PLEDGE OF ALLEGIANCE ROLL CALL MEMBERS PRESENT: Mayor Linke, Councilmembers Wuori, Blanchard, and Quick 4111 MEMBERS ABSENT: None ALSO PRESENT: Samantha Orduno, City Administrator; Cathy Bennett, Economic Development Coordinator ADDITIONS TO AGENDA: Mayor Linke was asked by staff to pull Item 11D off of the agenda. APPROVAL OF MINUTES MOTION/SECOND: Quick/Wuori to Adopt June 27, 1994 Regular Council Meeting Minutes VOTE: 4 ayes 0 nays Motion Carried Councilmember Trude joined the meeting at 7 : 04 p.m. ACCEPTANCE OF ADVISORY COMMISSION MINUTES: There were no Advisory Commission Minutes to approve. SPECIAL ORDER OF BUSINESS There was no Special Order of Business scheduled for this meeting. • View City Council Page Two • Mounds Regular Meeting July 11, 1994 CONSENT AGENDA Samantha Orduno, City Administrator, read the Consent Agenda Mayor Linke asked if there were any items the Council desired removed from the Consent Agenda. There were no items removed. MOTION/SECOND: Blanchard/Quick to Adopt the Consent Agenda As Presented VOTE: 5 ayes 0 nays Motion Carried RESIDENTS REQUESTS AND COMMENTS FROM THE FLOOR There were no resident requests or comments brought forth at this meeting. PUBLIC HEARINGS: There were no public hearings scheduled for this meeting. 4111 COUNCIL BUSINESS: There were no Consent Agenda items brought forward. A. Introduction of Ordinance No. 544 Accepting Changes to EDA By Laws Cathy Bennett, Economic Development Coordinator, explained that a discussion took place at the July 6, 1994 Work Session regarding Economic Development Authority (EDA) meetings and work sessions. Bennett reported that it is proposed to amend the EDA By Laws and establish regular scheduled meetings. Proposed Ordinance No. 544 establishes that the EDA Board shall meet on the 2nd Monday of each monthimmediatelyfollowing the _regular scheduled Council meetings and that the Board shall discuss EDA business in conjunction with the regular City Council work session which is scheduled for the 1st Monday of each month at 7 : 00 p.m. Mayor Linke clarified that the EDA By Laws previously called for EDA meetings as needed and now the meetings will follow a regular schedule. MOTION/SECOND: Wuori/Trude to Waive the Reading and Approve the Formal Introduction of Ordinance No. 544 Amending the Economic Development Authority By Laws, ARticle IV. , Section 4.2, Entitled, "Regular Meetings" 0 VOTE: 5 ayes 0 nays Motion Carried Mounds View City Council Page Three 4111 Regular Meeting July 11, 1994 B. Consideration of Introduction of Ordinance No. 546 Amending Municipal Code of Mounds View by Amending Chapter 408 Entitled, "Economic Development Commission" Cathy Bennett, Economic Development Coordinator, explained that an amendment needed to be made to Chapter 408 of the Mounds View Municipal Code entitled, "Economic Development Commission" for term expiration dates for the first EDC members. This would allow the terms of the commission members to be staggered. MOTION/SECOND: Wuori/Trude to Waive the Reading and Approve Formal Introduction of Ordinance No. 546 Amending the Mounds View Municipal Code Chapter 408, Entitled "Economic Development Commission" VOTE: 5 ayes 0 nays Motion Carried C. Consideration of Adoption of Ordinance No. 543 Amending the Municipal Code of Mounds View By Amending Appendix A Entitled, "Specific Rezonings" Samantha Orduno, City Administrator, announced that this ordinance would require a roll call vote. IIII Orduno reported that at the June 27, 1994 Council Meeting, Prime Builders was given approval for a 22 unit condominium project at 2856 Highway 10. Orduno further explained that as part of that application, Prime Builders requested a rezoning of the property from R-4, High Density Residential, to PUD, Planned Unit Development. Orduno stated that the rezoning would allow the zoning to more closely match the use of the propoerty as a condominium development. MOTION/SECOND: Blanchard/Wuori to Waive the Reading and Adopt Ordinance No. 543 Amending the Municipal Code of Mounds View by Amending Appendix A Entitled, "Specific Rezonings" ROLL CALL VOTE: Linke - yes Blanchard - yes Quick - yes Trude - yes Wuori - yes VOTE: 5 ayes 0 nays Motion Carried D. Consideration of Contract with SEH for Storm Water Management Permitting Policy_ Samantha Orduno, City Administrator, reported that Rocky Keene, SEH, presented a schedule for assuming the permitting authority of surface water issues to Council at their July 6, 1994 Work Session. Orduno stated that the presentation included the necessary steps to be taken to accomplish this policy accompanied by a fee schedule for performing those tasks. Orduno explained that one of the tasks to be performed is to ensure that the current plan is in compliance with all laws and regulations of the Wetland Conservation Act. Councilmember Trude stated that at the Work Session it was discussed to have the City bring the ordinances up to date and she didn't realize that this meant that the City would rush into the permitting process. Councilmember Trude raised some concerns regarding this issue, i.e. , does the City have adequate staff to complete the process and also the fact the the City has no engineer. Trude stated that this would require that the City have the consulting engineer involved with each permit when the Rice Creek Watershed District has an engineer which would be covered by the Rice Creek Watershed taxing district. • Mayor Linke stated that the City's wetland ordinance is more strict than that of Rice Creek Watershed District. Mayor Linke stated taht now the resident or developer has to go through the same process twice, once with the City and once with Rice Creek Watershed District. Councilmember Trude asked if the City requires soil borings. Mayor Linke responded that the soil borings are done by the developer and all data is provided to the City's consultant. Mayor Linke stated that he is not aware of any case where a resident has - -had--to- do-soil---borings-. - The contractor normally- would--do--the-soil--- boring because the contractor would have to find out what the footings are being put on. Councilmember