Members Present, Commissioners McCarthy, Haake, Loeding, Fedor, Miller, Breske, Chairmar. Mountin. Alen Present, Mayor McCarty, Councilmembers Forelund and Hodges, Building & Zoning Official. Rose, Clerk -Administrator Pauley. Members Absent: Commissioners Glazer, Warren - absences excused. Point of Order: Loading questioned the legality of the Ccmmission's Cali to Order and conduct of business when the official City signboard indicated that the December 3, 1980, meeting had been cancelled. Chairman Mountin directed Clerk -Administrator Pauley to clarify the legal point with Attorney Meyers. ( lotion/second: Miller/Breske moved to approve the '---"November 5, 1980, minutes as written. 5 ayes 0 nays 2 abstain (Haake, Fedor not present 11/5/80) Applicant requestsapproval of a conditional use permit for a convenience food establishment (Mr. Donut) development. Official Rose presented the planning cosiderations regarding the Northwest Associated Consultants' report, storm water retention/detention requirements, traffic issues, present code requirements and alternatives, and staff recommendations. The Planning Commission had previously tabled the request September 1, 1980, and referred the developer's proposal to the City's Planning Consultant, Northwest Associated Consultants Inc. Motion/Second: McCarthy/Haake moved to take the Brooks Superette Development Proposal, Case 64-80, from the table. ayes 0 nays Regular Meeting December 3, 1980 Mounds View City Hall , Mounds View MN 55112 1. Brooks Superette,Inc. 2390 Highway 10 Development Proposal Case 64-80 MOTION CARRIED MOUNDS VIEW PLANNING COMMISSION Page 2 Jack Welch, representing Brooks, stated that the developer is not interested in attaching the Mr. ( '90nut facility to the Superette as the business could be under separate management, they are of entirely different commerical uses., and attach- ment would pose traffic flow problems. Summary of Discussion: What is the feasibility of subdividing the parcel into two separate lots. Has there been a change in the City's position concerning P.U.D. lot size requirements that would warrant a code revision. Motion/Seconds Haake/McCarthy moved to recommend to the City Council denial of the conditional use permit for the property located at 2390 Highway 10 as it is not in conformance with existing Municipal Code requirements, 40.22 Subd. C (2b and 3b) and 40.04 Subd. C. 7 ayes 0 nays Applicant requests approval of preliminary plat called Miller Industrial Piat and rezoning of the 0-"1and which has presently sections of R-1 and B-3 1lo I, 1 for development of an industrial park. Official Rose stated that Mr. Miller had been informed of the Commission's December 3rd meeting, but since the Rice Creek Watershed administrative approval and thereports from the City Attorney and Engineer were not yet available, Mr. Miller requested that action on his proposal be tabled until December 10, 1980. Motion/Seconds Fedor/Miller moved to table Case 47-80 to December 10, as requested by,the developer. 7 ayes 0 nays Official Rose clarified the 60 day time limit requirements in the review of a development proposal. Commissioners Haake and Miller left the meeting at 9:40 p.m. Motion/Seconds Breske/Loeding moved to table the review of Chapter 32 until December 10, 1980. ayes 0 nays Regular Meeting December 3, 1900 MOTION CARRIED. 5.
