Call to Order The meeting was called to order by Chair Stevenson at 7:00 p.m., October 2, 2002. ______________________________________________________________________________ 2. Approve Minutes a. September 4, 2002 MOTION/SECOND: Zwirn/Hegland. To Approve the Minutes of the Planning Commission for September 4, 2002 as Presented. Planning Case CU02-001 Planner Atkinson indicated the request was for a conditional use permit to operate an automotive repair facility in a B-3 zoning district. He then indicated that auto repair is conditionally allowed in a B-3 zoning district as long as certain criteria are met. Planner Atkinson indicated that the items discussed at the last Planning Commission meeting were added to the conditions on the conditional use permit. He then indicated that 10 parking spaces are required and two site plans have been provided for review. Planner Atkinson reviewed the parking site plans with the Commission. He then indicated that either would satisfy the Code and asked for input as to which plan the Commission would prefer. Planner Atkinson indicated that the vacuum island would need to be removed if parking site plan number two were used. Commissioner Miller asked if any parking spaces would need to be designated for handicapped parking. Planner Atkinson indicated that there were currently no spots designated as handicapped spaces and then said that the building official would handle that during the building permit phase. Commissioner Zwirn indicated he preferred version one for method of operation and ease of congestion and then noted he would prefer to have the parking away from the building for fire and safety reasons. Commissioner Johnson commented it would be preferable to have the cars away from the building at night. Chair Stevenson indicated the third stall would not be needed to meet the requirements of the Code. He then said that it would be possible to eliminate stall one and open up the curb to add another stall. Commissioner Hegland commented that the vacuum island could be left in its current location if parking version one were used. Chair Stevenson asked if a third stall could be added if the curb cut was changed. Mr. Studer suggested turning stall one to be parallel to the building to provide for a van accessible handicapped stall. The Commission indicated it was fine with the version one parking site plan with the addition of the parallel to the building handicapped accessible stall. Mounds View Planning Commission October 2, 2002 Regular Meeting Page 3 _______________________________________________________________________ Commissioner Johnson commented that it would not be advisable to leave vehicles behind the building with a 24-hour operation. Chair Stevenson commented that the area of stalls two and three would be the place for outside overnight parking. Commissioner Johnson recommended keeping cars away from the building to discourage vandals. Commissioner Miller asked if there would be a trash enclosure. The Applicant indicated there is a garbage enclosure now. MOTION/SECOND: Johnson/Zwirn. To Approve Resolution 710-02, a Resolution Recommending Approval of a Conditional Use Permit to Operate an Automotive Repair Facility in a B-3 (Highway Commercial) Zoning District. Ayes – 6 Nays – 0 Motion carried. Planner Atkinson noted this matter would be heard by the Council on October 28, 2002 at 7:00 p.m. ______________________________________________________________________________ 6. Consideration and Discussion Regarding a Proposed Amendment to the Zoning Code Pertaining to Temporary Outdoor Sales. Planner Atkinson indicated the City Code requires a conditional use permit for all temporary sales and another part of the code requires an administrative permit. He then indicated Staff would like to provide an option for those that only want to operate on a temporary basis that would allow for them to apply for an administrative permit without going through the formal conditional use permit process. Planner Atkinson indicated that Staff is proposing putting a time limit on some of the smaller vendors to allow for sales shorter than 10 consecutive days. Planner Atkinson indicated this amendment would apply to all business districts. Planner Atkinson indicated some other issues have come up for uses in R1 districts such as having sales or festivals at the churches. Commissioner Miller questioned whether the ten consecutive days should be limited to a certain number of times per year to prevent recurring sales from month to month. Planner Atkinson suggested allowing three permits through administration per year before requiring the conditional use permit. Mounds View Planning Commission October 2, 2002 Regular Meeting Page 4 _______________________________________________________________________ Chair Stevenson commented that the three days was added for temporary signs and limiting to three periods would be reasonable and consistent with other parts of the Code. Commissioner Johnson suggested finding a way to make sure that parking and obstructing views is not an issue. Planner Atkinson indicated that the proposed language indicates that parking shall not take up any parking spaces needed to meet the Code requirements for that property. He then said that Staff should be able to determine if there is an issue with the proposed sale location before issuing the permit. Commissioner Johnson suggested adding language to indicate that the permit could be revoked if the activity causes a parking or safety issue. Community Development Director Ericson commented that the building owner may be the one taking out the permit. Chair Stevenson asked Staff to further define the language to indicate that the activity shall not cause parking issues or the permit would be revoked. Commissioner Johnson commented that most of the businesses in town have just enough parking to conform with the Code. Director Ericson indicated Staff could come up with language to address the issues raised. He then indicated that Staff should be able to review the proposal and determine if there would be an issue with the location and/or type of activity and would have the right to deny the permit request. Commissioner Hegland asked that some language be added to require no more than three consecutive 10-day permits. Commissioner Miller asked if there would be an occasion where a permit would be taken out at one location and then the applicant would pull a permit for another location and move to several properties in town. Planner Atkinson indicated that the proposed change would apply to the property itself so a vendor could potentially move from one property to the other with the consent of the owners. Director Ericson indicated that Staff would review that issue and suggested that Chapter 500 may assist in addressing the matter. Chair Stevenson asked how the Pepsi truck moving to all the gas stations in town would be addressed. Mounds View Planning Commission October 2, 2002 Regular Meeting Page 5 _______________________________________________________________________ Director Ericson indicated that parking a semi on the grass with a sign on it would be handled under the sign code. Commissioner Zwirn indicated that Pepsi recently introduced tent sales where they sell pop and promotional items out of the back of the truck. He then said he thinks Staff should look into that matter as well as requiring one representative from each vendor rather than multiples. Chair Stevenson indicated he felt that the sign on the Pepsi truck would fall under the temporary sign Code. Planner Atkinson indicated that the Pepsi truck parking in the parking lot is not an issue but it the truck should not be parked on the grass. Director Ericson indicated that if the truck is parked in a manner to draw attention to it for the purpose of selling products it would be handled under the sign code and Staff would pay the business a visit. Commissioner Johnson commented that he did not feel that the City could enforce not having the truck parked there because he has seen similar situations with Budweiser. Commissioner Hegland commented that the Pepsi truck scenario is outdoor storage of the product for the business running the property and is not the same as a temporary vendor selling something separate from the business that owns the property. Director Ericson indicated Staff would put together the comments and bring a draft for review at the next meeting. ______________________________________________________________________________ 7.
