Director Thatcher reported that the Planning 5. Kinder Care
Cou~iesion had reco~ended hiring David Licht to 2291 Highway .l0
do an analyeis of the eite in question, end Caee 156-84
anewer questions and concerne the Planning Coffiiseion
had. He advised that the devaloper hae provided the
$7.,000 bond, and Mr. Licht has submitted hie report,
Mr. Licht, of Northweat Asaociated Consultante, Inc.,
reviewed hie report concerning the Kinder Care proposal,
and resented the proposed site plan. He summarized,
etat~ng they would reco~end approval of a conditional
uae permit eub,ject to a noise barrier being provided,
sdditional landecaping, the traeh encloaure being
relocated 15 feet west, a loading berth being desig-
nated, a variance being granted to exempt the parking
~ and loading area from eatback requiremente, and the
cenCer beittg in conformance k~i.th the rules and regu-
latlone of the DPW Rule No, 3.

Mr, Licht etatQd that in reeponea to concern about

traffic on Highway 10, that vegetation along Highway 10
would make no noticeable dif£erenca, and ehat a eoli~
barrie.r would be required Co cut down the noise. He
edded that the trafPic patCerns and etop lighte would
increase the amount of emmiseione in the air, but new
Highway 10 ~hould have a draetic impacC on reducing
them.
In response to safeCy concerne, Mz. Licht aCated the
area would be cowpLetely fenced and the ohildren
aupervised at all timeo Ly Che center's stafE,
Mr, Licht reported they have analyzed the dszta avail-
able for the impa~t on tzaffic, and they do not feel
it wi11 present a problem. 1'he bank traffic is not
r~ grESt aC thia t~e, and the houzs wh~re•the pax~nts
;,~j will be caming and going should not create a probLem.
Director Thatcher added that the development agreement
with th~ bank requirements them co install a right
turn lane i£ traYfic on Red Oak Drive hecomas a problem.
The'Commissionere asked if a raised barm would haVe any
effect on the Hillview eide. Mr. Licht replied that a
very gentle slnpe is required, and tfiere ia not enough
room on the property to do that.
Robart Bors, the repreaentative From Kindez Caxe, atated
they would be willi.ng to move their fencing inside the
shrube and trees, for safety reasons. He also advised
thar Kinder L'are had r.ecently developed in Cottage Grove,
on a Preeway ramp, and the PCA determined it was not
neceesary to teat the noise levels there,

Jerry Jensen, a repreeeneative of Holiday Station
5toree, reviawed their proposal for tha property
now occupied by Northeaet I3arine.
Chairman Mountin noCed tha CiCy Counci.l was in the
midee of conaid~ring thie property for rezoning co
medlum densiCy reeidential, She noted the Compre-
hettsiWe Plan would require a ma~or revision to
accomodate thie type of development.
Thpre was discusaion a~on ~he Co~mtisaioners re~
~.. garding reeolving the con~lic.t with the Comprehensive
i Plan, end whether there was a demonstrated need in
~' the coumunity Eor thia type of development. Chairman
Mountin reminded tha Coumiesionera that when the
zoning ia proper and the applicant can meet all the
requirementa, the conditional uae permit ahould not
be denied.
Mr, Jenaen etated thia wea the fourth time they have
been before the City, and each time they have come
in prepared wi.th what ia required, they have been
asked to wait gnother meeting. Ae stated the
conatructien aeason is getting very short and asked
how long it would be before the City could provide
them with an anewer.
Chai.rman Mountin noted they must resolve the conflict
wiCh the Compr.ehensive Plan. She aiso ataCed they
will ttot eend a developer to the planner if they
intend to deny the request.
In response to the 1'lanning Coa~iasion's inquiry,
Mr. Licht st&Y.ed it would talce langer to reView thie
development than it 31d to do Kinder Care, as it is
more complicated, but they could have a preliminary
report out two weeka nfter. they had received authori-
zation to do i.t.

indicated an interast in purchasing some of his
propcsrty .
Chairman Mountin nuted the applicant would require
two vartances, one for facing Hillview and one £or
Che eetback. Upon discueaion, the Commiseionera
concurzed that I4r. Orr would be able to move the ,
house back to b~ in conformance with the code.

RESOLUTION APPROVIN6 THE DEVELOPMENT PROPOSAL OF AN
ADDITION, PHASE 2, 2159 MUSTANG DRIVE, BAUER WELDING
AND METAL FABRICATORS, MOUNDS VIEW PLANNING CASE 101-81
WNEREAS, Mounds W ew Code, 69.07, requires the review of the proposed
eddition, Phase 2, to 2159 Mustang Drive; end
WHEREAS, the Mounds View Planning Comnission has rsviQwed the propased
addition, Phese 2, on August 1, 1984; and
WHEREAS, the Mounds View Planning Comnission has reviewed the original
submission which lncluded the addition, Phase 2; and
WNEREAS, the original approvai of ttie development was under a previous
Zoning Code; and
WHEREAS, the Mounds View Planning Comnission finds that the praposed
add9tlnn, Phase 2, is similar to the originel proposal and in keeping with tho
spirit and intent of the Zoning Code requirements;
~- NOW, TNEREFORE, BE IT R~SOL4ED that the Mounds View P1anM ng Comnission
recamnends approvel oP the site ptan submitted December 15, 1981, in a devetopment
agreement executed to include the following:
1) The following items should be exhiGits of ihe development agreement:
a site plan
b grading plan
c final ptans and specifications
d legal description
e Ordinance Plo. 49A requirements
P} Ordinance Na. ~9A 7-year security
2) A security in the amount of E10,000 for the site lmprovements.
3) The foliowing Exhibit 2A condltlons should be inciuded:
a) payment of ali City expenses witM n 30 days.
b) Provlde additional parking if necessary in future to meet area
Code requtrements;
BE IT FURTHER RESOLVEO that the Mounds View Planning Commtssion directs
staff to forward this resolution to the C1t~ Council prior to approval of the minutes.
