MINOR SUBDIVTSION REZONING AND CONDITIONAL USE PERMIT REQUEST OF GLENN KARLEN - 2&09 COUNTY RO G I Official Rose reported that Mr. Karlen has requeated to lacate a self-service car wash business on the northwest corner of County Road I and S11ver Lake Road. Rpproval oF the request would require the City to approve a minor subdivision creating two l~ts, n rexaning of one 1ot from R-1 to B-3 and a conditional use permit for the car ~aASh usage. P7anning consideratlons include that the proposed sketch for the subdivision creates two code conforming lots, of which both equal or exceed size requirements for R-1 and B-3 lots. The setbacks for existing and proposed bu77d1ng features meet minimum requiremants with the exce;tior ~:liat code requires a minimum 10' green strip abutting residentrel properties, while the applicant has oniy provided approxlmately 5' on the west and north sides. If the Comnission were to approve Mr. Karlen's request, he wou7d submit a surveyor's certificate for subdivis;on. Official Rose stated that present zoning and land use plan designatien is singl2 famlly, and Che parcei in question has been considered for possibte duplex development by other developers in contact with the City. February 22, Z978 Pege 2 Or'ficial Rose reported thAt a1i specif1ed condittuns under Conditionel Use Permlt RequiremenCs, Section 40,17, Sub. d can be satisfted, wiCh the exception of the ~ntnimum ten foot setback required alung residentiai properties, Officia1 Rose stated that Mr. Karlen has requested tw4 curb cuts, one on County Road I, to be an entrance, and an exit on 511ver Laks Road, The pro~ected A,D.T. is under 200 vehicles. Mr. Karlen praposes to screen residential properties with a six faot opaque redwood fence, wi~ich should be required to encompass the proposed B-3 property, including the unused northwest portion, which would more readity allow its maintenance. Mr. Karlen has proposed piantin5s atong the minor arterial frontages. Also, the present plat would allow a stacking of 12 vehicles with additlonal di•ive through space avaiTabie. Offtciai Rose stated that the sewer and water services are available ior the B-3 conditionai use permit request, and that Mr. Y,arlan may he required to install a catch basin, if on surface drainage is unfeastb7e. Offiaial Rose added that if Mr. Kartan's requests are approved, a development agreement would be drawn up, takiny fnCa cons;deration ~oncrete curbing, opaque fencing, plantin9s, signs, 1lghting and drainage. C~mnission Member Glazer questioned where the wate~ from the car wash would go if the City dra7nage pro~ect is not approved. Official Rose replied that the present s~stem catch basin crosses the street and enters into the Kraus-Anderson property and goes through that d9tch and travels south, ending up in Long Lake. Camnission Member Glazer asked how the Rice Creek Watershed District felt about soap from the car wash going inta the lake. Official Rase replled that sand and grease traps would be required inside the car wash, and that the PCA would have ___.to approve whatever deteryents were used. I~e a)so added that the water from the car wash would go into the sanitary sewer system, and that it was fust the run-off from the exterior pavement that wou7d be going into the storm sewer system. Mr. Xar]an added that it would only be outside rainwater that would be going into the storir~ sewer system and that a11 other water wnu7d be going into the sanitary sewer system, and that he would be charged accordi~igiy. Corrm7ssion Member Gtazer questioned what the average water consumpLion would be per montf~. Mr. Karlan replled that he has a similar operation in 8iaine and that the average water cansumption ia 100,000 gallons per month. He stated tf~at only 8 gallons of water are used per cycTe. Official Rose added that the type of sprayer to be used was high pressure - 1ow valume. Mr. K~r1an stated that the car wash would be self service but that he wouid have an attendent on duty at a11 times, both to protect his investment and to assist the customers if any mechanical prob7ems occur with the equipment. Mr. Karlan added that there are several neighborhood businesses along Silver Lake Road pre- sently and tt~at he fe1t the corner he had selected would'be a good one for such a business. He also stated that he had spoken with some of the neighbors, who had said they would appreciate having a car wash in that locatton. Chairperson Haake inquired what the hours of operation wouid be. Mr. Karlan replled thet it would be open from 7 AM to 10 PM, seven days a week, with'Saturday and Sun4ay being the busiest deys. Commission MemSer Fedor questianed if the land was lower than tbe road. Mr. Karlan replied that the property was lower than County Road I but it was levet with or higher than Silver Lake Road, February 