MOUNDS VIEW PLANNING COMMISSION
RESOLUTION NO. 363-93
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RECOMMENDATION TO THE CITY COUNCIL REGARDING
CONDITIONAL USE PERMIT AND VARIANCE REQUEST BY GATEWAY FOODS,
2390 HIGHWAY 10, MOUNDS VIEW PLANNING CASE NO. 362-93
WHEREAS, Gateway Foods has requested City approval
to construct an automated car wash in the City of Mounds View;
and
WHEREAS, the Zoning Ordinance allows car wash uses
in the B-3, Highway Commercial District; and
WHEREAS, the development, as proposed, requires a
conditional use permit and variance; and
WHEREAS, the Planning Commission has reviewed the
following document regarding this development proposal:

(shown as boundary and topography survey)
WHEREAS, the Planning Commission has determined that
the conditional use permit request is in conformance with the
requirements of the Municipal Code, specifically Chapters 40,
42, 49 and 49A and State Statutes; and
WHEREAS, the Planning commission has determined that
the requested variance to allow placement of a structure 20
feet from an adjacent residential property where 40 feet is
required by Municipal Code does not meet the minimum necessary
requirements for hardship.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends denial of the conditional use
permit and variance request based upon the following:
1. No hardship has been presented by the
applicant.
2 . Reasonable use of the property does exist.
3 . The request for variance is not unique to this
property.

BE IT FINALLY RESOLVED THAT the Planning commission
directs Staff to forward this resolution to the city Council
prior to approval of the minutes.
