Call to Order Vice Chair Miller called the meeting to order at 7:00 p.m. October 3, 2007 ______________________________________________________________________________ 2. Approve Minutes A. September 5, 2007. MOTION/SECOND: Gunn/ Lang, to approve the minutes of the September 5, 2007 regular Planning Commission meetings as corrected. Ayes – 4 Nays – 0 Motion carried. Citizens Requests and Comments on Items Not on the Agenda None ______________________________________________________________________________ 5. Planning Cases A. AV2007-001: Consideration of an Administrative Variance for a Reduced Side Yard Setback at 5060 Red Oak Drive Planning Associate Heller reported the applicant, Mr. Rich Sonterre, is requesting a variance to enhance his home by constructing a 225 square foot, 15’x15’ three-season porch on the rear of his home located at 5060 Red Oak Drive. She stated the existing house, built in 1958, was placed on the lot with only an eight-foot side yard setback on the north side. She explained this porch would extend the north wall of the house towards the rear an additional 15 feet; however, the Mounds View Zoning Code requires a ten-foot side setback for living space. She stated the requested two foot variance would allow the property owner to expand upon his current non- conforming eight-foot side setback. Planning Associate Heller reported Staff reviewed the request and determined that it qualified for an administrative variance, as it is within 25 percent of setback requirements. She explained that Administrative Variances were added as an option to make the process faster and easier for residents when their request was not excessively beyond what the code allows. Planning Associate Heller stated Staff feels there is sufficient hardship to warrant a variance. She indicated that staff also considered any negative affects that the proposed addition might have on the surrounding area and found that the porch addition would not negatively impact the neighborhood. She reported the Community Development Director granted preliminary approval. She informed the Commission that the four adjacent property owners were notified of the variance request and that Staff had received no feedback from the adjacent property owners. Vice Chair Miller asked if the code had changed since it was built. Planning Associate Heller replied that Mounds View did not become a City until 1958 and therefore no codes existed when the applicant’s house was built. MOTION/SECOND: Gunn/Lang, to approve Resolution 874-07, a Resolution approving a Variance for an Eight-Foot Side Yard Setback at 5060 Red Oak Drive; Mounds View Planning Case AV2007-001. Other Planning Activities A. Comp Plan 2008 Update Planning Associate Heller explained that the Planning Commission would discuss the Future Land Use Map again as three of the Commissioners were absent from the September 19th meeting. She stated the Commissioners who were present felt that no decisions should be made without more of the Commissioners being involved in any changes. Planning Associate Heller explained that, since the last meeting, she put together maps outlining the specific parcels that should possibly have the land use designation changed. She presented the following examples: 1) Two of the manufactured home parks are currently designated as Single Family Attached (SFA) for the future land use, but maybe they should be changed to stay a manufactured home neighborhood in order for these areas to remain affordable housing and 2) There are also several redevelopment opportunities right now in the City, and the Planning Commission should look at the land use map in order to prepare for potential changes. Planning Associate Heller commented she and Community Development Director Ericson discussed changing some of the land uses to make them consistent such as single-family homes and townhomes. Vice Chair Miller commented the Townsedge Terrace manufactured town home park should go with the industrial area next to it. Planning Associate Heller replied this manufactured home park would be designated as light industrial should that use ever be changed in the future. Commissioner Gunn stated she would like it to remain light industrial. Planning Associate Heller commented the manufactured home parks are great affordable living areas. Consensus reached that Townsedge Terrace Manufactured Home Park would remain as light industrial and the other manufactured home parks would be changed from single family attached (SFA) to a manufactured home (MH) designation. Commissioner Cramblit commented on the Saturn and Premium Stop sites at the corner of Highway 10 and County Road H2. He questioned the plan for Highway 10 and what would be best for these sites. He commented this seems to be an opportunity to identify these properties correctly. Planning Associate Heller replied she would need to review the Highway 10 plan to see what had been envisioned for this corner. Mounds View Planning Commission October 3, 2007 Regular Meeting Page 4 Commissioner Gunn stated she believed this intersection is earmarked for restructuring. She indicated the Saturn lot might become smaller when the intersection is realigned. Planning Associate Heller commented the Saturn site should probably be designated as a Mixed Use PUD to keep it as a business park type use, such as what is currently in that area. Planning Associate Heller asked Director Ericson if the Highway 10 Plan shows realignment. Director Ericson replied the City Council went on record that they would not support the realignment at the expense of displacing residents or businesses. Consensus reached to change the Multi-tech vacant lot and the Saturn site to a Mixed-Use PUD designation. Director Ericson recommended notifying residents in the surrounding areas where the designation changed for their input. Director Ericson pointed out four single-family lots south of Robert’s that could be changed to a Mixed-Use PUD designation, as they could be included into the Premium Stop redevelopment area project. Consensus reached to re-designate these lots as Mixed-Use PUD. The Commissioners discussed the Tyson Company lots and whether to designate them all light or heavy industrial. Consensus reached to designate all four of the Tyson lots as Light Industrial. Consensus reached to designate the Skyline Motel’s three lots along Highway 8 as Light Industrial. Consensus reached to designate the theater site as Regional Commercial property and remove the PUD designation since the lots are now developed. Consensus reached to designate Moe’s parking lot property as Highway Commercial to match the restaurant lot. Consensus reached to designate the office building site next to Moe’s parking lot as Office. Consensus reached to designate the CVS property to Highway Commercial. Consensus reached to designate the property south of CVS to Multi-Family. Mounds View Planning Commission October 3, 2007 Regular Meeting Page 5 Consensus reached to designate the east and west sides of Groveland Road, south of Highway 10, to reflect what is currently there — single family detached, single family attached, and multi- family. Planning Associate Heller referred the Commissioners to the Public Facilities chapter of the Comp Plan. She stated she would edit this section to reflect the current data. She stated she would request that the Parks, Recreation & Forestry Commission and Public Works review this also. Director Ericson suggested adding a more generic statement that would encompass all public utility providers under Goal 1, Policy d. Commissioner Lang recommended adding another policy under Goal 3: "Look for opportunities to share resources with adjacent communities where it is economically advantageous without lowering the level of service." Planning Associate Heller recommended changes to Goal 6, Policy h. Vice Chair Miller commented she is curious to know whether the year 2000 estimated sewage flow statistics turned out to be correct. 7. Next Planning Commission Meeting: A. October 17, 2007 B.
