WHEREAS, tho Mounda View Planninq Commisain has reviewed the
developmant request of Mr. Norb Yenish to construct a 98-unit motel
(~0 unita in Phase Z, an additional 28 uni.ts in Phase II) qnd a major
aubdivision, 1 lat into 2j and
tQHEREAS, the Mounds View Planninq Com;nission has recoived and
raviewed the repnrt from City ataff reqarding hhis requesti and
' WNEP.EAS, the existin9 zoning of the nroperty i.s B-3, Iiighway
Busl,ne3s Districtj and
WHEREAS, the Comprahensive Plan deaignates the property ae
Highway Commercial/industrial ~.U.D.; and
'viH£RGAS, the proposed use conforms to both the existing zoning
and the Comprehanaive Planj and
^. WHEREAS, the pra[~~aal meet~ Zoning code req~tiremants for lot
'~ i size and screeningt and
WHERE1i5, modific:alion tc thc~ site Plan is neeessary to mai.ntain
a five foot setback between purking lot and property line;
WHEREAS, it is recommended that the proposed ponding area on'
Lats 2 and 3 be used foz thi.s motel development in addition to all
future development on any lot in Block 3~ Programmed Land First Addition,
and such ~,ond should be of sufficient size to accommodate tbe storm
water generate by 'the devalopment; and °
WHEREAS, the Block 3 drainage plan has been reviewed by hhe City
Engineer and determined ro ',~ in conformance vtith Chapter 49A; and
WHEREaS, the Planning Commieaion has addresaed the issuas oE
aacess t.o adjoining properties to the north of thi.e deveJ.qpment and hae
accepted tha axist•ing 66 faot stre.et right-oP-way accaes ae ahown oq
the Programmed Land First Add3tion plat ae a means to provide access to
these properties; and

Land Cirst Addition.
2) The exislinq skimmer be modifi,ed to allow emargenoy
overfloc~ in the event that tho skimmor ;.nlet bocomes
pluc~ged or frozen.
3) Tha developos wi1T6e respunsible for the performance arid
' maintenance of tha akimmer for tha sEandard 7-year period.
4) Rice Creek Water.ahed Diatrict approval.
5) That approval is granted for a phased type of development
whera initial construction shall consist of 70 units with
adequate pax~king as Phase I and an additional 28 unite
(98 unite total, with additional adequate parking baing
providad) as Phase II.

of dimensional requirements of: thc Zoning Ordinance to
further purnosc~ of Chapter 48.
~ NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planninq
Commission recommends to tha City Council approval of a,minor aubdivt-
sion combining two lots under conaideralion into one.
BE IT FURTHER RESOLVED that contingent upon approval being
qiven to combine the two lots into one and the applicant recording

Planning Commission recommends to the Mounds VieH CiY.y Council the