Trude questioned if this would add additional stress to the staff by having them do processes that they don't do now. Trude stated she was concerned if staff could adequately handle this permitting policy. Trude stated that she understood the City was talking about SEH bringing ordinances up to date, but didn't know that the City was taking over permitting. Trude also expressed concern that there was an environmental issue conflict with development goals. Trude stated that the City would not be as objective as Rice Creek Watershed District. Trude stated that she 1111 would like more public input. Trude also stated that the City could deny a permit in a wetland and the City would end up defending themself in court. Mounds View City Council Page Five 1111 Regular Meeting July 11, 1994 Mayor Linke stated that if the developer passed our wetland ordinance, they would pass Rice Creek Watershed's. Linke stated that the City's is stricter. Mounds View's Wetland Ordinance is the strictest in the metro area and Linke stated that he believed, in the state. Councilmember Trude stated that if the City were to deny a permit, then there could be a lawsuit. Mayor Linke stated that the City has denied permits and that the developer then reconfigured the work and it met the code. Councilmember Trude asked what the driving force was behind the City rushing into the permitting. Mayor Linke indicated that this permitting policy has been talked about for the past three years. Councilmember Trude stated that the last work session was the first time that she had heard about it. Councilmember Wuori explained that the recommendation by staff is to 1111 approve a contract with SEH to proceed with developing a permitting policy. Wuori stated that there would be time to hold a public hearing to get public input. Wuori noted that there wouldn't be any type of policy to adopt before this Fall. Step Councilmember Trude suggested the ordinance amendments be made and then the City should look at making a decision regarding the permitting process. Trude stated that there are a lot of people watching this issue very carefully in the City. Samantha Orduno, City Administrator, stated that at the meeting Rocky Keene, SEH, stated that Tasks 1 through 3 could be completed and if, at that time, the City wanted to go on to the Final Permit Forms and Information Package for a cost of $3 , 000 they could. Councilmember Trude asked that at what point did staff discuss this permitting policy to come up with the recommendation at a cost of $8, 000. Orduno responded that the permitting policy was totally discussed at meeting. Councilmember Trude asked again at what point did staff come up with the cost of $8, 300 if the subject was only discussed at the Council work session. 1111 Orduno stated that the Council talked about the $300 and also what the total cost would be. Rocky Keene stated that the last $3 , 000 Mounds View City Council Page Six • Regular Meeting July 11, 1994 would be a cost if Council chose to move on to the Permitting Forms and Information Package. Mayor Linke explained that the contract allows the City to do this. The contract would encompass everything and the costs would not be piece meal. MOTION/SECOND: Quick/Wuori to Approve Contract to SEH to Proceed with Developing a Permitting Policy for the City of Mounds View for the Sum of $8, 000 to be Funded from the Surface Water Management Fund, Account No. 420-4121-303 VOTE: 4 ayes 1 nay Motion Carried REPORTS 1. Report of Councilmembers: Councilmember Quick - No report Councilmember Blanchard - No report 4111 Councilmember Wuori: Mounds View Community Theater is presenting Oliver. Wuori stated that she has attended parts of different rehersals and it is wonderful to see that many children on stage singing and dancing in unison. Wuori announced the times and dates for the performances and added that tickets can be purchased at City Hall, charged and tickets then can be mailed out or purchased on a will call basis. Wuori commented that this is a great family play. Councilmember Trude asked what the status was regarding the - - - - status-of the-streetlight _on-CountyRoadJ._ _ Orduno noted that Tim Cruikshank is scheduling a meeting for next week. Orduno also noted that MnDot, Ramsey County and Anoka County have been very cooperative regarding this streetlight issue. Orduno also mentioned that the sign entering Mounds View would be taken care of in about three months. Councilmember Trude commented that this would improve safety in that neighborhood. Trude also mentioned discussions regarding the noise wall and changes that perhaps would be 1111 made. Mounds View City Council • Page Seven Regular Meeting July 11, 1994 Orduno commented that the walls come in sections and discussions have taken place regarding removing a section or perhaps curving a section of the wall. Councilmember Trude encouraged residents to stop completely at stop signs and to watch their speed limit. Trude stated that there is a community effort to keep these laws enforced due to to a rising number of complaints. Councilmember Trude also mentioned that she was glad to see the people who attended and gave input at the budget work session. Trude noted that a couple of those persons stayed until 1:00 a.m. Report of Administrator: Samantha Orduno reported that there will be public informational meeting on the Pleasantview Drive reconstruction regarding curbs, gutters and storm sewer. Mike Ulrich, Public Works Director did a large mailing on Pleasantview Drive to the homeowners. Report of Mayor Linke: 4111 a. The Festival In The Park is July 17. The parade will start at 1: 00 p.m., There will be 42 units in the parade with three of those being band units. In the City newsletter there was a list and time of the Festival activities. Mayor Linke encouraged everyone to participate in the Festival. b. On July 20 the Ramsey County League of Local Government will hold its annual picnic. There are still openings for Council to attend. The Parks and Recreation people are also being invited to attend. -Mayor -Linke—announced- the times anddatesof the upcomingCouncil meetings.
