MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 141-85 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A VARIANCE, RECOMMENDING APPROVAL OF A MAJOR SUBDIVISION (2 LOTS INTO 6 ZERO LOT LINE LOTS) AND RECOMMENDING DEVELOPMENT APPROVAL OF A DUPLEX, MOUNDS VIEW PLANNING CASE 175-85 WHEREAS, there exists on the southwest intersection of County Road I and Silver Lake Road two duplexes zoned R-2; and WHEREAS, Ramsey County took approximately 875 square feet of land from the property for road right-of-way; and WHEREAS, the justification for the hardship for the variance is the taking of the property for County Road I right- of WHEREAS, the property needs a 530 square foot area variance in order to have this subdivision; and WHEREAS, the subdivision meets all other requirements; and WHEREAS, there is adequate setback from all roads and all property lines; and WHEREAS, the property owner has agreed to provide ease- ments and construct a storm water retention pond according to City requirements and remove the old detention pond; and WHEREAS, Mr. Leonard Kremer has requested City approval to construct a double bungelow in the City of Mounds View; and WHEREAS, construction of this building, as requested, requires approval of the development; and WHEREAS, the Planning Commission has reviewed the staff report and reviewed information submitted by the applicant which includes the following: I. Development plan 2. Site survey 3. Evidence of site control; and WHEREAS, the Planning Commission has reviewed this proposal and it is in conformance with all Chapters of the Municipal Code, specifically Chapters 40, 42, 49 and 49A and State Statutes; and . . . Resolution No. 14l-85 Page Two of Two WHEREAS, this development does not need to be reviewed by the Rice Creek Watershed District; and WHEREAS, the storm water control will be approved by the City Engineer prior to City Council approval; NOW, THEREFORE, BE IT RESOLVED that the Mounds View Plan- ning Commission approves the variance request by Leonard Kremer; BE IT FURTHER RESOLVED that the Mounds View Planning Commission recommends approval of the request by Leonard Kremer for a major subdivision and construction of a double bungelow; BE IT FURTHER RESOLVED that a development agreement be entered into between the City and the developer which includes the following: 1. Exhibits: a) Site, grading and utility plan b) Development plan c) Site survey d) Legal description e) Ordinance No. 49A 7-year performance bond of $1,OOO.OO f) Building plans and specifications 2. Security for the development in an amount to be determined. 3. Exhibit 2A to require the following: a) Secure approval from Ramsey County for curb cuts. b) Payment of all City expenses above and beyond amounts previously submitted. c) Other items as may be required by the City Council. BE IT FINALLY RESOLVED that the Mounds View Planning Commission direct staff to forward this resolution to the City Council prior to approval of the minutes. Adopted this 7th day of August, 1985.
