MOUNDS VIEW PLANNING COMMISSION RESOLUTION NO. 452-96 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING AMENDING CHAPTER 1106 OF THE MOUNDS VIEW MUNICIPAL CODE ENTITLED "R-l, SINGLE FAMILY RESIDENTIAL DISTRICT," PERTAINING TO FOSTER CARE FACILITIES WHEREAS, the purpose of the Zoning Code is to protect the public health, safety and welfare of residents of the City; and WHEREAS, this purpose is accomplished by regulating permitted and conditional uses within zoning districts; and WHEREAS, the existing Zoning Code restricts the number, ages of children and the duration of their stay at a foster care facility; WHEREAS, the Minnesota Statutes 462.357 Subd. 7 allows for a state licensed residential facility serving six or fewer persons; a licensed day care facility serving 12 or fewer persons; a group family day care facility licensed under Minnesota Rules, parts 9502.0315 to 9502,0445 to serve 14 or fewer children as permitted single-family uses; and WHEREAS, the existing Mounds View Zoning Code is in need of modifications to adequately meet the Minnesota statute requirements; and NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends modification to the Chapter 1106, Section 1106,02 entitled R-l, Single-Family Residential District, to include the following permitted uses: a. A state licensed residential facility serving six or fewer persons; b, A licensed day care facility serving 12 or fewer persons; c. A group family day care facility licensed under Minnesota Rules, parts 9502,0315 to 9502.0445 to serve 14 or fewer children, d, Residential facilities whose primary purpose is to treat juveniles who have violated criminal statutes relating to sex offenses or have been adjudicated delinquent on the basis of conduct in violation of criminal statutes relating to sex offenses shall not be considered a permitted use. e, Not withstanding the provision of subdivision 2 of Section 1106,02 herein, foster family homes as identified in Chapter 9545, Section 6545,0010, Subp, 7 of Minnesota Rules shall be allowed as permitted uses to serve not more than eight children per home, not including the foster family's own children, NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Mounds View recommends approval of Ordinance No. 575, an ordinance relating to foster family homes and amending the Mounds View Zoning Code by amending Chapter 1106, Section . . . RESOLUTION NO, 452-96 (FOSTER CARE AMENDMENT) PAGE TWO OF TWO , 1106,02, entitled "R-1 Single Family Residential District," BE IT FURTHER RESOLVED that the Mounds View Planning Commission directs Staff to forward this Resolution to the City Council prior to approval of the minutes.
