Discussion:
The City Council had requested a meeting with representatives of the School
District and Ramsey County to discuss issues associated with pedestrian
crossing of County Road H.
Recommendation:
Staff is looking for direction from the City Council, the School District, and
Ramsey County pertaining to this matter.

Item Title/Subject: Employee Contribution From Sick Leave For Health Facility
Membership
Section 3.20 of the City Personnel Manual states the following:
D. HEALTH CLUB MEMBERSHIP
Employees are reimbursed for a health club membership in exchange for
accrued Sick Leave. An hour of Sick Leave is valued at the employee’s current
rate of pay. Employees can participate if a minimum balance of 80 hours sick
leave is maintained. The maximum monthly contribution amount is $40 per
month. Balance and contribution amounts are pro-rated for part-time employees.
Presumably, health and wellness programs such as this one produce benefits to the
City, in that employees (in theory) become more physically fit and mentally alert with
decreases in lost time due to illness. At the time the $40 monthly reimbursement
amount was enacted, it more than covered a single membership. Rates have
increased substantially over the years, yet the monthly reimbursement has not changed
since the program's inception nearly a decade ago.
Staff called three health clubs and requested monthly rates for a single membership.
They are as follows:
• YMCA $49
• Lifetime $48
• Northwest $68
The average rate for the three clubs is $55.
Staff’s recommendation is to increase the maximum monthly reimbursement to $55,
which would be sufficient to cover two of the rates for a single membership and partial
for the third.
For those who belong to the Y or Lifetime on a "single" membership, their
reimbursement would be limited to their monthly rate, which is currently $49 and $48
respectively. Thus, while $55 would be the maximum, the true budgetary impact would
be less (unless of course EVERYONE has a family membership or belongs to
Northwest.). Currently, approximately eight employees participate in the reimbursement
program.

the department functions and has made recommendations for changes where necessary. Changes
to the fee schedule are either underlined (additions) or stricken (deletions). If you are using a hard
copy to review the proposed changes you may want to look for the vertical lines in the margin, which
indicate changes to the text.
Recommendation: Please review the enclosed proposed 2004 Fee Schedule and advise staff of

A. VALUATION TABLE
The following Valuation Table shall be used to determine fees for those permits indicated
below and in all cases where the work is of such a nature that the permit fees cannot be
determined from the schedule established below for such work. The minimum fee for
all permits shall be $23.50 unless otherwise specified.

Please convey that applicants are responsible for all costs incurred associated with the filing, review and
processing of development applications. Such fees are to be paid in escrow up front or upon receipt of
statement from the City of Mounds View. Fees may include but are not limited to costs for consultants
retained by the City, consultant planning services, attorney, and engineer fees. A deposit may also be
required to cover costs of public notices, materials and staff time spent in the review, research or preparation
of materials associated with this application. The applicant shall be responsible for all reasonable incurred
costs in excess of the initial deposit amount. Any portion of the deposit not spent or encumbered shall be
refunded to the applicant within 30 days after consideration of the application is completed. Payment of park
dedication fees is required with subdivision applications.

Item Title/Subject: 2004 Trailway / Sidewalk Implementation Plan
Background:
The City’s Pathway Plan was discussed at the February 3, 2003 City Council
Work Session. In addition to the pathway along County Road H from Edgewood
Drive to the west City limits, the City Council identified four pathway segments
they would consider to be a priority. These were:
• Along the north side of County Road H2 - from County Road 10 to
Program Avenue.
• Along the east side of Edgewood Drive - from County Road H2 to
Edgewood Middle School.
• Along the north side of County Road 10 - adjacent to the wetland area
located just southeast of Walgreen’s store.
• Along the south side of County Road 10 – from Woodale Drive to the
south, connecting into the existing trail.
The two segments along County Road 10 were completed in the fall of 2003 as a
change order to the County Road H2 Project.
Discussion:
Staff would like to discuss the first two segments with the City Council. Staff has
investigated both sites. The Edgewood Drive Street segment consists of a right-
of-way width of sixty feet (60’) with Edgewood Drive being forty-six feet (46’) wide
measured from back-of-curb to back-of-curb. This leaves only seven feet (7’) of
boulevard on each side. Given these conditions, along with the current
obstructions, installing a sidewalk and allowing for adequate snow storage would
be extremely problematic for both the City and the adjacent residents without
acquisition of additional right-of-way or easements.
The County Road H2 segment is somewhat more accommodating for a sidewalk
or pathway. The northerly boulevard is twenty-three feet (23’) in width at Jackson
Drive and to the east. West of Jackson Drive the boulevards tapers down to
seventeen feet (17’) in width.
Due to the lack of available right-of-way along Edgewood drive, Staff is
recommending that the City install pedestrian walkways along this segment at
the time the street is scheduled for major maintenance. This would allow for the
option of changing one or both curblines to accommodate a pathway. This would
provide the best long-term solution for the City and the people who use and live
along these street segments.
Staff is looking for direction and reconfirmation from City Council as to if they
would like to proceed with a pedestrian corridor along County Road H2 east of
County Road 10.
In lieu of constructing the segment on Edgewood Drive, Staff is presenting the
option of pursuing the construction of a pathway along Silver Lake Road from
County Road H to County Road 10. The County has scheduled a mill and overlay
for this segment of Silver Lake Road in 2004. Although the County project will not
involve or disturb the boulevard areas, it still would be advantageous to
coordinate a new sidewalk/pathway with the repaving of the street.
2003 Street Improvement Project Sidewalks
There are three additional sidewalk/pathway segments located within the area
proposed for the 2003 Street Improvement Project Area. These are:
• Groveland Road – from County Road I to County Road 10
• Knollwood Drive – from County Road H to County Road H2
• Woodcrest Drive – from Knollwood Drive to Silver Lake Road
Staff would like direction from the City Council on these potential segments. They
are included in the City’s Comprehensive Plan. If the City Council wishes to
construct these segments, it would be advantageous to do so as part of the
adjacent street project.
County Road H Sidewalk Project.
As a note, a bid date of January 8, 2004 was established for the County Road H
Sidewalk Project. The City will be receiving bids for two segments: From Silver
Lake Road to the West City Limits and from Silver Lake Road to Knollwood
Drive. These were set up as two completely separate bids. The City Council will
have the option of awarding the contract for either bid or rejecting the bids and
not awarding a contract.
Information pertaining to the County Road H sidewalk status was included in the
January/February issue of the Mounds View Matters. Staff anticipates presenting
this to the City Council for action on January 26, 2004.
Recommendation:
Staff is looking for direction from the City Council pertaining to this matter.
Specifically, Staff is looking for Council input as to what trailways or sidewalks
they would like to construct in 2004.

