MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 293-90 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION DENYING THE REQUEST FOR MORE THAN ONE ACCESSORY BUILDING, ACCESSORY BUILDING SETBACK, AND SWIMMING POOL FENCE HEIGHT VARIANCE FOR DARYL MADISON, 5200 JEFFERY DRIVE, PLANNING CASE NO. 297-90 WHEREAS, the Mounds View Planning Commission has reviewed the request by Daryl Madison, 5200 Jeffery Drive, for an accessory building setback variance to allow three sheds existing on his lot to be at the property line and less than six (6) feet from each other; and WHEREAS, the Mounds View Planning Commission has reviewed the request by Mr. Madison for a variance in the fence height requirements for swimming pools from the required 5 feet to 3.5 feet; and WHEREAS, the Planning Commission has reviewed the conditions of the property in relation to this request; and WHEREAS, the Planning Commission has taken into consideration the fact that the sheds have existed for a number of years; and WHEREAS, the Planning Commission has reviewed ,the criteria used when evaluating all variance requests; and NOW, THEREFORE BE IT RESOLVED that, the Mounds View Planning Commission denies the variance request to allow the sheds to be at the property line and less than 6 (six) feet from each other based on the following: 1. No hardship exists. BE IT FURTHER RESOLVED that the Mounds View Planning Commission denies the request to keep the perimeter fence 3.5 feet high based on the following: 1. No hardship exists. BE IT FURTHER RESOLVED that the Mounds View Planning Commission denies the request for more than one accessory building based on the following: 1. No hardship exists. . . . RESOLUTION NO. 293-90 PAGE TWO BE IT FINALLY RESOLVED that the Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes.
