Chairpereon Haake aslced that the minutea of the March 14 meeting be /"`~orrecL•ed to ~~d a moti.on on page 1 to reconeider the pr~vious_action.of ~.~ Sebruary 2$ re~;ardin~ the motion to the Council and secommend to the ^-'Eouncil that tUeq do not reinetate the oid aoning code proviaions ae Chapter 40,06 Subdividion B(4), with the motion made by Haake, seconded by ]Burmeister, and paaeed with 8 ayes. Commiealon Memhex Quan joined the meeting at thia time. Commiesion Member Freewore aeked that the March 14 minutes be clarified on page 5, aecond paragraph, that he was only addreasing the parking eituation and impervious surface, noe the asthetics at that time. Commiaeion Member Fedor aeked that paragxaph 8 on page 5 be clarified to etste that the applicanta ahould realize that a city-wide storm sewer eyetem wae ~uae turned down by tha City and that he did not forsee a eyetem baing approv~d in the near future, und ttiat ehe applicante ehauld plan thair on-site retention ae being permanene. Cammisaion Member Goebel aalced t~at tha nineth paragraph on page 5 he changed to reflect that he had recommended the applicanta conaider a gravel filled ditch to increase infiltrecion. Neil Loeding, 5046 Longview Drive asked if the firat paragra.ph on paga 5 wae correct. Chaisperoon Heake pointed out that thP ordinancc allowe 218 equare feet for garages and that Mr. Pa~ak's exieting garage in 277 equare feet, Commisaion Member Fedor aeked why a building permit hsd been i,aeued tor Cwo garages on the lot. Official Kooe exnlained that it had been iesued by a former member of the Building Staff, approximately 3 yeare ago. Co~iasion Member Burmeieter pointed out that they have requ.tred people in r"'+~,he pase to either take the acceseory garages down or cut them down to ~ ize, Mr, Pajak repl3ed thaC he wauld be willing to put a amaller door on `~--~t and that he could cut it down to eize but that it would be coetly. Commiesion Member Fose pointed out Chat a policy hae been adopeed Y.o split lota ia half, wherever posaible, unless a definite hardehip was ehown. He added thst in mauy i.netancea, people have been required to remave garages. He also atated that the applicant should be requir.ed to line up with the neighbora. Commiaeion Member Goebel asked what condition and age the gaxage was in. Mr. Pajak replied that it ia very nld but well built, Officia7. Rose reported t•hat Che lot to the north has been aubdivid~d, pro- dueing e 239' deep eaet Iat and a 234' deep west lot, with it being en equal aplit. He slao etated that a uinimum 5' utility easement ehould be granted along the rear loe liae~, and that the garaga on the propoeed west lot exceeds the 5' eetback requirement, although it does face enet. He added that both lote are buildnble and serviceable. She stated khaC Mr, Pa~ak ehould be required to take the garage down or cut it down to meet code. She elso atated that ehe would agree to moving the lot line cloaer to the ~ garage to bring it closer to an even lot eplit, ~ f Commiaeiun Member Glazer etated that he did not see that many probleme j with the deve'!~pment. I Commieaion Member Fedor etated that he cculd not see how the lot line could ~ bo moti~ed to within 3' nf the garap.,e i.f a 5' eaeemenr. was required, aa the ± garage would be 2' into the easement, ~ Commfeaion Diember Goebel atated that it was difficult to aelc a pereon to ~ move a building but that a 3' or 5' offset in the middle of the people ~,rqould cause probleme later. He added that it would be wiser to divide ~e lot in the mi3dle, especially aince it will be a long term, permanent ~ `^^fleciei~n. He also recommended that a amaller door be put on the garage. ~ Commiesion Member Freemore atated that he did nat see any major problems with an uneven lot split or with the exieting bullding. Commiasion Member Foea added that banka and mo:tgage inatituttone require a r.lear title eo propezty and rarely would grant £inancing with an unclear title. They ehowed the planned development by phaae.e and a total ptcture. Commiaetan t4ember Burmeieter asked if the houae oti the lot would be removed. Mr. Budzynaki replied that it would, Mr. Mathern stated that the drainage would be completed in Phase 3 of the development. Officinl Rase reported that 5taff had looked at the properCy wi.th xeepect to run-off, huilding space, parking epace and so forth and addresaed a 100 year, 24 hour rain of 6" to determine what it would take to handle such run-off. Cnmmiesion Member Goebel etated that Che buildings would generate extra rua-off and a 1tl0 year atorm would cause probleme. He reca~ended that ~1ey address the proUlem of putting 3n impervious eurface and where the ter is going to ga. There wae coneiderable discussion between the Planning CoTmnieeion, Official Rose and the applicante ae to how to handle drainagQ for the devalopment. Co~niasion Member 8oebel replied that he would like to see them tnke care of 40-50% of the run-oEf without going off the property. !ie also recommended that the npglicant plan on k~eeping 75-80% of the wate: from 1" of 2" raine within 3 to 4 honre on elte, or E" over 24 houre, taking 60%. Aeting Chairperson Fador stated he would like to table the diacuNeiou until the City can contact an engineer foz his reco~rmoendation.
