FOR 2865 HIGHWAY 10, GREG JOHNSON, PLANNING CASE NO. 320-90
WHEREAS, Mr. Greg Johnson has applied to rezone the
property located at 2865 Highway 10 from R-O, Residential-
Office District to B-3, Highway Business District; and
WHEREAS, Chapter 40.25, Subdivision A(5), provides
that the Planning Commission shall consider possible adverse
effects of the proposed amendment or conditional use. Its
judgement shall be based upon, but not limited to, the
following factors:
1. Relationship to Municipal Comprehensive Plan.
2. The geographical area involved.
3.
Whether such use will tend to or actually
depreciate the area in which it is proposed.
4. The character of the surrounding area.
5. The demonstrated need for such use.
WHEREAS, the rezoning request is inconsistent with the
City's Comprehensive Land Use Plan designation for this
property which is medium density residential; and
WHEREAS, a B-3 development on this property would be
directly adjacent to residential property on the north and
east; and
WHEREAS, the proposal has been submitted to the City
in order to allow the property owner to sell the property and
no development is currently before the Planning Commission or
City Council for their consideration.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends denial of this request because
of the following:
