MOUNDS VIEW PLANNING COMMISSION
RESOLUTION NO. 116-84
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RECOMMENDATION TO THE CITY COUNCIL REGARDING
MOUNDS VIEW PLANNING CASE NO. 156-84, KINDER CARE
WHEREAS, Kinder Care has requested City approval to
construct a day care facility within the City of Mounds View; and
WHEREAS, construction of this day care facility as
requested requires approval of a minor subdivision (combining 2
lots into 1), conditional use permit, and development approval;
and
WHEREAS, the Planning Commission has reviewed the Staff
Report and has reviewed a report on the development by David
Licht of Northwest Associated Consultants, Inc., along with
information submitted by the applicant which includes the
following:
a) Development and Landscape Plan
b) Site Survey
c) Site, Grading and Utility Plan
d) Project Summary
e) Evidence of Site Control
f) Location Map; and
WHEREAS, the Planning Commission has also reviewed this
proposal and it is in conformance with all chapters of the
Municipal Code, specifically Chapters 40, 42, 49 and 49A and
State Statutes; and
WHEREAS, this proposal meets all requirements of Chapters
40, 42 and 49 of the Municipal Code; and
WHEREAS, Rice Creek Watershed District will review the
development prior to construction; and
WHEREAS, a variance for parking in the front and side
yards due to the hardship of the shape of the lot has been given;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends approval of the request by Kinder
Care of the following:
1. A mlnor subdivision combining 2 lots into 1.
2. Placing the tot lot on the Hillview Road side of the
building.

3. Placing shrubs and trees as outlined in David Licht's
report outside of the play area.
4. If the City Engineer approves, the proposed 24 foot
wide curb cut is acceptable rather than 22 foot
required for residential property.
5. The developer shall install a noise barrier in the
future according to state standards if the noise is
above state standards.
6. The Comprehensive Plan should be amended.
7. Screening, trees and vegetation shall be provided
according to David Licht's report.
8. Provide screening and install all landscaping according
to David Licht's memorandum.
9. Move the trash enclosure 15 feet to the west according
to David Licht's memorandum and City Ordinance which
specifies a 55 foot length for a loading berth.
10. Additional landscaping shall be provided as indicated
in Exhibit E of David Licht's letter.
11. The variance is to exempt the parking and loading area
from setback requirements;
12. The principal structure must be insulated for sound
according to federal and state standards.
BE IT FURTHER RESOLVED that a development agreement be
entered into between the City and the Developer which includes
the following provisions:
a) Exhibits:
1. Site, Grading and Utility plan
2. Site, Development and Landscape Plan
3. Site Survey
4. Legal Description
5. Ordinance No. 49A 7-Year Peformance Bond
of $1,000.00
6. Building Plans and Specifications
b) Security for the development in an amount to be
determined.
c) Exhibit 2A to require the following:
1. Payment of all City expenses above and beyond
amounts previously submitted.

2. Other items as may be required by the City Council.
3. Kinder Care shall construct a noise barrier
according to City Code if the noise is excessive
according to State Standards.
4. A shared parking agreement between Kinder Care and
the church on the northeast corner of Red Oak Drive
and Hillview Road.
BE IT FURTHER RESOLVED that a conditional use permit be
granted which includes the above items;
BE IT FURTHER RESOLVED that the Mounds View Planning
Commission direct staff to forward this resolution to the City
Council prior to approval of the minutes.
