the amended propoaal of. Sahara Inveatme.nt
Company to build a 3,600 eq. Et. building for
benkiag purpoaea only.
Mr. Erir_kao» revie~red the pzoposal, pointing
out thaC the bank had received conceptual
approval for a 20,000 eq. ft building in 1979
and they were now back with their final platt
for a amaller facility. He aleo atated that
~more landscaping was now planned than had been
nrigi.na7.ly approved, and pointed out othec
identical features to the origir.al p1an, auch
ae parking, access, etc,

for the future building. Mr. Erickson replied
that it was envisioned ta be an expansion of
the bank, and Chat iC would definitaly fall into
the B-2 zoning use.
Coomnissioner Warsen nleo ex~resaed concern about
gas fumes from the drive-in facility becoming a
nuieance to the neighbors, and aeked for a clari-
ficatlon of ~he screening, t1r. Erickann reglied
that he did not feel. the umount of gae fumea trom
the vehiclea at the bank would preeent any change
over what was already exieting on Nighway 10. He
alao etated Chat the ecreening had been detarmined
to be adequate.

proposal d±d not meet the requirements of Rasolu-
tion No. 983. Offie:ial Rose replied that the

of storage.
Mr. Eriakaon aCated thst he would like an opportunity
to d3:scueu the requirement with the City ~ngineer.
Cormnisaion Breske asked if the letter from the Fire
Department had been addreeaed, regarding ]~ydrante and
aprinklers. Official Rose replied that it wou18 noC
be a problem ae they were raquired by the code and
the applicant aould not get approval or a building
permit without meeting these raquirements.
Commieeioner Breske asked if ary trees would be planted
that would reanain gree¢~ year round, Mr. Erickeon peinCed
out that all acreening was called out on the new plan,
including aize and apec.
Oommissioner Glaaer added that the only tree that wauld
remain green year round would he effected by the eaYt
uaed on the roads during the wintez, and thus would not
be euiCable.
Chairperaqn Mountin asked if e redwood fence would bE
adequate soreening, in addition to the shruba on the

Mr. Erickeon added that the plantinga woald genexally
be more apgealing. Chairperson Mountin stated that

Mr. Winniak pointed ouL that the original plan had
~ oallad for e two srory building, which had basn
~approved, and that they w6re now propoeing a one
etory building. He added that puttinq in a fence,
in addition to the proposed screening, would add to
the cost. He also stated that they would try to
retain as muah oE the naturel plantinge as poseible.
Commiesiones Narran eiataQ that she was aoncerned
with the exit onto Highway 10, qoing to the west only,
Ms. Erickeon replied that two extenoive studiee had
been dona, which determined that it would not preaent
a problem, and he also pointed outi Y.haC thera would
be lesa traffic than with the oriqinal propo~al.
Chairporaon Mountin reviewed Rasolution No. 29-81,
regardl.ng the propoeal.
Commieainner Glazer read a piepared statement expres-
sing lengthy opposir.ion to the drive-in bank facility
propoeal. Although'he stated he would yo along with
a motion in ita favor, 1E ne,oessary to get a reaoluti~n
allowi;ig for a publia hcarinq an3 re=_j.3ent input on the
matter.
Commieaioner Millar asked that an item 6 be adde3 to the
~ reaolution, to rQAd "The 9rading plan be altesed so as
~~ to provide 0,46'acre feet of atarage (22,000 cubic feet)
with.,a combined outflow fzom tha ponding sites of 1.0
cubio feet per aecond. ~fhe two ponds ahould be inter-
connected so that one pipe would ba the control struc-
ture to ~ha highway ditch, and the outlet pipe ahould
be rainforced concrete pipe."; as recommanded by Dan
Boxrud. ,
Official nose atated that Mr, eoxrud w~s addressiny the
development as a whole, whereae Mr. Erickson and the
Rice Creek Waterahed Dietrict were addreasing it as an
individual development.
Cauneilmember Forelund asked that the reaolution be
ahanged on hhe 4th "Wharea~" to indicate that the City
had received tho plan on October 15, 1979.
Chairperson Mountin stated that the developer has been
informed that future development of the praperty will
require a aubdivision. Mr. Erickaon asked if a re-
zoninq pr~cess wae necessary for duwnzoning the property.
Chairporaon Mountin :aplied that the Planninq Commission
would like the developer to inStiate a requeaC for down-
zoning. official kose added that rho bankinq Eaoility
ia allowable in 8-'s zoning as well as in e•-2, and that
,' ~the developer could petition for downzoning.
~~Mr. Erlekeon atated that he felt he was getting negative
foedback from the Planning C~mmiaeion on the naw propoeal,

which wae an improvement over the original one.
Cha.irpereon Mountin replied that thmy would hava

