RESOLUTION NO. 399-94
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING A MINIMUM BUILDING SEPARATION VARIANCE
AT 5299 CLIFTON DRIVE, PLANNING CASE NO. 394-94
WHEREAS, the Mounds View Planning commission has
reviewed the request of Larry and Susan Potts for a variance to
allow a reduction in the minimum building separation at 5299
Clifton Drive; and
WHEREAS, the Mounds View Municipal Code requires that
all structures be separated by a minimum of six (6) feet; and
WHEREAS, the applicant's request for variance would
allow construction of an addition to their single family home
which would be four (4) feet from an existing detached garage;
and
WHEREAS, the Planning Commission has reviewed the
criteria used to evaluate all variance requests; and
WHEREAS, the Planning Commission has determined that no
reasonable alternatives for the location of the house addition
are available; and
WHEREAS, the variance requested is the minimum
necessary to alleviate the hardship; and
WHEREAS, the Uniform Building Code allows structures
closer than six (6) feet to one another with proper installation
of fire walls.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission approves the request of Larry and Susan Potts
for a variance to allow a four (4) foot setback between
structures on their property contingent upon the following:
1. All applicable regulations contained in the Uniform
Building Code relating to fireproofing of walls shall be
adhered to.