22, 1978 Page 3 Chairperson Haako pointed ouC that the ~resent zoning is R-1 and that R-2 is being brou~ht in along the west side of Siiver Lake Road, and that the nartheast corner ~1s designated for cortmercial. Mr, Karian stated that he hau checked with the St. Pau1 Water Works, kl7o had age~eed to tssue a permit to run water pipes across the road. Official Rose added that there would be no problem in crossing the road, and thaC Staff may require that exect detalls of the drainage be worked out if the Commis,ion & Council approve the request. Comnission Member Glezer asked if the 100,000 gai1on per month water consumptlon fit within the City water budgt:. Official Rose replied that there would be no problem with the water consumption, Chairperson Haake asked that the Comnission Members address the issue of rezoning and the conditional use pennit, and stated that other details could bP worked out later, Comnission Member Burmeister questioned whether there would be a traffic problem as there had aiready been severa7 accidenis at that intersection, ~nd stated that the area was already heavily traveled. Official Rose replied that the Ci~y coutd envision a 4-way stop sign at that intarsection when the Kraus-Anderson property is developed, but that for the present,'the traffic counes on County Road I were 7ow and the County had not yet determined a need for traffic controls. ,~ Gomnissian Member Foss stated that he felt the property shoutd be a higher density i than R-1 6ut that the main Gharacteristics of the neighborhood were residential and that he would rather see tlie land remain residentiat. Mr. Karian stated that he owns quite a bit more 7and behind his car wash in Blaine, where he was planning on putting in duplexes, since he felt duplexes go we71 with business esta611shments. He also added that there is a commercial use across the straei from where he wauld like to put the car wash in, and that the tacation was a major thoroughfare. MSP (Burmeister-Fuss) to den~ the request of Mr. Karlan far a ininor subdivision, rezoning and conditianal use permit because this type oP use is much more intense that what Che Comprehensiv4 PY~r calis for or the Z~ning Map. 5 ayes Comnission Member Burmeister stated that she did not feel the City is short of comrercial property, and thus did not feel it was necessary to change R-1 zaning Comrnission Member Glazer added that he agreed wlth Comnission Member Durmeister and stcted that if the request had been approved, it would frustrate any efforts in the future to keep ked Oak Drive from being upgraded. ~ Co~rmStsion Member Fedor stated that if the City approved rezon7ng on one corner, they might be face with the possibiiity of rezoning the other corner of the intersection, which was not intended when the Canprehensive P1an was written. f '~ , 2EOUEST OF OMEG11 CORPORATION FOR R-3 OEVELOPMENT - 7640 WOODLAWN ORIVE Official Rose reported that Omega Cqrporation has requested to bu17d a 4-plex unit with garaged in an R-4 zoned area. Pe6ruary 22, 1978 Aage 4 Planning considerations include that both the 2oning Map and Land Use Pian desig- nete the area as high density residential, and R-3 ts an allowable use in an R-4 ~lassiPied area. The proposed 4-plex unit and garages meet minimum setback requirements, and minimum requirements for both lot area per unit and usabie open space are met. The codp requires 2y parking spaces per unit with a minimum of one being a garage unit, which would be mat with the p1an. Official Rose stated that the appli:ant has proposed a curb cut on Bronson Drive which is only a half street without storm drainage facilities, and recommended that Lhe curb cut and traffic be placed an Woodlawn Drive, as it is a storm sewered ful~ street which is capable of handling the traffic which would be generated. Officia7 Rose stated that a devetopment agreeme~t wouid 6c entered inta 1f the requesC is npproved, and would include a g2,000 bond or cash escrow submitted to the City, requirA sodding or seeding of the 1og, reauir•e a minimum of two plantings, 2' in diameter st breast height, aspha't paving and curbing and concrete xidewalks. OfFictal Rose added that the Commission Members might wish to discuss and require a tot lnt a1so. Councilmember Baumgartner asked what the drainage situation was in the area. Offictal Rnse replied that there is a catch basin and an existing system on Wuod- lawn Drive, He added that the amount of run-off is miniinal, bu: that each addiEfonnl deve7opment in the City adds to the drainage probleins that exist everywhere. Wally Kocemba introduced himseif as the representative fram Omega Corporation and stated that they also nwn the lot next to the proposed development and would 11ke ~to put another 4-plex on that lot at same time tn the future. Ne added that he ^~~°would be willing