Mr. Winniok aeked that it be noted that the daveloper
had not requeated a rezoning, and that it was being
required by the Planninq Commiseion.
Chairperoon Mountin replied that it was requaeted to
proteat the area, and that tlie Planning Commiesion
would like it downzoned, and th~y want to ineura that
a mure intense uae is prohibil•ed. Sha added rhat e
publ~c haaring would be required with any rezoninq.

tion to the bank pr~poeal at this time, expleininq his
votg ae a pragmatic etap to get wording that would
facilitate a public hearing on the isaue. He falt
~hat conaeasion was necessary be~ausa a motinn to paes
the resolution by the reat ~f the commission aeemed
~robable in ar.y event.

Wayne Herr, of Wayne Herr Construction Company, gavu eity Rasid~ntial
a presentation of his proposal, and oxplained what a Case 89-81
home ownera asaociation does in maintaining aondominl-
ums once they are built.
Dou,q Dinndorf, 2901 Oakwood DrSve, asked to remind
the Planning Commisaion that this was basically the
same type of development that had bsen proposed
before, and that the Compreheneive Plan calls for it
to be single Eamily and medium deneity development.
He stated he wae ~fraid tha'_ the property to the east
would be developed in tho same manner, thus putting
approximately 80 units in a~mall area and deyradiny
property values in the neighborhood for eingle family
homes. Chairperaon Mountin replied tliat they must remem-
ber *he legal rights of the property owr.er to develop the
property as is called for by the present zoning.
~ric Emeraon, 7865 Spring Lake Road, aeked if the City
r,ou2d compensate the property ownera in a rezoninq. Offi-
cial Rose replied that it wae a legal question. He added
that tha Comprehaneive Plan takes tirae to implement and
~ that the Met Councii muet approve it first, He explained
that the propexty could be rezona@ ei.thAr at the requeat oE
the property awnare or by the request af the Planning Com-
misaion to the C1ty Counail.

" Janet Schuldt, 7887 Spring Lake Park Road, stated she
ovned a deep lot that would be Iand-locked if the develop-
menC wae allowed. She also poi.nted out that a petiCion
had been submitted to the Covncil in 1979 by the property
ownere, aeking that a~oint eaeement oE 30' be eaken from
both the davelopere and property ownera to allow a road to
be put 3n.
Official Roae replied that becauae of the considerable
dePth uF the lots, iC would be poesible to run a cul-de-eac
in, wlxich would allow development of the loCS. He also
pointed out Chat Spr±ng Lake Park would have ta be w111ing
to participate in order to put a rond in to go out to
kiighway 10.
There wae considerable diacuasion with the property ownera
predent about the easement that they had raqueaCed in 1979,
with the opinion of Che Planning Com~ias3on and 3taff that
it had been for the original propoaal only, which aae ne•ver
approved, and thue the easeanent wna never approved or taken.
Concern :vas also expressed that a cul-de-sac would juet
provide another road for the reaidents of the r.,ondiminiums,'
Mz~. Herz ezcplained that the condominium ownera would not
,~ be using that road ae their garegea would be on the otEier
;aide of the buildings, and the secur.ity doore would not
~--'allow them to enter from the cuL-de-sac side. Msyar McCurty
eugges*_~ed that the pxoperty ownere again petition the City
for an easement on the new propoaed development,
Mr. Dinndorf asked what type of buffering w°itId be provided.
Mr. Herr replied that he would be using tre~s, and cauld
put fencea up between Che guragea, tu buffer that eide also.
Wally Schuldt, 7887 Spring Lake Park Road, asked what would
happen to the run-ofE, Official Rose replied that there
would be a controlled outlet.
Mra. Schuldt• aeked if an easement would be provided along
Hip~hway 10. Mr. Herr replied that he had adequate room
to provide that easement.
Commisaioner Andereon asked if the problem that the Fire
Department had noted ha3 been cleared up yet•, oE a~equate
aacese for emergency vehicles. Mr. Herr xeplied tiiaC it

Mayor McCarty suggenLed that it be clarified if the pxo-
p~aal should be conaidered as separate eubdivieione,
eince there wou?.d then not be enough roam.
