MINUTES' Minutes of the August
Blanchard, James 8urggraff, Nancy Burmeister,
Glazer, George Gustafson, Batters Hake and
Commission Meeting were approved as read.
BUSINESS'
Review of Piot and Construction Plans for the Sely 135.5 feet of Lota 106 and
107. Spring Lake Park Hillview Addition for Crown Auto Stores, represented by
Mr. Charles Novak. Ma Novak investigated an entry off of Highway 10 into the
proposed development containing a Crown Auto Store with the Highway Department.

specific'area designated for the Crown Auto Store, it was noted that the
items meet' with our ordinances' parking facilities, exit points, setbacks and
fencing of the back lot area.

patter or Lake 106 Hillview
1145 indicated in site plan dated 9/20/73 tbut traffic
with
the sane architectural specifications indicated in site plan dated 8/1/73 which
was presented at the August 22, 1973 Planning Commission Meeting. Approval of
the whole proposed development and traffic exits as Indicated in site plan
dated 9/20/73 is not given. 8 ayes 1 nay. (Bob Glazer opposed, he preferred
to see some endorsement by the Highway Department of all proposed exits and
entrances along Highway 10.)
A Major Subdivision (16 lots) by Keith Harstad for Proposed Greenfield
Plat No. 3 was not heard because no one appeared before this Commission to
represent him.
The Commission reviewed a plan Gordon Fedor presented reGardins a 20' x 40'
addition he wished to build on the back of Fedor's Market. The. addition +Quid
have the same stucco finish as the exist:.ng building,' It would be used
strictly for storage, not for retail, purposes.
M`P (Shelquist /Glazer) to approve the proposed 20' x 40' addition by
Fedor's Market. 9 ayes.
Erwin Miller, 5259 Jeffery Driv9, Lot 15, Block 3, Eigenheer Second Addition
asked for a Special Permit to build an oversized garage (816 square feet)
When question',ag Mr. Miller, it was discovered ono comer of the proposed addition
would be approximately 4' 10" from the lot line. This in itself could be varied,
but it was found that even this distance was a rough estimate.
hSP (Grazer /Buaaeister) that this variance and special permit be approved
subject to a confirmation by a eurvay and. that the setback not be less than
the 4' 10" as presented tonight. 9 ayes.
If the survey indicates anythiag less than 4' 10 then Mr. Miller can cone
back to.the Planning Commission for re- oonsideration.

A variance for a side yard setback for a driveway was presented by James
Kositza, 2800 /import, Lot 1, Block 2, Eigenheor 4th Addition. Mr. Kositze's
neighbor on the garage side, Mr. Warren Pabst, appeared also. A letter was
read to the Commission from Mr.Pabst's attorney regarding the attorney's legal
opinion as to the effects thin driveway would have on Mr.Pabet's property.
The cement slab has already been poured and is 6• from the lot line. It was
red tagged earlier by the Village for being in violation of our ordinance.
Mr. Kozitza's intentions are to use this slab as a parking seta for his
tractor. He wants to erect a opaque fence 2" from the lot line to screen
this tractor from Mr. Pabst's property. Mr, Pabst feels this cement slab
right next to the lot line will be a detriment to his property,
MSP (Glazer /Shelqulst) recommended that unless Mr. Kozitza and Mr. Pabet
could come to some mutually satisfactory agreement, the Planning Commission
withholds or eenios Mr. Kozitza'o request for this variance. 9 ayes,
MSP (Shelqulst, Feick) to amend Mr. Glazer's motion that a time limit for
a al'reaching this, agreement be limited to one month from tonight and futhnr, if
e' agreement ie';(rbaohed prior to next month's Planning Commission Meeting, the
Village Attorney provide us with a ruling as to whether this slab is a
driveway as defined in 40.05 (2) (d) (2) (p. 16) or "other* as defined in
40.03 5 (2) (b) (p. 11) of our Ordinance. 9 ayes.
John Kelnor, 7t45 Groveland Road, Lot l., Spring Lake Park Knolls requested
a Minor Subdivision (2 lots).
M3P (Glazer /Burgraff) to recommend approval of Mr. Kelner's request for
'a Minor subdivisioa of Lot 1; Spring Lake Park Knolls.
Mr. Bill Edds of Programmed Land asked for a Mayor Subdivisioft of the land
located to the east of Highway 10 and north of Highway Avenue. This parcel
contains 11.37 aeres. Mention was made to Mr. Edds of the law requiring
land or cash donation, to the municipality in subdivisions of over 5 acres.
This will be brought up again when Mr. Edds comes in with a preliminary plat
of the above designated land. Tonlght, Mr. Edds showed uu a sketch plan of
'bat his intentions are on the land is queztion and asked oar, assistance
before he went ahead with his preliminary plat. A Standard Gas Station and
a Country Kitchen are now located on the south portion of this property.
Mr. Ode said he had some plans for e. Mollonald's in one Election of the
Subdivision, and a motel with 10C units for another. A third area will be
left open for future development. The main discueslon centered on existing
road easements and proposed road easements. His sketch indicated a fully
contained area with traffic movement tota iy confined within its boundaries.
Questions arose as to what would be eventually developed Borth of his subdivision
and difficulties that development may have in traffic congestion.
MSP (Buraeistee /Falck) to recommend a vacation of the easement in the
Northeast corner 210' strip on the East'side'of proposed Block 2, Lot 3 but
maintain the easement on the 180' curve on the East side; vacate easement on
the East side of the Southeast corner of 210', Block 2, Lot 2, and Vacate the
South easement of Block 2, Lot 2, of 282.70', have the CO' road go through
the lower i/3 part of the Subdivision as indicated in the Preliminary Sketch Plan.

We would like Attorney Myers or the Council to check out the present etatum
of Liberty Street which was plotted previously. Liberty Street is located on
the East side of the proposed Subdivioion by Prograi wed Land, First Addition,
Block 2, Lot 3. It supposedly belongs to Claudia Skits. We would like this
information before our next Planning Commiesion Meeting in October.
MS (Blanchard /Gustafson) to recommend to the Counoil that they consider
acquiring 6' more on the proposed street which will go through the lower 1/3
portion of the Programmed Land Subdivision to make it a 66' street right -of-
way. 3 ayes; 6 nays Defeated.