and Discuss Potential Code Amendments
Background:
On February 26, 2001, the City Council approved Resolution 5527, a resolution authorizing
the development of a small commercial parcel at the southwest corner of County Road I and
Greenfield Avenue. The original approval allowed for a two-level office building with a 2,004
square foot foundation at 2402 County Road I. While modifications and amendments were
requested and approved for the development, what was ultimately constructed was a two-
level office building with a 2,004 square foot foundation as originally intended.
Discussion
One of the original conditions of the approval was that the garbage was to be stored inside
the building. This was not a condition that the Commission or the Council necessarily
desired, the property owner at the time—Tony Mezzenga—indicated that it was his
preference to keep the garbage inside. Given the limited greenspace on the site, the
Commission and Council agreed and added the condition to the resolution.
After the building was constructed, the property was sold to Mr. Stephen Farrell. Mr. Farrell
had been unaware of the garbage provision even though it was clearly called out in the
original resolution of approval. Mr. Farrell indicated that even if he wanted to keep the
garbage inside, he could not as there was not sufficient room or space to do so. Mr. Farrell
petitioned the City Council to have the condition removed and on July 14, 2003, the Council
unanimously approved a motion to uphold the condition.
Following the Council action, correspondence took place between this office and Mr. Farrell
regarding the garbage issue and after repeated requests for compliance, a Ramsey County
Court Citation was issued in Mr. Farrell’s name. The matter was before the Court on
November 18, 2003 and the charge was dismissed so long as there was no reoccurrence of
the violation. Two weeks later staff notified the prosecuting attorney Tom Hughes that the
garbage cans remained outside in violation of the court order and Res. 5527. It was at this
point staff was advised that the City could not seek resolution through a criminal procedure,
as the City Code does not prohibit garbage cans outside. Furthermore, the attorney advised
that our Code did not have any language that would identify a violation of a development
review resolution as a misdemeanor and, additionally, any violations of development
agreements entered into by the City could neither be pursued criminally.

Staff consulted with City Attorney Scott Riggs who concurred with Mr. Hughes interpretation
of the City Code deficiency relating to development review and development agreement
conditions. While the matter could be pursued through a civil process, both Mr. Hughes and
Mr. Riggs questioned the economics of doing so. They suggest that Chapter 1006 of the
City Code be amended to eliminate this loophole and Mr. Hughes has offered to provide the
necessary language to do so. Such a code amendment could not, however, be applied
retroactively in this situation; thus the “no outside garbage” condition becomes
unenforceable.
Recommendation:
Staff recommends that the Council authorize staff to draft and present an ordinance
amending Chapter 1006 adding language to ensure that development review conditions are
enforceable via the criminal process similar to conditional use permits and variances. Staff
also recommends that the Council approve an amendment to Resolution 5527 removing the
condition relating to outside storage of garbage on the property.

