CONDITIONAL USE PERPiIT REQUEST OF ALEXANOER OI4ERSIFIEO SALES INC. - 28q8 HIRHWAY 10 Offlcial Rose reported that the applicants request was originally dented 4n NovembRr 9. 1977 and that he has now submitted a survey uf the property showing existing features and proposed parkirg. Planning considerations include that the Camprehensive Plan directs the remeinin@ undeveloped land in District 12 along Highway 10 to develop medium density and the future redevetopment of the existing spot comnercial site to medium density. The land is presently zoned 6-4 anA the proposed useage requires a B-3 Conditional Use PeYmit zoning. B-4 zoning uses allow B~3 uses. The appllcant has shawn 11 customer perking spaces, which Staff fieels would be ndequate. The sale display spaces are located in front of the garage area and , along the Highway 7.U frontage, totating 15 spaces. Yhe fuur sP::ces 1oc~ked in front of the gara~e cause a customer parking problem in that the tast southwesterly sta11 would be hard to use, if not impossible, 7he traffic corridar betWeen the dispiay spaces is only 15 feet widr and not adequate for two-way traffic. The appllcant plans na additional !mprovements other than the marking of parking spaces. All parking is located on paved arezs. Alexender a1so asked that he not be pre-~udged by the previous occupants record. Mr. Alerandar presented Official Rose wlth a 11st of signatures from the three neighbors giving their approval. They ar~ Walter Harvey, 2855 ftighway 10, James ~Jeick, 7920 Groveland and Simon T. Simon of Simons Liquor and Food. Mr. Alexender also asked that the Planning Comm9ssion keep in mind that wfth a Conditional Use Permit, 1t could be revoked if he did not comply with the f,ity and that he would not risk his investment. Councilmember Bnumgartner asked 1f anything was pianned to be done with the gas pumps. Mr. Alexander replied thct they were already gone. Comnisslon Mem4er Burmeister asked if any work would be done to tha cars in the gnrage other than cleaning them. Mr. Alexander repiiod that no ma~or work would be done on the cars, that they wouTd be basically c7eaned and that very minor repair wark mtght be done, such as changing spark plugs or a tire, but that no bady work or engin~ overhauls or anything ma~or would be done. Cortmission Member Mackeben asked if the gas tanks were sti11 there. Mr. Alexander ' replled that they were but that they had been emptied and would rot be used. MSP (Btanchard-Burmetster) to recommen9 to the Council that thc; grant a Condi- tionai Use Petm1C for the operatlon of a used auto sales business at tho corner of Grove7end and Nighway 1~, with the stipulations that onty 31 cars be dtspla;~ed in front of Hfghway 30, accordlnp to the site p1an, and two ir.side the garage. Comm. recottmends that there be a ltmit of nnly one frontage sign and no outside storage of parCs or non-functioning vehicles and that the parking spaces be properiy mArked. 6 ayes Cortmission Member Glazer asked Mr. Alexander if he agreed L•hat the 11 outdoor display spaces were adequaL•e. Mr. Atexander reptied that the 11 spaces would be edequate and that he was sntisfied w~th that number. JMJOR SUBDIVISION R~UEST OF KEITH HAR57AD - 8374 PLEASANT YIEW DRIVE Off1c1e1 Rose reparte~ that Mr. Narstad has requested to subdivide three separate parcels to create 7 iots with two autlots for R-1 development. Planning consideratians include that the land use and zoning depicts singie famity construction. Biock 1 creates three ]aCs and one outlot and a17 lots have 85' Yrontages and exeeed the square foot~ge requirement of 11,000 squaPe feet. A tot remnanC wouid be created, approximate7y 50' x 165', fronting Pieasant View. ~ Lot 1, fronting Spring Lake Road, has three buildin~s iocated on or part9ally on it. 8oth the garage end housa meet setback requirements, whiTe the shed is i~ceted partlally on 1o±s 1 and 3 and outlot A. Lot 2 is an irreguiar~ shapad iot due to the pcrtiel tnking uf a pnrcel from the Rosenquist Addition, leaving both lots meeting reinlmum rQquirements. Lot 1 meets or exceeds lot size requirements and lot remnant outlot 8 1s created, approximately 49' x 256'. B1osk 3 creates three lots, and a11 lots exceed frontage and square footage require- ments and front Pleasant Vtew Drive. An additional ten feet of uCillty eas~nents for the lots fronting Pleasant View Drive would be given for underground utilltie~. An additionai etght feet woutd be required on Sprtng Lak~ Rcad. but the additional propased ten foot utility easement would not be necessary. Servlce stubs to the lot lines are availabie for all five lots front- ing Pleasant View, and services are available in the street far the new tot fronting Spring Lake Road. A devalopment agreement wouTd be required to be drztvn up and execuCed for the devclopment. OPftcial Rose reported xhat Staff recumnends denial of the plat as presenCed wlth the outlots but that if Mr. NArstad desires to create buildable lots from the outlots as he has donA wlth Lot 2, Btock 1, he should be required to do that with the ptatCing. If the awners of the ad,~acent prnperty are unwilling, the outlats cauld becoms tax farfeit land. Officiat Rose recomnended that 1:he plat could be approved with changes and ameridntents, - Chat 61o~k 1, Lot 2 requil^e that the Rosenqutst praperty Lo the north be incar- porated 1ntQ the plat, that Block 1, Lot 3 and OutioC A be combined to meke one 1oL. and that Bloak 2, Lot 1 and Outlot B ba combinad to make one lot also, und that n development agreement with the City be drawn up and executed. Mr. HarsCad stated that he has spoken to all the owners of the ad,~acent property and that while Mr. Rosenquist is willing to se11 that this time, that the other owners ~ are not yet ready. He stated that he has shown Outlnts A arid B on the plat because he plans to someday make arrangements with the other owners to make legal lots. Hr. Harstad aiso sLated that he would pay off the aesessments, if necessary, for approval. Comnission Memb9r eurmeister asked how much land was between Outlot e and lot i, Block 3.. Official Rose replied that ~cfiere was 134'. Officlal Rose stated that the ad~acent property should be purchased and platted now, for approval. Mr. Harstad replted that no one was ready to se1T yet but they would 1n the future. Official Rose also poiated out that Chapter 42.09~ Subdlvision 6, Paragraph 4 refers to lot remnents and requires that they be combined with adjacent properYy. Comnission Member Glazer stated that Mr. Narstad's comments and plans make sense about future development of the p~aperty but that he did not feel the Comm~ssion shauld go ugainst a wrltten law. : Cammisston Member hiackeben stated that if Mr. Narstad wouid agree to pay off the \~ assessments, it could be approved. Mr. Harstad also stated that while Mr. Rosenquist was rQady ~ to setl now, he woutd not purehase that property until the City had approved the whole plen. i. Mr. Harstad a1s4 asked Che Planning Co~nission members to 6e aware tlint he was involved in the request of Eigenheer 8uilders for the proporty ~t Edgewood and County Road I, as he was on~ of the property owners. MAJOR SUBDIVISION REQUEST OF RAY GALE - 8243 GROVELAN~ ROAD Chairperson Haake stated that since no one was preseot ta represent Mr. Gale that #he issue woutd not be disc~.sed. -J Chairperson Haake stated that be~inning in Januery, the Plenning Commission would be meeting twice a month, on the second and fourth Wednesd~ys. She aiso stated that sh~ woutd be out of town on Sanuary 11 end aske~ Comm!ssiun Member Mackeben to chair that meeting.
