STATE OF MINNESOTA
RESOLUTION APPROVING A VARIANCE TO ALLOW FOR A REDUCTION IN
THE NUMBER OF REQUIRED OFF-STREET PARKING SPACES AT
2840 HIGHWAY 10, PLANNING CASE NO. 358-92
WHEREAS, the Mounds View Planning Commission has
reviewed the request of Simon T. Simon for a variance to allow a
reduction in the number of required off-street parking spaces at
2840 Highway 10; and
WHEREAS, the applicants property is subject to parking
requirements setforth in Chapter 40 of the Mounds View Municipal
Code; and
WHEREAS, the Planning Commission has reviewed the
criteria used to evaluate all variance requests; and
WHEREAS, the applicant has presented a hardship
statement to the Planning Commission; and
WHEREAS, the literal interpretation of the provisions
of this code would deprive the applicant of rights commonly
enjoyed by other properties in the same district under the terms
of this Code; and
WHEREAS, the special conditions of the property do not
result from the actions of the applicant; and
WHEREAS, granting the variance would not confer special
privileges on the applicant that are not enjoyed by other
property owners in the same district; and
WHEREAS, the variance requested is the minimum
necessary to alleviate the hardship.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission approves the request of Simon T. Simon for a
reduction in the number of required off-street parking spaces at
2840 Highway 10 contingent upon the following:
1) A Certificate of Survey and, a parking and curbing
plan shall be prepared by a professional engineer
and submitted to City staff for review and approval
prior to occupancy of that portion of the building
at 2840 Highway 10 which is currently vacant.

limited to two (2) curb cuts meeting all
requirements of the Mounds View Municipal Code.
3) A written:agreement between the property owner and
the Minnesota Department of Transportation allowing
the use of MnDOT right-of-way for vehicle
circulation and parking on the property be provided
to the City.
4) Any future change in use of the property shall
require the review of the change as it impacts
parking on the site by the Mounds View Planning
Commission and City Council.
