RESOLUTION NO. 203-87
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION DENYING A VARIANCE REQUEST FOR
SCOTT A. HYSER, 7340 SPRING LAKE ROAD,
MOUNDS VIEW PLANNING CASE NO. 223-87
WHEREAS, Mr. Scott Hyser, 7340 Spring Lake Road, has
requested a variance to allow construction of a 6 foot high
fence; and
WHEREAS, Mounds View Municipal Code, 40.04, Subdivision
H(3), requires that a fence not exceed 48 inches in height when
extended beyond the front line of the principle building; and
WHEREAS, Mounds View Municipal Code, 40.26, Subdivision
D, states the criteria for granting a variance; and
WHEREAS, there are no extraordinary circumstances applied
to the property which do not apply to other properties in the
vicinity.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission denies the variance request of Scott Hyser,
7340 Spring Lake Road, for a 6 foot high fence due to lack of
exceptional circumstances meeting the requirements of the Mounds
View Zoning Code.
Adopted this 7th day of October, 1987.
