Planning conslderations include the continuence of the existing 5' setback on the west side of the buitding. Employee off-street perking 1s to be 1lmited to the east side and rear (north slde) of tha building. Eight unmarked off-street parking spaces are avaitabte south of the buitding, with eight being rwqulred as per ordinance #!40.07 subdivislqn H 19. Gary Korf, owner of Horse end Rider steted that he woutd like to expedlte the addit7on ,.:,, as rtwnh as possible. He added tMe~t they ere presently heving water problems in the 'wenr and plan to raise the floor of the additlon to alleviate the water problem. ~Comn. Comnission Member foss stated thAt he could see no prnblem with the devetopnent but wouid suggest a green strip or shrubs be requlred, as it hes been requlw•d o? mact new businesses. CODE REVIEW - HEALTH SPA ZONING CLASSIFICATION Officiai Rose reported that Pastor Enterprises of Mounds View Square has inquired as to whether or not a health spa For women could be 1ocaCed in their mati. Offtciai Rose stated that Staff has found no zoniny classification for health spa usages in business districts, An R-0 zoning d9strict does atiow ctu6s or lodges without the serving of food or beverages, but by definition they have to be non- proff t. page 3 Officla7 Rose presented a survey of etght tocat cities, showin9 their ciassifications, and asked that the Piamiing Commission address the. issue. Conunission Member Glazer asked if the health spa would be right in the ma11. Official Fiose rsplied that it would be, in one of the vacant stores. Councilmember eaumgartner suggested that a condltional use permit be required if the spa was approved. OffSciai Rose read a definition he }~aJ p~~epared for a hcalth spa, that it he a prdvate .~-~,or pub7ic 6uiZding or portion thereof, having rooms for a princ+pie use of exercising and a secondary use of suntanning, bathing> steam bathing, and restrooms, which would '~-% not inciude saunas. OFficial Rose added that he wou7d have to hav~ the attorney look at the definttion for his approval. Com~Hssion Member quan stated he ~ou7d like the City Attarney to review the definitioh. Commission Mem6er G7azer stated that since the property does abut R-1 property, he felt it would be more difficu7t to maintain R-i zoning. He stated he felt 8-4 zoning would draw clientel on a region-wide basis, whereas B-3 would be more municipally located and he would prefer B-3. Comnission Member Burmeister patnted out that the shopping cPnter will be B-4 under the zoning reclassification. Commission Mem6er Glazer replied that it the Planning Commissi~n requires the spa to be 8-4, it would percipitate the whole Paster Ente'rprises be changed to e-4., Offictai Rose stated that if Attorney Mayers feels the whole center should become B-4, a pubiic heartng cou]d be he1d. Mr. Doty asked if the Pianning Commission would have to specify if tiiey want B-3 or D-4 now, since it is ,just a pt~oposed devel~p~nent. He sugqested leav9ng the zoning low and making it higher upon request. Chairperson Haake rep7led that they must spec~ify where they wunt the difPerent deveiopment to go lnto the City. Comnission Member Fedor stated he would 11ke 8-3 v;i`.h a conditlonal use permit. Comniss7on Member Foss stated he would like B-3 with a conditional use permit. Chairperson Haake stated she would like B-4, with a conditionat usa permit. Official Rose stated that they have an option to hnid a pubiic hearing , under the Conditional Use Ordinance 40.23, Subdivision A, 10, which cauld include requiring a licence, limiting Lhe hou~~s of operation, and stating something'to'the fact thet it does not corfttct with thp characCer of the development or an intended use. Commission Member Fedor stated that he felt the Plar.ning Comnission shouid be consider- 1ng the issue thraugh a license, rather than thro~gh rezoning, as a iicense wouid allow much stricter controls. He recommended holding a publlc heariny. ~MSP (Haake-Burmeister) to recomnend to the City Cnunci7 that the zoning code be amended to inciude health spas in Mounds View, and that the cirssiflcatlon for health spas be placed under B-4 zoning, with a conditional use permit required. A suggested deflnition for health spas is as follows, that tiiey be a private ar public bul7ding or portio~ thereof, liaving roans for a principle use of exercising, and a secondary use of suntanning, bathing, steem bathing, and restrooms, This does not include a sauna. Also, the Plennin~ Comnission suggests that a conditional use permtt be included, limiting the hours of operation, that the use does not confiict with the character of the development and intendeG use of the disCrict and surrounding districts, and any additionat restrictions that Staff and the Council would sug9est. Councilmember Baumgartner stated that Staff should be asked to go around and get defi- `" ~nitions from other cities on saunas and rap pariors, and then ask the attorrtey to conte ~up with the prqper wording. Offlciai Rose reported that the Council approved the minor subdivlsions Por Mr. Staples, Mr. Neinand and Mr, Westling, and the ordinance change to 75' froatages. Of°icial Rasa reported that the Councii had tabled Pro~ect 1978-5, the Mounds 41ew I' Squere addition and ~tarlen addition, and Ga1e additi~n, pending a solution to ' draina~e ptrobtems. tlfficiai Rose added that the Councll hau executed an agreement with tiie Ramsey County Soi1 and Water Gonservation District. Com~nission Member Glazer commanted that the traffic at the airport appeared to be getting heaW er and lower.
