1. Call to Order
The meeting was called to order by Chair Stevenson at 7:00 p.m. March 4, 2009.
2. Roll Call
Members Present: Chair Stevenson; Commissioners Cramblit, Miller and Rundle.
Absent and Excused: Commissioners Lang, Meehlhause and Walsh-Kaczmarek

3. Approval of Minutes
December 3, 2008
MOTION/SECOND: Commissioner Cramblit/Commissioner Miller. To approve the minutes of
the December 3, 2008 regular Planning Commission meeting as slightly amended.

A. Planning Case VR2009-001; Consideration of a Variance for Increased Wall
Signage for Kentucky Fried Chicken (KFC) located at 2213 County Road 10.
Community Development Director Roberts stated KFC located at 2213 County Road 10 has
applied for a variance for increased wall signage. KFC remodeled their restaurant in 2008, and
as part of this work, the contractor installed several new exterior signs. The contractor did not
get a permit from the City to install the new signs. City staff discovered the new signs after the
contractor had installed them and then the contractor applied to the City for a permit for all the
new signs. During the review of the sign permit application, the City determined that KFC had
too much signage on their building. There are a total of 193 square feet of signage on the
building and the ordinance allows for a maximum of 100 square feet.
Community Development Director Roberts explained the different signs and their square
footage. He stated the City has approved sign variances for several businesses including
Totino's, which the City approved in 2008. He stated for the city to approve a variance, the
applicant needs to demonstrate a hardship or practical difficulty associated with the property.
Director Roberts stated that it was not the fault of the applicant that the contractor did not apply
for a sign permit. This was because the owner's contractor failed to apply for the permit.
Chair Stevenson stated the commission would take into account the applicant applied for the
permit after the contractor had completed the work for the signs. He stressed that anyone that is
doing any work within the City should check the city codes. Chair Stevenson also stated this
property has enough merit and uniqueness for this amount of signage. He felt the existing signs
are not a detriment to Mounds View.
Commissioner Cramblit stated it is arrogant of a contractor to complete the work and then apply
for the permit. He indicated the expression panel signs on the building do look nice but asked if
they need to be there.
Commissioner Miller asked when the original building was built if there was a permit pulled for
signage. She wondered if there was this amount of signage on the original building.
Community Development Director Roberts stated he did not believe so but did not check and the
new additional signage is part of a corporate image.
Commissioner Rundle questioned why the contractor did not check with the City about sign
permits.
Community Development Director Roberts stated the corporate contractor did the remodeling
work and they did not check. He stated the applicant representative could talk about this issue.

Paul Atteberry, KFC representative, stated he had changed sign companies before this project
and assumed the new sign contractor obtained a permit. The sign contractor thought the general
contractor obtained the sign permit. He stated it was his fault and apologized for the mix up.
Chair Stevenson asked why this is the minimum amount of signage that should be on this
building.
Mr. Atteberry stated it is the wall graphics that are pushing the total signage amount over the
allowed maximum. He indicated this is the eighth remodeling of a KFC and Mounds View is
only the second city to consider the wall graphics as signs. There is no lighting on those signs
and the graphics do not have to stay on the building but they are an enhancement to the building.
Commissioner Cramblit stated the graphics are appealing and he did not understand why the City
considers them signs.
Community Development Director Roberts stated that the City Code considers any attention -
getting device a sign.
Commissioner Miller asked if there was glass behind the graphics.
Chair Stevenson stated the graphics are on a wall. He stated the options of tabling, denying or
approving the resolution.

Community Development Director Roberts stated if the commission felt they had enough
information they should act on the item tonight.
MOTIONlSECOND: Commissioner Cramblit/Commissioner Rundle. To approve Resolution
899-09, a resolution to approve a variance of 93 square feet, for a total of 193 square feet, of
exterior wall signage for Kentucky Fried Chicken (KFC), 2213 County Road 10; Planning Case
No. VR2009-001
Ayes —3 Nays — 1 Motion carried.
6. Other Planning Activity
A. Proposed Code Amendment — Conditional Use Permits (Dynamic Display
Signs)
Community Development Director Roberts stated after several meetings last fall staff is
recommending amending the code for conditional use permits for Dynamic Display Signs. Staff
is proposing to add one line to the current code. The addition would be that dynamic display
signs in certain locations need a conditional use permit and would be subject to the standards in
Chapter 1008.10, Subd, 9 of the City Code.

MOTION/SECOND: Commissioner Miller/Commissioner Cramblit. To approve Resolution
900-09, a resolution to approve an amendment to Chapter 1106 of the Mounds View City Code
about Condtional Use Permits for Dynamic Display Signs.

Motion carried.
There being no further business before the Planning Commission, Chair Stevenson adjourned the
meeting at 7:35 p.m.
