RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT
TO ALLOW FOR AN OVERSIZE]) GARAGE AT 8100 LONG LAKE ROA]);
MOUNDS VIEW PLANNING CASE NO. 546-99
Whereas, Richard Maid has applied for a conditional use permit to expand an existing
400 square-foot garage by an additional 580 squarc fect on propcrty located at 8100 Long Lake
Road, zoned R-l, Single Family Residential, legally describcd as followed:
The East 133 Feet of the South 162 Feet of the NE Quarter of
Section 6, Township 30, Range 23
RAMSEY COUNTY, MINNESOTA
WHEREAS, there is currently a 400 square-foot garage and an 80 square-foot shed on
this lot; and,
WHEREAS, The Mounds View Zoning Code allows, with a conditional use permit, up
to 1,400 square feet of garage/accessory building on one lot; and
WHEREAS, the Planning Commission has reviewed the following documents regarding
this proposal:
a. Planning Application
b. Zoning Map
c. Site Plan
d. Area Map with Building Footprints
WHEREAS, the Planning Commission finds that the dimensional requirements as stated
in Chapter 1104 the Zoning Code for this proposal havc been met; and,
WHEREAS, the Planning Commission makes the following findings that possible
adverse effects have been considered in its recommendation, as required by Section 1125.01
Subd. I.e.:

Relationship with thc Comprehensive Plan.
177e Comprehensive Plan encourages the development and maintenance qf'residential areas so as
to improve the quali(v. appearance and attractiveness (?f' housing units and residential property in
general. The Comprehensive Plan designates this property. 8100 Long Lake Road. as low-density
residential. This proposal does not C01?flict with the Comprehensive Plan.

2,4. The Geographical Area Involved & the Character of the Surrounding Area.
In this area ofAlound\' View. there is a good mix behreen 101 ger lots and smaller lots. Alost of the
homes in the immediate area are (~lthe same size and age. many of which having garages as large
or larger than that (?f 8100 Long [,ake Road. More than half of the garages in the area are
attached to the principal strw:ture. A larger garage 011 the su~ject proper(v would not appear out
(?lplace.
3. Whether such use will tend to or aetually depreciate the arca in which it is proposed.
Increasing the size of the existing garage will have an immediate positive impact on the property
value for the su~ject property. and /1/{~V actual(v increase the perceived values o.fthe homes
surrounding 8100 Long Lake Road in that vehicles ll'hich were once parked or stored outside
would be stored inside the garage addition. [t is not conceimble that this garage addition would
depreciate the surrounding area in any ll'{~l'.
5. The demonstrated need for such a use.
The existing garage is too s/1/allfor the need\' (?fthe proper(v owner. The applicant desires a large
enough garage to park his vehicles inside. protectedji'om the elements a1/{1 possible vandalism.
WHEREAS, the Planning Commission makes the following findings regarding the criteria
for approval ofa conditional use permit, as required by Section 1125.01 Subd. 3.b.:
I. The use will not create an exeessive burden 011 existing park~', schools, strects and other public
facilities and utilities whieh serve or are proposed to scrve the area.
7. The use will not cause traffic hazards or congestion.
8. Adequatc utilities, access roads, drainage and Ilceessary faeilities have been or will be provided.
Adding an addition to the garage, even one as large as is being requested. would not create a
greater impact on existing public facilities. parks. schools or services. 011 utilities or access roads.
nor lvould it create WI increase in tnri/ic 0/1 adjacem streets.
2. The use will be sufficiently eompatible or separated by distance or screcning from adjacent
residentially zoned or uscd land so that existing homes will not be deprcciated in value and there
will be no deterrence to development of vacant land.
3. The structure and site shall have an appearance that will not have an adverse effect upon adjacent
residential properties.
Because this is a small lot. the expanded garage would have little visual screening. In terms o.f its
relationship with the tlro adjoining properties. the garage is separatedfrom the property to the
north by another garage, so the e.\pansion would have little impact upon that property. The
property to the west would not be separated by much distance or all)-' physical screening

The use, in the opinion of the City Council, is reasonably rclated to the ovcrall needs of the City
and to the existing land use.
The use is consistent with the purposes of the Zoning Code and the purposes of the zoning distriet
in which the applicant intends to locate the proposed use.

6. The use is not in conflict with the Comprehensive Plan of the City.

NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission
recommends approval of the conditional use permit to allow for a 980 square-foot garage \vith the
following stipulations:
1. The conditional use permit shall he recorded with Ramsey County within 60 days
of City Council approval, and a receipt of such recording shall be provided to the
City of Mounds View.
2. The garage shall not be used for living space or other uses not allowed by the
district in which it is located or by the Zoning Code. Should the use change for
which the permit was granted. the conditional use permit shall become null and
void.
3.
The garage shall be designed and maintained to provide a uniform building
appearance with the house.
4.
The driveway leading to the garage expansion shall be improved with a permanent
surfacing material of either concrete or asphalt in conjunction with the construction
of the garage. If occupancy of the garage is to occur prior to the driveway" s
improvement, the applicant shall submit a Ictter of credit or performance bond in an
amount equivalent to the valuation of the work yet to be completed. as estimated by
the Community Development Dircctor.
5. All vehicles parked at the propel1y shall be parked either upon the driveway's
improved surface or within the garage. At no time shall a vehicle be allowed to
park upon the grass or off of the improved surface.
6. The existing shed on the lot shall be moved if necessary to maintain a
minimum six-foot setback fi'om the garage.
7. The square footage allow-ed by this Conditional Use Permit shall not excecd 1,060
square feet (980 squarc Icet ('or thc proposed garagc, 80 square fcet for the existing
shed.)
BE IT FINALLY RESOLVED that the Planning Commission directs staff to larward this
resolution to the City Council prior to approval of the minutes.
