'. . ~ MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 289-90 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING VARIANCE SETBACK REQUEST BY KUNZ OIL, 2280 COUNTY ROAD I, PLANNING CASE NO. 295-90 WHEREAS, the site plan is attached and shown as Exhibit A and dated April 16, 1990; and WHEREAS, the Planning Commission has reviewed the applicant's request for a variance from the side yard setback to allow the construction of a temporary accessory building on the site at 2280 County Road I; and WHEREAS, the accessory building would be used only for the purpose of housing the contamination clean up equipment; and WHEREAS, the building would be removed once the contamination clean up is completed; and WHEREAS, the Planning Commission has reviewed the criteria used when evaluating all variance requests; and WHEREAS, the Planning Commission determines that the requested variance meets the evaluation criteria; and WHEREAS, the Planning Commission determines that a situation exists on the property that affects the general health, safety and welfare of the community. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission approves the variance request based on the following: 1. The building is temporary in nature. 2. Documentation will be supplied to the City from the Minnesota Pollution Control Agency when the clean up has been completed. 3. The clean up will be completed by May, 1993. 4. If the clean up takes longer than anticipated, a time extension may be applied for. 5. The monitor wells will remain in place after the clean up. . . . Resolution No. 289-90 Page Two ATTEST: ( SEAL) , 6. When the temporary building is removed, the site will be restored to its original condition. 7. At the owner's expense, signage will be posted on the temporary structure indicating the use of the structure. 8. At the owner's expense, a mailing to all properties within 350 feet of the site will be sent indicating the nature of the clean up work. Adopted this 7th day of May, 1990.
