MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 102-84 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RECOMMENDATION TO THE CITY COUNCIL REGARDING PLANNING CASE 148-84, CHRISTOPHER COMPANIES WHEREAS, Mr. Chris Anderson of Christopher Companies has requested City approval to construct a 133 unit apartment within the City of Mounds View~ and WHEREAS, construction of these apartment units as requested would require approval of a major subdivision (combining 10 lots into 1), flood plain use permit, right-of-way and easement vacation, residential planned unit development/conditional use permit, and development approval~ and WHEREAS, the Planning Commission has reviewed the staff report along with information submitted by the applicant which includes the following: a) development and landscape plan b) site survey c) site grading and utility plan d) project summary e) illustration of similar character proposed for the project f) evidence of site control g) storm water management calculations h) location map; and WHEREAS, the Planning Commission has also reviewed this proposal for conformity to all relavent chapters of the Municipal Code, specifically Chapters 40, 42, 49 and 49A and State Statutes; and WHEREAS, this proposal meets all requirements of Chapters 40 and 42 of the Municipal Code~ and WHEREAS, a permit has been obtained from Rice Creek Watershed District~ and WHEREAS, Mr. John Johnson, the City's consultant engineer has reviewed the plans and finds that the following items need to be resolved in the final submission and approval: a) The watermain sizing and looping must provide adequate fire flow. b) The interim storm drainage plan appears to meet current Chapter 49A requirements but long term area-wide drainage impacts may result in additional ponding storage being required. . . . RESOLUTION NO. 102-84 PAGE TWO OF THREE c) Per the requirements of Chapter 49.07, Subd. 4(a), notification to the Commissioner of Natural Resources should be made prior to submittal to the Council; and WHEREAS, the sanitary sewer system proposed appears to meet the City of Mounds View criteria~ and WHEREAS, easements for drainage purposes shall be provided and recorded per the plans submitted~ and WHEREAS, the Fire Chief has reviewed this development proposal for conformity with all applicable fire codes and finds it to be in conformity with all fire codes reviewed; and WHEREAS, the Rice Creek Watershed District has reviewed this proposal and finds it to be in conformance will all Codes and regulations of the Rice Creek Watershed District; NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission recommends approval of the request by Christopher Companies of the following: 1) A major subdivision combining 10 lots into 1 lot. 2) A conditional use permit allowing the extraction of materials within the flood plain zoning district. 3) A flood plain use permit which allows the excavation/ placement of fill within the flood plain zoning district. 4) Vacation of the existing 10 foot utility and drainage easement between existing lots 7 and 8. 5) Vacation of the existing 25 drainage easements (Document No. 163496) between existing lots 4 and 5 by relocating and expanding the easement north of its existing loca- tion to the detention basin area. All open areas east and west of the garages located on the north end of the property, and all property to a distance of 200 feet north of the northern most surface of the garages located along the north end of this development in addition to the exsting 17.5 foot easement along the west property line shall be easemented. (See map for easement location.) 6) Vacation of the existing St. Stephen Street right-of-way from Bronson Drive to County Road I conditioned upon the retention of storm water drainage/storage easement should it be determined to be necessary for future storm water drainage/storage by the Storm Water Management Plan. The existing right-of-way west of the center line shall revert to and become part of the Nordling Terrace plat and the existing right-of-way east of the center . . . RESOLUTION NO. 102-84 PAGE THREE OF THREE line shall revert back to and become part of the property owned by the Sands Apartments. 7) A conditional use permit for the construction of the development proposed using the residential Planned Unit Development sections of the Municipal Zoning Code; BE IT FURTHER RESOLVED that notification to the Commissioner of Natural Resources be given of the conditional use permit prior to submittal to the Council for public hearing purposes; BE IT FURTHER RESOLVED that a development agreement be entered into between the City and the developer which includes the following provisions: a) Exhibits: 1) site grading and utility plan 2) site development and landscape plan 3) site survey 4) color photographs of proposed development 5) easement map 6) legal description 7) Ordinance No. 49A 7-year performance bond of $1,000 8) building plans and specifications b) Security for the development in an amount to be determined. c) Exhibit 2A to require the following: 1) Payment of all City expenses above and beyond amounts previously submitted. 2) Other items as may be required by the City Council. d) Fencing, not less than 42 inches in height, be constructed from the ends of the northernmost garage building to the east and west property lines with a gate for snow Temoval purposes. BE IT FURTHER RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 7th day of March, 1984.
