REZONING REpUEST OF WILLARD B. GRAHAM - 2515 COUNTY ROAD I Official Rose reported thet the applicant has requested rezonin~ of the property ~ from R-1 t;'R-2, in order to build a duplex of which he plans to occupy ha1f and ~ rent the other ha1f. °lanning considerations include that both the present znning and land use map designations are R-1 but the east half of Lot 11 has been developed as a duplex and the City has considered other frontages along County Road i far dup7ex deveTopment, due ta the exposure of heavy traffic. The proposed 1ot meets frontage and area requirements for R-2 construction. The propos2d buiiding pian and sfte p7an would require a 2' variance for the rear yaru setbeck, since ttiere is only 28' and 30' is required. doth water and sewer services are avallabie, and permits w917 be required for services to travel througn the St. Paul Water Works easement. Off9cia7 Rose recomnended that a development agreement include sodding, paving, concrete sldewatks, plantings, with a minimum of 2, drainage to County Fnad I and $1,OOq escrow or bond. Official Rose recomnended the rezoning request be appraved from R-1 to R-2, since this would tolerate the traffic and buffer the existing R-1 develcpment to the north. t4r. Graham stated that he couid possibty shift the proposed buiiding on the Tot, but would prefer to leave it as it is p7anned. Chairperson Haake questioned what the setback was fnr 2he dupiex next to the tot, and stated that she ~touid prefer having the front yard setback 28' rather than the rear. Official Rose replied that he thouynt Ciie se2bdck for the other dupiex ~:as 30' ~nd sYat~~ that t!!a duplex wuuld be a different style and set differently on the 7ot than the daplex nexC door. Cartmisslon Member Foss asked if the St. Paui Water Works owned the property going ~ through hir. Graham's lot. Chairperson Naake replied that Chey did. Comni;sion MPmber 8lanchard asked if Mr. Graham planned on living in the duplex once it was built. Mr. Grahain replied that he wou7d be moving in but viasn't sure how 1ong he woutd be 1lvinq therc. September 13, 1978 ~ Chairperson Naake asked how many homes there were alreedy along f,aunty Raad I. Orficiat Rose repiied that there are three that actunlly front County Road I and athers that back up to it. Comnission Mem6er Foss stated that he felt this wauld be a good use for Che land, with the higher denslty across Che street and the heavy tr~affic on I. Page 2 MSP (Haake-foss) to recommend to the Council approval of the rezoning of the pro- perty at approximaLely 2615 County Road i from R-1 to R-2 for a doubie ~uhgeiow development, as presented toni~ht. The Planning Commission also grauts a 2' variance for a front yard setback of 28 , raCher than that indicated on the plan, which re- quired the variance in the rear yard, because the extra footage is more needed in the back for a Luffer from the R-1 zoning and privacy. A development agreement shall atso be entered into with the dc~~etoper and City. 5 ayes MINOR SI)BDIVISION R~UESt OF ORVAL W, AUAIR - 6900 PLEASANT VIEW DRIVE Offictal Rose reported that the appticant has requested approval of a minor subdivi- sion creating two lots, the interior lot to be approximate7y 153' wide by 103' deep and tha corner 7ot to be 146' wide by 100' deep. Upon approval, the appiicant'plans to have the interior lot developed For a single famity dwelling. Planning considerations include that the existing zoning and land ~,e map depicts the pruperty as R-1, and the area has ueen developed R-1 and the applicant plans to continue that usage. Both lots exceed or equai area nnd fr•crtage requirements for interior and corner 7ots. The Aast lot has an existing single family home and detached garage, both of which rtteet minimum setback ~^equirements, and the west loi has both a shed and a garaye ~hich do nat meet minimum setback requirements and should be removed prior to approval of deeds if the subdivision ie granted. Offlcial Rose reported that the west lot will require e,eryices ko be brought from Pleasant View Orive by the ~wner, and an easement will be rpquired along the south 10' of the east 1ot for the conveyance of the services for the west 1ot. Drainage wi11 be directed to the stree~ and rear of the lot in a westerly direction. Official Rose recommended that the request be approved with grantinq of the south 10' utility easement on the east 1ot for the west lot, and that the shed and garage be rertroved prior to approval of deeds of covenance or before one year or the completion af the house and garage, whichever comes first. Mr. Adair stated that there is aiready a sewer stub for Che west 1ot. Comnission Mem6er Foss asked what the City would be doing in the future if some of the preperty owners to the north wcu7d want to develop the backs of their lots, and asked if a 30' eas-:ment would be taken for a,possible future road. Official Rose replled that the City had already had an infor~natior.al public hearing for the exten- sion of Piaasant View between Woodcrest and CouqCy Road H2, and that there had not been much interest expressed in putting the road'~through. He added thaC the City of fridley does r~ut plan on putiing a road through where they border with Mounds View, and without their aid, Mounds View would most likely.not put it Chrough elther. Mr, Adair replled that he woutd 11ke to leave them up for the year so his son can use th~a during construcCion. MSP (Haake-quan) to recomnond to the Councit approval of the minor subdivision request of Orva1 ndair, 6900 Pleasant View Drive, to create two lots, with the corner Tot being 14b' wide by 100' deep and the interior lot being 153' wide by 103' deep, An easement of 10' wi11 have to be given along the souCh lot lina of the corner lot for ut111t1es. The garage and she~ that would be located on the interior 1ot would be required to be moved within one year at tht maximum, or upon compietion of the house on that 7~t before that year is up. It is the recommendation of Che Planning Corrtnission that notl~es be sent to land owners along the west end af Pleasant View Dr1ve, extanding to Woodcrest, ef the date thak the minor subdi~!ision would come batoreithe Council, stating tYiat the Councii would be discussinq the new lot, which wnutd preclude any development of a road along the x~est end of the property. 4 ay~s 1 nay Coirmission Member Foss stated that he was vot±ng agai~st the rc~otion as he felt they should take an eas~>ment on tha property at this time, in case a road was put through in the future. Ne adde6 that development of the corner lot without that easement could block off any chance of putting throuph a road at a later date. Official Rose replled that if enough people are interested in having a road put through, the Council wou7d take an easement hefore granting the subdivision. r Chairperson Haake stated that the reason the Planning Comnission was requesting that `• the neighbors he notified about the posslbi7lty of a road was because this is a ~~,' Planning Comnission which looks to whaCever contingencies could be asked for in the future shou]d be thought of in the present. OUPLEX DEVELOPMENT - OMEGA MANAGEMENT INC. - 7636 WOODLAWN DRI4E OfPiclal Rose reported that Omega Management has requested a buildin~ permit for the development of a duplex at 7636 Woodtawn Drive. Planning consiAerations include t~at boCh the exi>2ing zoning and land use maps depict the area to be deveioped high density residential, and R-4 zoned d!stricts permit dupiex usage. The lot conforms to minimum area requirements while its frontage, being on a cul-de-sac type corner, is substandard. The existtng tot with its frontege can provtde ample access to Woodlawn Drive, and the proposed duplex mests minimum building setback requirements. 3oth water and sewer are avaiiable in the street, and drainage should be directed to Wood7awn Drive. Official Rose stated that a devetopment agreemee~t should include sadding, paving, con- crete sidewaiks, a minfe~m of two p]antings, drainage to Woodlawn Urive, and $1,000 escrow or bond, ~nd recommended +hat the develo~ment be approved to inctude the deve7opnHZnt considerations. Wa11y Kocemba, of Omega Management Inc, presented a sketch, showiiig what the frunt of the duplex would 1aoY, like and stated that he might yossibly be coming back soon to request a fpur-plex. t ' `~d~Comnission hiember puan stated that the property is r'ight to the edye of sane land that has poor soi;. Official Rose replied that the Staff leas looked at the property, and with the deve7opment that has occurred in the area, they do not antlcip~te any probiems wit6 development. Official Rose also pointed out thaC the actual basement floor wi11 be onty 3G" below the ground. MSP (Blanchard-Fedor) to recommend to the Council that they issue a buildiny permit for a duplex at 7636 Woodlawn D~ive, as Fresented this evening, and a development agreement be antered into between thz applicant and the CiCy. 6 ayes Commission Membor Quan stated he wants someone, such as the Ramsey County Water District, to cane out and look at the property and check it for drainage. Officlal Rose replied th&t 1f Canmission Member Quan wants assurance, he should require soil tests, since Ramsey C.ounty Water Ilistrict witl only ref~r to their graphs, snd they da not take so11 borings. Conmission Member Fedor pointed out that the developer wi17 be staying a goad viay above the water table, about 28" to 30". Mr. Kocemba atated that he had bu11t in bad soil before and would never build in it agair.. 11e added that Official Rose wiil be checkiny the footings and wi17 know if the so11 is bad, and if it is, it wi11 be taken care of. He added that he does not want to go to the expense of having the so~l checked out at this time. I~ Comnission Member quan stated that Ramsey County Water District is a free service. Coumission Member Foss replied that he did not fee7 it was a free service as all tax payers were paying for it. He added tha2 both the builder and the Building Inspector are qualified to ~udge whether the soit is baA, and that it is a waste of time to get all those government agencies involved when they wi11 not comnit themselves to any- T.hing. Comnission Member Foss added that having Ramsey County Water District come out would be a bad use af tax dnllars, and pointed out Chat the builder rould not be building a duplex in that price range without taking alt necessary precautions. Official Rose stated that a previaus addition in the City had run into peat and put pilings in. He edded that if the so17 luoks questianable, the builder wi31 then have suil tests done. Comm~ission Member Fedor puinted out that when Official Rose inspects the footings, he will know fY there is a problem. Official Rose added thaw he wi11 be at the site when the Caterpillur is there and if there appears to be a problem, he will have them dig deeper unti] they h;t buildable ground. Comnission Member quan stated he would withdraw his reconenzndat9on that the Ramsey County Water District check lnto the property. He addeG that 1f St~ff is going to inspect it, they shouyd inspect 1t for signs of organic soil and correct 1t.
