MOUNDS VIEW PLANNING COMMISSION
RESOLUTION NO. 140-85
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION DENYING THE VARIANCE REQUEST FOR 2840 OAKWOOD DRIVE
WHEREAS, there exists on the southeast intersection of
Oakwood Drive and Knollwood Drive a house which faces Oakwood
Drive; and
WHEREAS, Mr. Boyles, the property owner, requests to
build an accessory building six inches from his property line;
and
WHEREAS, the accessory building is proposed to be 128
square feet; and
WHEREAS, the accessory building occupies less than 25
percent of the rear yard; and
WHEREAS, the accessory building is less than 15 feet in
height; and
WHEREAS, all of the setbacks on the site are satisfied;
and
WHEREAS, there are reasonable alternatives for providing
privacy; and
WHEREAS, there are reasonable alternatives for a location
for the accessory building; and
WHEREAS, the hardship was self-created by Mr. Boyles
by installing a new deck in his back yard; and
WHEREAS, there is a lack of uniqueness for this variance
request;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission denies a 4.5 foot variance request on the
rear lot line at 2840 Oakwood Drive.
