owned Land Located at 2625 County Highway 10 to the Mounds View Animal Hospital in the amount of $50,000. _____________________________________ James Ericson Community Development Director 763-717-4021 Attachments: 1. Resolution 01-EDA-152 C:\WINNT\Profiles\Jime\Favorites\City Council Stuff\Land Sale Report - Oct 1, 2001.doc RESOLUTION NO. 01-EDA-152 MOUNDS VIEW ECONOMIC DEVELOPMENT AUTHORITY COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION AUTHORIZING THE SALE AND REDEVELOPMENT OF EDA-OWNED LAND LOCATED AT 2625 COUNTY HIGHWAY 10 TO THE MOUNDS VIEW ANIMAL HOSPITAL FOR $50,000 It is hereby resolved by the Board of Commissioners (the “Board”) of the Mounds View Economic Development Authority (the “Authority”) as follows: WHEREAS, the EDA acquired real property located at 2625 County Highway 10 (the “Property”) in 1995; and, WHEREAS, the EDA, after demolishing the existing building and restoring the Property, marketed the Property for commercial redevelopment; and, WHEREAS, On May 2, 2001, the EDA received a purchase offer from the Mounds View Animal Hospital with certain contingencies; and, WHEREAS, the Purchaser intends to construct upon the property a 5,086 square foot, single-story veterinary clinic and animal boarding facility; and, WHEREAS, the EDA, on May 7, 2001 provided staff with direction to accept the purchase offer from the Mounds View Animal Hospital (the “Purchaser”) for the property in the amount of $50,000; and, WHEREAS, the EDA, on October 1, 2001, held a public hearing regarding conveyance of the Property to the Purchaser at which time all interested persons were given an opportunity to be heard. NOW THEREFORE BE IT RESOLVED, that the Mounds View Economic Development Authority, finding that the proposed development would be consistent with the City’s Comprehensive Plan and Zoning Code, and finding that the proposed development would be a low intensity use with little impact to the neighborhood, hereby approves the sale of the Property to the Purchaser in the amount of $50,000, less submitted earnest money. Resolution 01-EDA-152 Page 2 NOW THEREFORE BE IT FURTHER RESOLVED, that the Mounds View Economic Development Authority hereby authorizes its President and Executive Director to execute a Purchase and Redevelopment Agreement which articulates the conditions and requirements of this sale.
