approved as read.

MdNOR SUBDIVISION REQUEST OF CYRIL ZIFGLMEIEII - 8205 LONG LAKE ROAD
Official Rose reported that the app1lcant has requested to divide a tot 297.5'
long by 120' wide into two lots, the westeriy iot 187.0' tong by 120' wide and
the easterly lot 110.6' by 120' wide.
Planr~ing cans'.:ieratians include that bnth present zoning and the Comorehensive
Land Use deh~te the area as siryle famlly development. Both the proposed corner
1ot and interior 1ot meet minimum frantage and area requirements. Official Rose
added that presentiy Lapurt Drive is platted but is without fu11 Improvements.
Official Rose stated tliat Parcel A ha5 sewer and water improvements availabie
in Long Lake Road, white Parcel B has only sewer improvements in an unimpPOVed
street without water. Applicant should either petition for improvements or
agree to install them to City coAe requirements.

and water improvements is submitted and approved, or if Lhe applicant is unwiiling
to submit a pet9tion, the request be denied unless thQ appllcant intends to
make the improvements himself.
Mr. 2iegimeler stated ~hat es far as street and water services were concerned, he
did need them far~ the next lot but he wou7d tike to se71 that lok first so he
could get help financially in putting in the services,

Chairperson Haake pointed out that since Mr. Zieg7meier does have 50~ ownership of
the lsnd, he could petltion for the services and while he woutd be assessed 50~, he
could then inciude that assessment iri the se111ng price of the 1ot.
Councilmemher Baumgartner questioned the sign on the property asking for fi11 for
the lot, Orficial Rose advis~d Mr. Ziegimeier that he must have a speclal use
permit before he can put clean fill in the 1ot.
Commission Member 6urmeister questioned how 1ow the land ts. Official Rose replled
that 1t is wet and probably holds water in some areas.
MSP (Heake-Glazer) to tab7e the subdivision for a ~naximum of six months or until
a petltion for street and sewer and watEr improvements is suhn~itted and approved. 6 ayes
Chairperson i~aake asked if hir•. Zefolmei~i~ was interested in petittoning for the
irnprovemen+.s. Mr. Zeiglmeier rep7led that the street and water improvements were
necessary for the back lot but that he was not sure if he wanted to petition for
them.
Comnission Member Burmeister stated that if Mr. Zeig7meter was not certain, he would
have the s1x months to make uo h1s mind.

Official Rose reported that the appllcant has requested to subdivide a parce1
fronting llighway 10 into two 1o±s; one beSn~ 76' w{,{P by 410' deep on the wpst
side and 343' deep on the east side, and the other being 560' deep 6y 76' wide.
Planni~g considerations include that thA exTstina zoning is R-4 multiple famfly,
and the Comprehensive Plan Land Use denoCes medium density, and proposed Lot 2 has
an existing single family hnme located on it. The appiicant has no definite plans
for Parcel N1, and Parcel N3 is also owned by the applicant anA shoutd 6e required
to b~ inc7ude6 with any plan for develupment, or subdivision.
Officiai Rose stated that Parcel ;/2 meets area requirements for its present use
but has a substandard Frontage of 76', with 85' heing required, and Parcel N1,
undeveloped, meets area requirements for R-4, while its 76' wldth is less than the
100' requ~red. Sewer is availabte on the Highway 10 frontage, whtle watar is not,
~nd provides only partiat service to Parcel #2. Parcel N1, as proposed, would be
without street, sewer and water services, and a 30' road easement for th~ extension
of Knollwo~d Drive north is existing but unimproved. Official Rose added that
services, when planned for, should include the total of the undeveloped area
fronting Highway 10, and that Section 42.09, Sub. 6(1) requires ti~at atl lots of
a subdivision abut a public7y dedicated street, and Lnt 1 does not abut a dedicatn9
streat.
Mr. Halverson stated that he has a potenc;ai buyer for the house on Parcel p2.
"'~ He added that he is not sure what they wi17 be doing with the remaining land but
'~~ tfiey are interested in puttina in a dental lab and clinic. He added that he has
studie~ the Cqmprehensive Plan and feels that the property would 6e beet utilized
as comnercial property.

~ Chairperson Haake stated that there were several problems with the proposed subdivislon
such as the Comprehensive Plan, lot frontages and so forth, and that she would tike to
see the issue tabled to a11ow time to study it.
Mr. Halverson stated that he would a15o like it studied, which would a11ow him time
to decide how to best utilize t~~e property. Official Rose added that it could be
tabled and Staff eould undertake the task of Figuring out how tc service the property
with streets and impr~vements.
MSP (Haake-Burmeister) to table Che request of George Halverson until they come up
with a feasible alternative on how to service the property. 6 ayes
Commisston Member Glazer stated that the issue of zoning should aisu be addressed.
Official Rose replled that with unique parcels such as this, quite often the str?et
tayout will dictate the use of the 1and.
Mr. Haiverson asked how long it would be before the issue Would be befure the
Planning Commission agaln. Officiai Rose replled that it wou7d be one or two months.
Chairperson Haake left the me2ting at this time.
VARIANCE REQUEST OF TOM KOSEL - 5449 ERICKSON ROAD
Official Rose reported tiiat the applicant has requested to build a~0' by 6' additfon
~ to hts kitchen and family ruum at the rear of his existing home. The proposed
addition would be 29' from the lot 11ne, requiring a i` variance. A71 the other home
setbacks meet the minimum requirements. Official Rose added that the lat is only 100'
deep, wMie having a frontage of 165', with 100' being a ninimat lot depth.
Official Rose stated that the home, due to its placement and its minimum depth, requires
a variance for an addltion of more than 5', and thc~t cor.struction additinns are
generally in even feet.
Mr. Kosei stated that he was asking for a 2' variance, nnt 1', as he had measured
the property and f~und he would be 1'8" too close to the lot 11ne. Official Rose
replled that Staff had measured the lnt also and determined the addition to come to
29' fran i:ne laC iina and only requ~lring a 1' veriance.
Mr. Kosel added that he plans to put on a small addition on the back of hfs house to
~nlarge the kitchen and family room, and that he had spoken to his neighbor to the
rear, who had no problem with the proposed addition.
, Commisslon Member Glazer asRed if a 20' by 5' addition wouid be acceptab7e, thus ~
not requiriny a variance. Mr. Kosel r~eplied that it would not be, as it would be

