HomeMy WebLinkAbout12-12-1984 MOUNDS VIEW CHARTER COMMISSION MINUTES December 12, 1984 I. Meeting called to order by Chairman Doty at 7:30 P.M. with recitation of the "Pledge Allegiance to the Flag". II. Roll Call Absent: Charlotte Forslund - Excused: ill Milan Illig The chairman noted that the name of Commission member Donald Hodges was omitted from the District Court's Order, File No. 430622, dated October 30, 1984, appointing members to the Charter Commission for a term of four years beginning November 1, 1984. Hodges stated he did indicate to the Chief Judge his willingness to serve another term. Chairman Doty said he would check the matter out with Judge Schultz as soon as possible. The following commission members were reappointed to serve a four year term beginning November 1, 1984 to November 1, 1988: Charlotte Forslund Russell A. Warren Milan Illig William Werner, Sr. Philip G. Johnson Ruth J. White Lowell D. Nygaard III. Approval of Minutes of December 14, 1983 Motion made by Judy Rowley, seconded by Don Hodges, to approve minutes of December 14, 1983, as presented. Motion passed with four abstentions., Abstained: Duane McCarty Lowell Nygaard Neil Loeding Ruth White IV. Old Business Chairman Doty stated that the Study Committee on Municipal Elections mentioned in Item V of the December 14, 1983, minutes did not meet; however, he presented to the commission for consideration a proposed amendment to Chapter 4, Nomin- ations and Elections, Sec. 4.01, of the city charter. Also, a proposed new Subdivision 7 under Section 4.05, Vacancy of Municipal Elected Office. IV. Old Business - (cont'd. ) page (2) Sec. 4.01 to be amended to indicate "A regular municipal election shall be held on the -first Tuesday after the first Monday in May of each even numbered year corrunencing in 1986 at such places as the city council shall designate," and, "Elected and qualified officers provided for by this charter shall assume the duties of office to which they were elected on the first business day in June following such election". Subdivision 7 to read: "Should a Council member seek the office of Mayor, and still have one (1) or more years to serve on their present term of office, that. Council member must resign from their present office in time to allow their council seat to be added to the general, or special election. Failure to resign prevents that Council member from running for the Mayor's office." Motion made by Jean Miller, seconded by Bill Werner, that the proposed amend- ment to Chapter. 4, Nominations and Elections, Sec. 4.01, be presented to the voters at the Special City Election to be held on March 12, 1985. Motion made by Neil Loeding to amend the language of the main motion to designate January 9, 1985, at 7:30 P.M. for a public hearing to consider change in the date and/or year, as to whether or not even or odd numbered, for the regular municipal election. Seconded by Bob Beutel. Motion carried. One opposed: Bill Werner. Motion made by Duane McCarty, seconded by Jean Miller, to include in the public hearing the proposed Charter Amendment to Section 4.05, which would be subse- quently titled Subdivision 7. Motion made by Russ Warren, seconded by Bob Beutel, to have a vote on the above "Question". Motion failed. Vote: 11 - no 2 - yes - - Warren Beutel Motion by Judy Rowley, seconded by Duane McCarty, to amend the main motion by substituting the following language for Subdivision 7: "Should a councilmember or mayor seek another elected office, and. still have one (1) or more years to serve on their present term of office, that person must resign from their present office in time to allow their council seat to be added to the General or Special Election. " Main motion, as amended, carried unanimously. Motion made by Duane McCarty, seconded by Russ Warren, that the chairman place a notice in the New Brighton Bulletin regarding the upcoming public hearing on January 9, 1985, and that the clerk-administrator put a notice in the upcoming City Newsletter.- Motion carried. (1) abstention: Bill Werner. V. New Business page (3) Bob Beutel presented, and read , a proposed resolution regarding appointments to the Mounds View Charter Commission. (copy attached) Motion made by Bob Beutel, seconded by Russ Warren, that the resolution be adopted by the Charter Commission as a functional rule. Motion made by Duane McCarty to table this resolution until the next regular meeting, with the request that the author clarify the application process of the resolution and bring into conformance with state law under Chapter 410.05, Subdivision 3. Seconded by Jean Miller. Motion failed by unanimous vote. After further discussion, the author amended his resolution as follows: "Resolution re: appointments WHEREAS the citizens of the City of Mounds View adopted the City Charter in order to make the government of the City of Mounds View more representative of its citizens and to permit and encourage more participation by the citizens in the governmental processes of the City of Mounds View; NOW, THEREFORE, BE IT RESOLVED: That at least three months prior to the expiration of any seat on the City of Mounds View Charter Commission, or upon the resignation, removal, or death of any commission member, the Chairman shall cause to be published in the Newsletter and the official newspaper of the City of Mounds View a notice of said expiration, the name of the in- cumbent member holding said seat, a summary of the application process, and the final date the Chief Judge will accept applications for appointment to said seat." The chairman called for a vote on the main motion regarding the Resolution. The motion carried unanimously to approve the Resolution as amended. VI. Election of Officers Motion made by Russ Warren, seconded by Duane McCarty, to the present officers for another 2 year term in office. The commission cast a unanimous vote for: Chairman: Bill Doty Vice-Chairman: Neil Loeding Secretary: Ruth White • VII. Annual Report page (4) In compliance with Minnesota Statute 410..05, motion made by Judy Rowley, seconded by Don Hodges, that the secretary submit the Commissions Annual Report to the District Court. VIII. Meeting Dates Motion made by Jean Miller, seconded by Phil Johnson, that meeting dates be scheduled for the second Wednesday of each quarter; such meetings to be called at the discretion of the Chairman. Carried unanimously. March 13, 1985 June 12, 1985 September 11, 1985 December 11, 1985 The Chairman called for a special meeting of the Charter Commission for January 9, 1985, at 7:30 P.M. to coincide with the Public Hearing concerning the proposed charter amendments. IX. Motion made to adjourn by Duane McCarty, seconded by Bill Werner. Carried unanimously. Time: 10:15 P.M. fes! Rut J. ,a'g'e, ecretary Attachment k MOUNDS VIEW CHARTER COMMISSION Resolution re : appointments WHEREAS the citizens of the City of Mounds View adopted the City Charter in order to make the government of the City of Mounds View more representative of its citizens and to permit and encourage more participation by the citizens in the governmental processes of the City of Mounds View ; AND WHEREAS appointments to seats on the Charter Commission are made in a non-representative and non-participative manner ; i . e . , by the Chief Judge of District Court without notice to the citizens and without request for advice ; AND WHEREAS the Charter Commission -has the means to remedy this departure from the spirit of the City Charter ; NOW, THEREFORE, BE IT RESOLVED : That at least six months prior to the expiration of any seat on the City of Mounds View Charter Commission , or upon the resignation , removal , or death of any commission member , the Chairman shall cause to be published in the Newsletter of the City of Mounds View and in the newspapers of general circulation in the City of Mounds View a notice of said expiration, the name of the incumbent member holding said seat, a summary of the application process , and the final date the Chief Judge will accept applications for appointment to said seat.
