Representatives of Compessior Christer Center appeared
before the Commission to request a special use permit to

growth of the elementary school would be limited to about
60 students.
Currently, recreation for the students is provided by
walking to Hillview Park. Mr. Baumann has been in contact
with the Principal of Red Oak School concerning the use
of the school grounds, but no agreement has yet been reached.

In addition to the church property at the above address,
Compassion Center also owns the triangular piece of lend
bounded by Red Oak Dr., Highway 10 and Hillview Rd. located
to the Southwest of the Church.
Mr. Beira stated that the church has 30,000 square feet of
parking space on the church grounds yib43lng approximately
55 to 60 parking spaces. The parking area has eetbaoke of
3 ft. on the north and 5 ft. on the eaot where it is
adjacent to residential property, and that it is screened
by a hedge around a part of it. That parking space is
sufficient to satisfy the requirement° for parking space as
required in the zoning ordinance 40.05 2 b) if the bible
school is judged at the same rats as a high school.
Mr. Baumann noted that the oar 000upenoy rata for bible sohool
student is 2.6 persona per oar versus a college average of
2.3 persona per oar in the twin cities area. The elementary
students are brought to the school by their parents in care
whioh do not remain on the premises. (The students aro children
of members of the congregation with the exception of six
students.)
Mr, Pe re futher stated that the triangnisr piece of property
has sufficient space for an additions 105 care which more
than satisfies the requirements for parking for the church.
Ater some discussion and oaloalatlon with Mr. Glaser of the
planning Commission, it was agreed that if that piece of land
is construed to he a parking lot, end if the set back require-
ments for parking lots ere applied there is epaoe for 65 oars
on the triangle.
Mr. Caumann stated that the fire chief 1s satisfied with their
faoilitiee now that the printing operation has been closed
down. He stated further that they made a survey by personal
contact with 10 neighbors, and that they have received no
objections to their operation,
Mr. Chandler expreasad the position of the ohuroh, that a
non conforming use of the land was established previous to
the adoption of the zoning ordinance, and that that use
passes with sale of the property to a new owner. To be other
than this would be oonfisioation of property. The usv of the
property as a church has been established and the bible study
class is a normal extension of church use. The church thus
does not feel that they are required to apply for a speoial use
permit for it church, but are doing so to demonstrate willing
ness to cooperate with the o1Cy. They futher contend that the
elementary school may be subject to a special use permit, but
that also could be argued to be an extension by precedent of
Abiding Saviour Nursery School.
He further stated that it was the hope of the church that the
city would keep in mind the limited financial resor,oes of the
church in placing requirements and conditions upon their use
permit.
The position of the planning commission was stated to be that
a property that has use s grandfathered" in becomes subject to
the requirements of the zoning ordinance gaud other 'laws there
in force at the time, whenever change of ownership takes plane.
In reply to a question concerning the people sleeping at the
ohuroh, Mr. Baumann responded that they have two maintenance
people staying on the premises to curb vandalism. This was
done at the suggestion of the police chief.
MSP Haako /Shelquist, we recommend to the council that a special
use permit for Compassion Christen Center to operate a church,
daily olassea in religious instruction for adults and an

elementary school be apbroved with that stipulation that
they comply with. the fire chiefs recommendations.
MSP Glaaer/Haake to amend the main motion to add that the
recommendation is based upon the expected enrollment of
150 adults and 60 elementary students maximum.

MSP Roseman/ to emmend the main motion to add a
stipulation that the trianglur parking lot be Surfaced, 15 ft.
setback established and screening added on the north side per
the fining ordinance.

MSP shelquiet /Haake to amend the main motion to add a statement
that the triangular lot may oontinue to be used as an
occasional parking lot as is, but if graded in the future for
use as s parking lot, eo as to permantly deatroy the vegetation.

MSP Glaser /Roseman to amend the main motion to include the
statement that vegetation on the lot will be sustained as a
deterent to blowing soil.

M3P shslquiet /Glaser to amend the main motion to add a rec-
emendation that the council hold a public hearing in con-
junction with the requested special use permit.
6 ayes. Motion passed
Futher discussion pertaining to inclusions of a statement on
the printing operation in the motion ensued. The consensus
of the commission was that since the printing operations had
been discontinued, and was not a part of the request for a speciall
use permit that it should not be included. It wao pointed out, f
however, that commercial activity in a resident's' tons is
specifically prohibits], and the prohibitions enumerated in
zoning ordinanoe included the shipment or delivery of material.
A vote was taken on the main motion as amended and Was passed.
