Call to Order The meeting was called to order by Chair Stevenson at 7:00 p.m., February 4, 2004. ______________________________________________________________________________ 2. Approve Minutes a. January 7, 2004 MOTION/SECOND: Song/Miller. To Approve the Planning Commission Minutes for January 7, 2004 as Presented. Ayes – 6 Nays – 0 Motion carried. ______________________________________________________________________________ Mounds View Planning Commission February 4, 2004 Regular Meeting Page 2 ________________________________________________________________________ 4. Citizens Requests and Comments on Items Not on the Agenda Mayor Linke addressed the Commission and expressed concern that a Planning Commissioner had commented at the last meeting in a negative manner against the Council. He then explained he did not like how the statement was worded and explained to the Commission what their job is and asked whether Mr. Zwirn was willing to abide by the Comprehensive Plan and City Code. Mayor Linke indicated that Council was told by its legal counsel that the preliminary plat must be approved if all the conditions are met or the City would be sued. He then said that no one on the Council is in favor of this development and he personally feels that the development will be cost prohibitive. Commissioner Zwirn indicated that he is willing to abide by the Comprehensive Plan and the City Code but reserves the right to disagree with Council decision. The Commission discussed the requirements for approval of preliminary plats and asked Staff to clarify the requirements to ensure there will be no misunderstandings. ______________________________________________________________________________ 5. Special Planning Case SP-121-03 Community Development Director Ericson suggested leaving the duration of the permit open to allow for consideration of the applications on a case by case basis. Director Ericson corrected the language to read 180 days rather than annually. Commissioner Miller asked if Staff checked with the attorney on penalty language. Director Ericson indicated that the City Attorney asked that the misdemeanor language of the Code stand on this. Commissioner Hegland asked that the fire code language be added. MOTION/SECOND: Miller/Scotch. To Approve Resolution 752-04, a Resolution Recommending Approval of a Code Amendment to the Zoning Code Regarding Temporary Structures in Commercial/Industrial Zoning Districts. Ayes – 6 Nays – 0 Motion carried. ______________________________________________________________________________ 6. Special Planning Case SP-113-02 The Commission asked that hours of operation be added from 7:00 a.m. to 10:00 p.m. Mounds View Planning Commission February 4, 2004 Regular Meeting Page 3 ________________________________________________________________________ MOTION/SECOND: Hegland/Song. To Approve 751-04, A Resolution Recommending Approval of a City Code Amendment to Section 1112.03, Section 1114, Subd. 5 and Section 1115.04, Subd. 2 Regarding Temporary Outdoor Sales. Ayes - 6 Nays – 0 Motion carried. ______________________________________________________________________________ 7. Review of the Planning and Zoning Commission Bylaws The Commission reviewed the bylaws and agreed that no changes were necessary. They voted to let the bylaws stand. Mr. Schmitt addressed the Commission and said he felt that the comments of the Mayor were inappropriate, and if he were on the Commission, he would resign. ______________________________________________________________________________ 8. Next Planning Commission Meeting: February 18, 2004 ______________________________________________________________________________ 9.
