RESOLUTION NO. 145-85
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION REGARDING VARIANCE REQUEST BY RAY BODICK
(5100 SUNNYSIDE ROAD), MOUNDS VIEW PLANNING CASE 180-85
WHEREAS, Mr. Bodick, applied 'for a variance to construct a
deck closer to the property line than the Code allows; and
WHEREAS, he is requesting an 18 inch variance from the
setback requirement on the north and east sides of his property
for a wood deck; and
WHEREAS, the hardship is that the City ponds storm water
in his back yard without a drainage easement and the ponding
reduces the usability of his backyard because the soil is wet;
and
WHEREAS, the deck is constructed over the ponding area and
does not affect the storm water detention characteristics of the
pond;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission grants an 18 inch variance from the setback
requirement on the north and east sides of his property for a
wood deck.
