The Ethics and Recognition Committee of the Minnesota City Management Associ- ation will review the new Charter to determine whether it meets the criteria promulgated by the International City Management Association for recognition as a council/manager or general management city. The Committee is in the process of being appointed and more than likely will not complete its work until some time in August. It is the request of the Association that the City of Mounds View inform candi- dates of the change in the Charter, of the change in the role of the Administrator, and of the review of criteria for recognition by the Minnesota City Management Association. We believe this will be helpful to both the city and the candidates in developing mutual expectations of each other concerning the job. The Minnesota City Management Association, in performing its role of reviewing the status of recognition, recognizes the right of municipalities to choose the form of government and in exercising its review is not advocating one form or another. Please let me know if you have any questions or if the Association may be of any help to the city. Sollenberger City Manager President, Minnesota City Management Association City Hall 4TH & LaFayette St. Winona, Minn. 55987 Dear Mr. Sollenberger: have been informed that a reviewal of the Home Rule Charter provision for our Clerk/Administrator position, will be conducted by a committee of the Minnesota City Management Association. I am requesting information that will enlighten me as to who requested, or on what basis, the forthcoming reviewal has been initiated. If the proposed reviewal was requested by an individual , or private parties, further communications between you and myself may prove beneficial to all concerned. However, if such reviewal is standard procedure, when a member' s unit of government changes in structure, then I further request a co-current opinion, in reference to our past "Clerk/Administrator" eligibility, under the former status of Statutory City Plan "A" . (Find enclosed, a copy of the ordinance for this position that was in effect under the former plan. ) Obviously, every Administrator employed by Plan "A" cities would be ineligible, if the precise status of "Manager Form" were required in determining eligibility for membership in your organization. Therefore, clarification of criteria used, by the Management Association, to determine eligibility for membership under Plan "A" , would become bene- ficial in deliberation of our new Charter provision for the office of Clerk/Administrator. To conclude, it is my considered opinion that a comparison ruling must be rendered, in the interest of credibility regarding the Minnesota s• Page 2 City Management Associations' past and present policies, as well as those of the City of Mounds View. Finally, I respectfully request the name, address and phone number of each person who will serve on the reviewal committee. If I may be of further assistance please feel free to contact me. Mulally Ramsey County District Court Second Judicial District Ramsey County Court House St. Paul, Minnesota 55102 . Dear Judge Mulally: In compliance with Minnesota Statute 410.05, we are submitting to you our Annual Report for 1980 as follows: Member Changes: Jean E. Miller, 2291 Hillview Road N.E., appointed January 8, 1980, to fill the vacancy of Curtis M. Schmidt who resigned due to health problems. The first meeting Miss Miller attended was March 6, 1980. ' James H. Wills resigned because of termination of residency in the City of Mounds View. To date, to the best of the Commission's knowledge, a new appoint- ment has not been made. Dates of Meetings: January 2, 1980 March 6, 1980 December 11, 1980 Business Synopsis: (1) In response to suggestions by the public, the Commission considered possible amendments to Section 5.08, Section 7. 05, Subd. 3, and Section 7.07 of the Mounds View Charter. (Refinement in language only.) The Commission felt changes were not necessary at this time, but presented the possible amend- ments to the Charter to the City Council for their review. The Council agreed with the Commission that the changes were not necessary. (2) Reviewed the section of the proposed Ordinance implementing the Home Rule Charter which deals with public improvements. A suggestion was made to the City Council concerning proposed Section 26.09 relative to "additional assess- ments within improvement area". The Honorable Edward D. Mulally -2- December 31, 1980 Business Synopsis: - (continued) (3) Reviewed an amendment to the Mounds View Charter suggested by some city council members and the clerk-administrator. This was to adopt Section 7.05, Long Term Financial Plan, by "Resolution" rather than by "Ordinance". The Commission by unanimous vote opposed the suggested change.