to put the driveway through on Woodlawn but wouid then like to move the garages sa as not to have the wh~le lot end up 6eing paved. Chairperson Naake stated that !f Omega Corporation plans to do the same Ching ou the next lot, they could back the garages up to a11ow even more green space. Mr. Kocemba rep]ied that they would tike to handle each development sepzrately since they would have different owners. Chairperson Haake asked why Bronson Drive would not be acceptable for the entrance and extt. Official Rose replied that Bronsan Drive is more of a service drive and that deve7opmen2 was not meant off of it. He added that it is w9thout sewer, water or storm sewer services and thore are no plans for putting it in, while Woodlawn does have full services. Chairperson Haake requnsted that if the plan is approved with the drive coming in from Woodiawn, that Staff review it again to make sure it meets a71 requirements Officiai Rose repiied that he would be reviewing it again. Mr. Kocemba asked if he woutd have to go through the same procedure when he was ready to develup the next 7ot. Official Rose replled that he would. MSP (Fass-Burmelster) to approve the request of Omega CorForation to build a 4-piex with garages at 7640 Woodlawn Drive, subfect to the tullowing cunditions, that a develapment agreement be entered inCo with the City, which would require that a ~$2,000 bond or cash escrow be submitted to the City, sadding or seeding be required, ~two trees, 2" in diameter at breast height be pianted, asphalt paving and curbing be put 1n, and a concrete si~ewalk be installed from the building to the garages. The driveway would go to Ivoodiawn Drive, and any relncatlon of tne garages or parking area woutd be approved by the Staff. 5 ayes February 22, 1978 Page 5 PREVIOU5 COUNCIL ACTIONS AND NEXT AGENDA ~ouncllmember Baumgartner pointed cut to the Comnission Members a paragreph in the Comprehensive P1an that says any and ati public improvemenCs or land acquisittons must be prasented to the Pianning Comnission, Official Rose added that the Alanntng Cortmtssion must make a recomnendatio~ to the City Councii on the storm water improven~nt pro~ect, before the Cuunci'I actrs on it, He alsa added Lhat he would see that each ComnissSon Member rec:ived a copy of the repart fran Short-E171ott- Hendr~9ckson on the proJect, and a copy of the minutes from the publlc heering to stuay, Councitmember 8aumgartner stated that the reaction fran the citizens at the public hearing was very evident and not unexpected. Comnission P4ember Foss asked hiox many hours were spent in presentipg the pro,~ect to the City Councii by the engineers, Councl7member 9aumgartner repiied that ~nany, many hours wera spent ~y both the Staff and Council in reviewing the entire proposat, tine by 1tne, page by page. He added thiat nine engineering firms he.d submitted proposals to the City, which had then been narrowed down to thr•ee, which each made a presentatton to the City, ai: which time ShorC-E7liot-Hendrtckson +vas selected. Officfal Rose steted that the cost of the feasibility report was $37,000, whlch came in under the $40,000 which had been budgeted. Comnission Member Foss asked if the City was under any obiigation to continue on ~ with Short-E111ott-Hendrickson, or if they could receive bids frwn 2ther engineeriny ,~~jfirms at this tiR~e. Official Rose repTied that the pro,~ecC had not been 1eC out for blds yet, which would be coming in fran contractors, not engineers. He add?d that it would be of no benePtt to the City to bring in another engineerinc~ firm since the rasults woutd be hasical7y the saine, yet the Gity would incur the cust again, Commission Member Burmeister asked what the time tsble for the pro~ect was. Counciimember Baumgartner replled that it was expected to take Chree years. Ne added that a five year pro,~ecc had been considered but that the feelinys were the citizens would not like to see the C1ty torn up for five years. Councllniember Baumga:^tner ,tated that a request had been made at the end of the publlc hear9ng to have the March 27 Council meetin9 at the Bet Rae Ba11i^oam atso, which is when the Council will annaunce their decisinn on the pro,~ect. Of£icia7 Rose added that the A7exander ~iversified Sales request had be!en approved at the February 13 Council meeting. He stated that the Nleasant Acres request for Y,eith Narstad was denied in content but that a subdivfsion of three lots on tha southwest corner was apprpved. Official Rose reported that the Seven-E7even request was not approved, ar,d that the Council requzsted studles be done on traffic patterns and pro,~ections Por 7980, 1985 and 1990 before they wouTd consider the ~equest agaln. He added that the criteria Whi~h was autTined for thern wi11 show any traffic ar congestion problems if they are tnevitab7e.