RESOLUTION APPROVING A DEVELOPMENT REVIEW REQUEST FOR AN
OFFICE BUILDING LOCATED AT 7664 GREENFIELD AVENUE;
PLANNING CASE NO. DE00-002.
WHEREAS, Tony Mezzenga, representing property owner Earnest Gustafson, has applied
for a development review to construct a 2,006 square-foot office building at 7664 Greenfield
Avenue; and,
WHEREAS, the subject property is zoned B-3, Highway Business, is designated as a
“Neighborhood Commercial” use on the Comprehensive Plan and is legally described as follows:
Lot 30, Block 3, Greenfield Plat 2, Subject to Road Easement
Ramsey County, State of Minnesota
WHEREAS, according to Section 1006.06 of the Mounds View Municipal Code, any new
construction or expansion of existing facilities requires the approval of a development review; and,
WHEREAS, according to Section 1114.02 of the Mounds View Zoning Code, commercial
offices are a permitted use with the B-3 zoning district; and,
WHEREAS, the City Council has reviewed the following documents regarding this
proposal:

WHEREAS, the proposed development satisfies the requirements of Zoning Code as
well as the variance approved on September 13, 2000; and,
WHEREAS, the site plans date-stamped 2/2/01 indicate that the proposed office building
will be 34 feet by 59 with a footprint of 2,006 square feet; and,
WHEREAS, the number of parking stalls provided (14 regular, 1 handicapped, 15 total)
satisfies the requirements of the Americans With Disabilities Act and the requirements in the
variance approved September 13, 2000; and,
WHEREAS, on January 17, 2001, the Planning Commission adopted Resolution 646-01,
recommending approval of this development review request.
NOW THEREFORE BE IT RESOLVED that the Mounds View City Council, finding
that all requirements have been met, does hereby approve the development review request for the
construction of a 2,006 square foot, two-level office building with a maximum 3,000 square feet
of leaseable office space at 7664 Greenfield Avenue, subject to the following stipulations:
1. Barrier curbing (B 6-12) shall be installed around the perimeter of the parking lot and
access drive. At points where stormwater will collect, cuts shall be made to allow water
to pass through into pervious areas.
2. All utilities to the building shall be installed underground.
3. One monument sign shall be allowed not to exceed eight (8) feet in height or one hundred
(100) square feet in area. The base of such sign shall be constructed of masonry or stone
materials to match the building. A pole or pylon type sign is prohibited. No more than
60 square feet of combined building mounted signage shall be allowed.
4. The masonry or stone building siding and any other architectural design characteristics
shall be consistent along the north and east building elevations.
5. There shall be no outside garbage storage or dumpster allowed on this site, all garbage
and refuse shall be stored within the building.
6. There shall be no parking lot lighting other than supplemental flood lights mounted upon
the building. Such lights shall be down cast and shielded or hooded to eliminate glare or
light spillage onto adjoining properties in accordance with Chapter 1103 of the Mounds
View Zoning Code.
7. The applicant shall revise the site plan to show fencing and landscaping plantings as
indicated on Exhibit A. No building permits shall be issued until such revised site plan
has been received and approved by the Director of Community Development.
8. If construction has not begun on this project within one year, this approval shall be
considered null and void.

1006.06: DEVELOPMENT CONTROLS:
Subd. 1. Purpose: It is the intent and purpose of this Section to provide for orderly development of
land to safeguard life, health, safety, property and public welfare by regulating and controlling
all development within the City. This Section shall be in addition to the requirements of any
other provisions of the Municipal Code regulating such development.
Subd. 2. Application of Development Controls: All new construction and expansions of existing
construction shall be reviewed by the Planning and Zoning Commission and approved by the
City Council as conforming to this Section, except as follows: (Ord. 692, 3-25-02)
a. Single or two (2)-family dwelling units; (Ord. 692, 3-25-02)
b. Accessory structures that meet the requirements of the applicable zoning district; (Ord. 692,
3-25-02)
c. Construction activity that increases the gross square footage of the principal building by less
than ten percent (10%) provided the area of expansion does not exceed ten thousand (10,000)
square feet. (Ord. 692, 3-25-02)
Subd. 3. Development Plan:
a. The owner or developer shall submit for review a development plan which sets forth plans
for utility service, surface water drainage consistent with the Local Water Management Plan
dated February 12, 1990, subject to subsequent revisions, erosion and sediment control
consistent with the Ramsey County Erosion and Sediment Control Handbook (1989) prepared
by the Ramsey County Soil and Water Conservation District and subsequent revisions thereto,
streets, parking, landscaping, screening and buffering, lighting, setbacks, exterior construction
design and materials, trash disposal, construction timetable and such other matters as the
Council may require.
b. The owner or developer shall submit with the development plan an abstract of title,
registered property report or such supporting affidavits or documents that establish ownership
or any other parties of interest in the property involved.
Subd. 4. Development Contract:
a. A development contract which sets forth all of the terms, conditions, requirements,
agreements, guarantees and plans for the orderly development of said land shall be entered into
between the developer and the Municipality prior to the final approval of any subdivision, or
project that qualifies for a Development Review, as determined by subdivision 2 of this
Section. This requirement may be waived by the City Council in the event no public
improvements are planned or proposed. (Ord. 692, 3-25-02)
b. Before execution of the development contract, the owner or developer shall submit
certification from Ramsey County Department of Taxation that all taxes and special
assessments due on the property involved have been paid in full.
c. Said development contract shall include provisions for supervision of details of construction
by the City and grant to the City authority to inspect all work performed pursuant to said