~ 7-11 FOOD STORE - VARIANCE REQUEST ANO CONDITIONAL USE FERSdIT,
g Official Rose stated that he had received a ca11 from David Schaak at 4:10 PM,
saying that he and his staff had noL been eble to get tngether and prepar? for the
meeting and that they would not be attending the meeting, Official Rose stated
that he explained to Mr, Schaak that if he did not appear before the Planning
Comnission that evening that he would be waiving his right to appear before them
and give them his input regarding the request and that 1t was the Plannin9
Commissions right to make a recommendation to the Council, even if 7-I1 did not
appear, and that h1r, Schaak had stated that he understood and agreed to giving
up his right to appear before the Planning Comnission.
Officiai Rose reported that a hearing is scheduled at the September 25 City Council
meeting on the issue. Ne added that Attorney Meyers had concurred wfth hlrn on 7-11
givir~y up their right to appear berore the P'lanning Commission.
Officiat Rose explained that at the February 27, 1978 Council meeting 7-11 hiad been
instructed to submit a report with tnformatian thr Cauncil wa, requesting, and that
when Staff reviewed tt~e report, they did noC feel it was adequate and ordered an
impact study, and that,MldwAst Planning's conclusion was that the request from
7-]1 6e denied for many reasons. Midwest P7anning also recommended that the City
review the sa'le of convenience foods, which is not permittr,d, and dnwn zoning the
land.

' Commission Member Burmeister rep~rted that she had previausly asked Offtcial Rose
~ --~ for background information on the interser.tion of County Road H2 and S11ver Lake
koad and lraffic problcros th:re, and that a ietter from Ramsey County cunfirmed that
~ ~~' they did feel there was a definite Craffic problem at that intersection. Cumnission
I Member Burmeister stated that she d9d feel the pattern had been established already
~ and that tiiere were sti11 traffic problems, even with the four way stop signs.
MSP (Fedor-elanchard) to recommend tn the Council that they +_tny the rnquest of
7-11 Food Stare, 7295 Silvep Lake Road, for a conditional use permit for gasoline
sa7es, as Che proposed use is inconsistent with the spirit and intent of nzighbor-
hood co~nercial centers, tlie proposed use represents an additional non-neighborhood
oriented use on the existing 7-11 site, that with the proposed use, the 7-11 site
cannot accomnodate sufficient parking to comply with the zoning ordinance, that
the existinq 7-11 slte cannot comply with zoning ordtnance requirements pertairiing
to site dimensions and access locations for gas stations, that the existing 7-11
site is not of suYficient size or dimensior. to accommodaCe necessary maneuvering
areas and provide reasonable car stiacking spaces, and that the proposed use would
add to an already unfavorabie traffic situation on Silver Lake Road and County
Road H2. 5 ayes
MSP (Glazer-Quan) to recommend to the Cauncil that the property be down za~ted from
8-3 to B-1 as suggested by the conctusions drawn by Midwest P1anM ng, that the prop-
erty zoning is inconsistent with the spirit of neighborhood comnercial centers and
the general use envisioned by the City's Comprehensive Plan. 5 ayes ,

~ Councilmember Baumgartner stated that there is a Tom Thumb store in the City which
should also be Tooked at as it was aiso in violation of the ordinance,

~ Cortmission Member Glazer stated that there is a sign by the raceway saying that
motorcycle races are coming up, and that ho would like it req~^ested through official
channeis that the PCA come out and monttor the races for noise. tlffictal Rose
replled that they have monitored the speedway before and had not found it to be
in violation,
Acting ~hairperson Fedor asked if *he City had copies of the Metro Councii's final
report of the airport p1an. Dfficial Rose replled that he would check into it.
Commission Member Burmeister asked what the limit was on the number of cars to be
ailowed for Alexander Diversifled Sales, since she had observed many occassions
when the 1ot was extremely full. She added that she did not feel they were keep~ng
up to their agreement to have only high quality cars since they did have a truck
in the 1ot, and not a11 the cars were high quality. Officiai Rose replied that a
limit of ]3 cars had been established and that he had been observing the 1ot and
faund it to have most7y liigh quallty vehicles.

UPCOMING AGENDA AND PREVIOUS COUNCYL ACTIONS
Official Rose reported that at the last Councit meeting they had approved the vaca-
,r^~ tion of Raymond Avenue, ordered Phase 1 of Pro~ect 1978-3 and the bond sale, and

Officiat Rose 1^eported that the Council had heurd an appeal to the Gale Addition.
Councilmember Baumgartner reported that on September 5, Lhe Task Force, C1ty Council
and Ptanning Conmission wi11 be getting together to dlscuss the Task Force's f9na1
report and make comnents on it, and that the Task Force wi11 be responding to those
questions and comnents in OcCober.
